Accordingly, the Law on Competition gives now the fined undertakings the right not to pay their fine until the courts adopt a final ruling in their case. Book excerpt: For years, competition law remained the preserve of large jurisdictions, but after the political and economic transformations of the late 1980's a number of new actors came to the stage. Many of them were small, developing countries with modest human and financial resources and limited or no experience in free market economy and liberal democracy. The speed with which such countries embraced competition rules left little time for analysis of whether such rules were needed, what they should be and how they were going to be enforced. As time passed, proliferation of competition laws in small countries attracted attention of academics and practitioners, but huge linguistic diversity, especially in Europe, imposed high barriers on what materials could be accessed for analytical purposes. As a result, most legal writings remain limited either to high-level comments on the available translations of statutory texts or to short accounts of selected cases and enforcement statistics, or a combination of both. -- In contrast, this dissertation presents an in-depth analysis of two decades of competition law enforcement in one of such small countries, and the current EU member, Lithuania. The author takes commonly identified challenges that competition authorities are expected to face and, drawing on the extensive review of the case-law, demonstrates how these challenges have been met in reality. The thesis considers that far from being transitory most of the size-related difficulties - such as political interference with the operations of the competition agency or the latter's lack of sufficient financing and qualified personnel - could be of a more permanent nature, and therefore the priorities of a small country's competition authority should be correspondingly adjusted.

Private law codification initiative, which began in 1989, after more than twenty years was recently reduced to optional non binding common sales law draft, which is gradually making its way through the EU institutions' legislative process. Choice of EU regulation as a form indicates that the willingness to reach objective results is strong enough, but the reasoning in support of this project faces equally strong argument against it. Lithuanian experience expands this discussion in several important respects. Rome I Regulation Article 6.2. deadlock solution is specifically beneficial for smaller countries, where market participants have less bargaining power. In addition, an optional supplementary regulatory framework that the parties could choose, would allow testing existing legal systems by competition. Lithuania's recent reform experience suggests that the draft regulation provides for a smooth change in Europe. Multilingualism, some of the Common European Sales Law solutions, radically different from the Lithuanian national legal provisions will certainly require revision of the existing concepts, but that is not a reason not to try to improve the EU's common private law.
