In the name of Almighty God: The United States of America and the United Mexican States, animated by a sincere desire to put an end to the calamities of the war which unhappily exists between the two republics, and to establish upon a solid basis relations of peace and friendship, which shall confer reciprocal benefits upon the citizens of both, and assure the concord, harmony and mutual confidence wherein the two people should live, as good neighbors, have for that purpose appointed their respective plenipotentiaries, that is to say, the President of the United States has appointed Nicholas P. Book excerpt: Excerpt from Claims Against Mexico The misunderstanding between Mexico and other nations in the matter of claims for losses sustained during the Mex ican revolutions Since 1910 has been intensified by the failure of many statesmen, politicians and publicists, particularly in Mexico and the United States, to reach conclusions in accord ance with well-settled principles of international law and sound diplomatic practice. When occasion has arisen for a determination of policy, tragedy has several times threatened because eloquence displaced clear thinking and judicial deliberation. Many estimates of the damages sustained by aliens in Mexico have been made, but these estimates at best are but guesses. Strange though it may seem, there has heretofore been no attempt to collect the principles of international law applicable particularly to the Mexican situation, and to view the issue of responsibility and liability, and to measure the recoverable quantum of damage, with such a codification as a foundation. In the preparation of this volume there has been little occasion for originality. Practically the entire subject is governed and controlled by diplomatic precedents readily available to the student and discussed in the works of author ities. This treatise is not, therefore, a composition, but a compilation. Selection has been made, wherever possible, of international precedents covering controversies to which Mexico has been a party, and because Of the peculiar position of the United States under the Monroe Doctrine, particularly of precedents between the United States and Mexico further more, it has not been possible within a volume of this size to exhaust the subject or even to indicate the law applicable to every possible type of Claim. Book excerpt: Excerpt from Proceedings of the International Boundary Commission, United States and Mexico: Diversion of Rio Grande by American Rio Grande Land and Irrigation Company The Honorable, The Secretary of State: Sir: I have the honor to enclose herewith Joint Journal of this Commission, in Spanish and English, in the case presented by the Mexican Commissioner known as the "Horcon Ranch Case." This case was also brought to the attention of the Department by the Mexican Embassy and was referred to me in the Department's letter of October 12, 1906. Our investigation has disclosed the fact that the American Rio Grande Land and Irrigation Company some time last Spring became aware of a threatened banco cut-off in the Rio Grande on Mexican soil, which cut-off would take the channel of the river away from the site selected by them for a pumping station, and they made endeavors extending over a period of three months, assisted by the Mexican owners, to prevent this cut-off, but finally became convinced that it was impossible to stop the erosion of the soft soil, and knowing that their works would be removed from the channel of the river and a sufficient supply of water for their pumping plant they determined in the early part of June to resort to the opening of another cut-off, by artificial means, below their pumping works, being perfectly aware that this latter artificial cut-off would carry the erosive current away from the point where the natural cut-off would in a short time be fully accomplished if no action was taken. As soon as the Mexican authorities were apprised of this work they sought in several ways to prevent or restrain it, and the Mexican Consul in Brownsville on July 1, 1906, addressed a communication to Mr. Silver, as President (he is really the General Manager) of the company, warning him that the work was in violation of the Treaty, a copy of which is submitted with the proceedings. Later on Mr. Mendiola, as engineer of the Department of Public Works of Mexico, visited the location and reported of what was being done to his Government, when the Secretary of Foreign Relations requested the Mexican Commissioner, Mr. Puga, to call a meeting of the Joint Commission to take up the case. For reasons of convenience and completeness the resolution and order under which the commission acted are quoted in full: Joint Resolution Directing the Secretary of War to investigate the claims of American citizens for damages suffered within American territory and growing out of the late insurrection in Mexico. Resolved by the Senate and House of Representatives of the United States of America in Congress assembled, That the Secretary of War be, and he is hereby, authorized and directed to make, or cause to be made under his direction, a full and thorough investigation of each and all claims of American citizens and of persons domiciled in the United States which may be called to his attention by claimants or their attorneys for damages for injuries to their persons or property, received by them or by those of whom claimants may be the legal representatives, within the boundaries of the United States, by means of gunshot wounds or otherwise inflicted by Mexican Federal or insurgent troops during the kite insurrection in Mexico in the year nineteen hundred and eleven. For the purpose of such investigation the Secretary of War is authorized to appoint a commission of three officers of the Army, one of whom shall be an Inspector general. Such commission shall have authority to subpoena witnesses, administer oaths, and to take evidence on oath relating to any such claim and to compel the attendance of witnesses and the production of books and papers In any such proceeding by application to the district court of the United States for the district within which any session of the commission is held, which court is hereby empowered and directed to make all orders and issue all processes necessary for that purpose, and said commission shall have all the powers conferred by law upon inspectors general of the United States Army in the performance of their duties. Such commission shall report to Congress, through the Secretary of War, as soon as practicable, its findings of fact upon each and all the claims presented to it and its conclusion as to the justice and equity thereof and as to the proper amount of compensation or indemnity thereupon.
