Book excerpt: "Prevalent claims ("too many," "too dangerous," "too expensive," "too different") portraying refugees and asylum seekers as security, economic and cultural identity threats are driving the disarticulation of human rights and international refugee law protections at domestic and regional levels. This notwithstanding that, of the 34 million refugees and asylum seekers in the world today, nearly 14 million are children. This dissertation explores whether the suggested ineluctable choice between protecting host-countries' national security interests (security claim) or protecting refugees (moral claim) is truly justified or, if not, can be redressed. And it analyzes whether legal reasoning alone can unravel critical distortions, contradictions and disconnections on security, reality, diversity and morality. Drawing on a different rationalisation process developed through a comparative legal analysis, a multidisciplinary approach on reality and diversity (history, anthropology, neuropsychology, physics, law) and an interdisciplinary analysis on security, law and morality (legal theory, constitutional morality, quantum theory), the thesis argues that these claims neither oppose nor complement to each other but are instead--despite perceptional and legal gaps--very much aligned through a multidimensional purpose: security. The thesis concludes: protecting one above the other, protects none. Four findings support this assertion. First, the evolution of international refugee protection going from the Postwar (victims of persecution entitled to human rights and refugee protections), Modern (suspects subject to prosecution and detention) and Final Refugee Paradigms (criminalized migrants subject to exclusion, rejection, abandonment) leads to its gradual disarticulation. Second, the reception and treatment of refugees and asylum seekers (State practices, polices, regulations, agreements) across the world indicate that international refugee law is falling into desuetude. Third, critical disconnections of reality (perceptional gap) and morality (legal gap) show conflicts of diversity, not security. Fourth, elaborating on evolving and emerging yet neglected risks as well as on moral and legal choices, a theoretical proposition (constitutional entanglement and morality) shows that it is not only possible but inherently necessary to redress the effects of the thereby mis-constructed security claim promoting the protection of national security above the protection of migrants. Book excerpt: Concerns are raised about the increasingly restrictive tendencies of the regime for refugee protection that has been developing in the European Union (EU), which relies on the 1951 Convention relating to the Status of Refugees (1951 Convention) and the 1967 Protocol Relating to the Status of Refugees (1967 Protocol), as the foundations of the universal regime for refugee protection. In the attempt to address a possible contradiction between the universal norms and their implementation at the regional level, the thesis provides a comparative analysis of norms, but also of other elements of the two regimes for refugee protection, and in that way addresses its research question about the extent to which the EU followed universal principles and norms for refugee protection and its consequential reflection in the quality of refugees protection at the EU level. Within a theoretical framework of international regimes and other relevant theories, and with a reference to specific social, political and economic circumstances, the comparative analysis of both regimes reveals the extent to which the EU has followed universal norms, by showing that although the EU regime for refugee protection relies on the same fundamental norms as the universal regime for refugee protection, and even expands them, it also introduces a number of elements that limit degree and quality of refugee protection in the EU, and thereby endanger the foundational norms. These contradictories within the EU regime itself, further reveal the weakness of the regime, but also contradictory characteristics of its relationship with the universal regime.
