Book excerpt: The International Convention on the Elimination of All Forms of Racial Discrimination was adopted thirty-five years ago, on 21 December 1965, by the General Assembly of the United Nations, and entered into force on 4 January 1969. It was the first of the universal human rights treaties with a treaty-monitoring body to be adopted and enter into force. At present, 156 States have ratified or acceded to this Convention. Under article 9 of the Convention, each State party has to submit a report within one year after the entry into force of the Convention for that State and thereafter every two years and whenever so requested. The Committee on the Elimination of Racial Discrimination has been formed to monitor the implementation of the Convention. At its fortieth session, in 1991, the Committee initiated the practice of adopting concluding observations by the Committee as a whole on each report it considered, and at its forty-third session, in 1993, the Committee started to use a standard format for the presentation of its concluding observations. The Committee makes a general evaluation of the report and of the dialogue with the delegation, and it makes note of positive developments that may have occurred during the period under review, of factors and difficulties impeding the implementation of the Convention, and of principal subjects of concern. It also makes suggestions and recommendations to the State party concerned. The present volume contains concluding observations adopted by the Committee on the Elimination of Racial Discrimination at its forty-third to fifty-seventh sessions (1993-2000). It asks whether Muslim States can comply with international human rights law whilst adhering to Islamic law. The traditional arguments on this subject are examined and responded to from both international human rights and Islamic legal perspectives. The volume engages international human rights law in theoretical dialogue with Islamic law, facilitating an evaluation of the human rights policy of modern Muslim States. International Human Rights and Islamic Law formulates a synthesis between these two extremes, and argues that although there are differences of scope and application, there is no fundamental incompatibility between these two bodies of law. Baderin argues that their differences could be better addressed if the concept of human rights were positively established from within the themes of Islamic law, rather than by imposing it upon Islamic law as an alien concept. Each article of the International Covenant on Civil and Political Rights, and the International Covenant on Economic, Social and Cultural Rights, as well as relevant articles of the Convention on the Elimination of All Forms of Discrimination against Women are analysed in the light of Islamic law. The volume concludes that it is possible to harmonise the differences between international human rights law and Islamic law through the adoption of the 'margin of appreciation' doctrine by international human rights treaty bodies and the utilization of the Islamic law doctrines of 'maqâsid al-sharî'ah' (the overall objective of Sharî'ah) and 'maslahah' (welfare) by Muslim States in their interpretation and application of Islamic law respectively. Baderin asserts that Islamic law can serve as an important vehicle for the guarantee and enforcement of international human rights law in the Muslim world, and the volume concludes with recommendations to that effect.

The existence of this hierarchy is proven and critiqued through three case study chapters that respectively explore the extent to which non-religious and atheist rights-holders enjoy freedom from proselytism, freedom from hate and freedom from the religions of their parents.
