Book excerpt: Originally published in 1986, reissued here with a new preface, this study of the origins and early development of family conciliation services in Britain outlines their philosophy, methods of work and reported results, illustrated with case examples. The examples demonstrate that disputes between separating and divorcing couples involve complex personal and family problems as well as legal ones, and that the practice of conciliation needed to be set in the context of current changes in family law and court procedures. At the time many solicitors and courts were adopting a settlement-seeking approach in matrimonial cases rather than a sharply adversarial one, and the complementary roles of solicitors and conciliators gave rise to dilemmas in practice, as well as offering potential advantages. This book draws a parallel between the work of ACAS in industrial disputes and the similar approach of family conciliation services, but points out that there are also major differences. It also shows how the experience of conciliation practice gained in other countries throws some useful light on the questions being raised in Britain. Research findings from Australia, Canada and the United States are used in discussing the future of conciliation in the short and longer term, and in looking at the possible development of alternative methods of resolving disputes.

Book excerpt: "Divorce mediation offers mental health professionals and lawyers an effective way to help couples dissolve their marriages, minimizing the frustration and animosity commonly associated with the adversarial process. The rapid growth of divorce mediation centers is evidence of the need for specially trained professionals who can continue working with clients once the decision to divorce is made. This handbook will enable clinical psychologists, counselors, clergy, and social workers to expand their practice into this important field. Lawyers also will find the book useful in relating to divorce clients and to mediators. The author presents a model for helping couples negotiate mutually beneficial separation agreements while coping emotionally with divorce. He demonstrates how a mediator helps resolve key issues concerning the division of personal and real property, support, children, and plans for the future. He gives step-by-step guidelines for moving through the mediation process and illustrates this with nine case studies. Also included are a discussion of the special problems of children of divorcing couples, and appendixes containing a manual for clients and sample separation agreements." -- Jacket.

But divorce no longer has to mean pain, exhaustion, or suffering. Today, you can choose to mediate your separation or divorce and save yourself time, money, and aggravation. Mediation enables couples to create custom-made agreements that work for everyone and that pave the way for an amicable future relationship. In this accessible question-and-answer guide, two experts offer solid advice and cover all the bases. Among the hundreds of entries inside you'll find answers to your most basic questions: o How do we find a mediator? o How does court-ordered mediation work? o What are fault and no-fault grounds for divorce? As well as your most confusing issues: o We have children but we never married, and now we're splitting up. Can we use mediation to provide for our children in the future? o Our baby is still nursing. How does that affect custody and visitation? o Does child support include medical bills? Health insurance? o How do we decide who gets the frequent flier miles? Who gets the dog? o If we sell our home, how do we divide the proceeds? o Am I entitled to a portion of my spouse's Social Security benefits? o When we complete our separation agreement, do we need new Wills and any other new documents? An invaluable resource section, with a listing of mediators around the country as well as other sources of information, makes this book an essential tool for any couple about to separate. Whether you're contemplating separation or are in the midst of a complex divorce, this book will empower you, will provide you with a base for entering into negotiations, and will offer support and guidance throughout the process, from both a legal and emotional perspective. Available in PDF, EPUB and Kindle. Book excerpt: Mediation, as a procedure to assist couples in dealing with the problems incident to their separation and divorce, is still relatively new in the United States. For the would-be practitioner, that poses certain problems. Divorce mediation cannot provide a long history of generally accepted procedures. Nor is there even a body of information to which would-be practitioners can turn for instruction or guidance. And, of course, there are no established schools that can train or prepare a practitioner to do this work. To make matters worse, the situation is likely to remain in this state for some time to come. Given this fact, it was felt that it would be useful for practitioners (even for those already engaged in divorce mediation) to have a handbook which would trace a typical mediation from its inception to its conclusion and which would provide them with the substantive informa tion they need to know in order to do divorce mediation. It is hoped that this handbook will fill this need. Having said that, however, it must be acknowledged that the purpose of this book is very much beyond that. Until now, divorce mediation in the United States has been shaped principally by such books as O. J. Coogler's Structured Mediation in Divorce Settlements: A Handbook for Marital Mediators, 1 and John Haynes' Divorce Mediation: 2 A Practical Guide for Therapists and Counselors.

This information is released in a new book that outlines a public relations program to raise consumer awareness of divorce mediation. Good Divorces, Bad Divorces: A Case For Divorce Mediation concentrates on strategies for influencing consumer behavior, communications, and the efficient use of mass media aimed at special populations. Attitudes, behavior, images, credibility, and demographics, are discussed. Included in the book are samples of press releases, brochures, scripts, print ads, etc., for the mediator to use to educate the majority of men and women who have never heard of Divorce Mediation. Dr. Hauser, Assistant Professor at New York University, and Family Mediator, has fused her two decades of being president and chief operating officer of three major businesses in the field of communication-- advertising, public relations and marketing with her research in divorce mediation to write this do-it-yourself public relations plan for Divorce Mediators.

Book excerpt: Relationships between adult partners following divorce or separation can be fragile, and the issues which have divided the parents are often hard to disentangle from the ongoing relationships between parents and children. There is a small group who have ongoing difficulty and who need professional help and legal intervention to make arrangements for ongoing parenting. This volume brings together a wealth of new empirical research from the USA, Central, North Western and Southern Europe, and Australia on the nature and importance of children's relationships with parents after parental separation, on the kinds of conflicts which develop, and on the range of professional interventions which support parents and children through these difficult times.

This manual is meant to positively assist and inform couples engaged in the process of divorce mediation, helping them navigate the process. Divorce mediation is about choosing what to do when a marriage is coming apart, and decisions must be made about whats best for both parties. If there are children involved, the mediation process can become an important process to promote a healthy connection between the parents and the children. In mediation, the couple meets with a neutral third party, the mediator; with his or her help, they work through the issues they need to resolve, so they can end their marriage peacefully, respectfully, and inexpensively. The basic topics to resolve in mediation include the following: Division of assets and debts Child custody and establishing a parenting plan Child support, spousal support, or family support Division of employee/retirement benefits Resolving reimbursement claims Avoiding taxes and defining the tax basis of assets to be divided Divorce Mediation Manual is an effective guide to making the right choices when considering a divorce or engaged in divorce mediation.
