Book excerpt: SBT/A 19 features selected papers from the Borderless Beckett / Beckett sans frontières Symposium held in Tokyo at Waseda University in 2006. The essays penned by eminent and young scholars from around the world examine the many ways Beckett's art crosses borders: coupling reality and dream, life and death, as in Japanese Noh drama, or transgressing distinctions between limits and limitlessness; humans, animals, virtual bodies, and stones; French and English; words and silence; and the received frameworks of philosophy and aesthetics. The highlight of the volume is the contribution by Nobel Laureate J. M. Coetzee, the special guest of the Symposium. His article entitled "Eight Ways of Looking at Samuel Beckett" introduces a variety of novel approaches to Beckett, ranging from a comparative analysis of his work and Melville's Moby Dick to a biographical observation concerning Beckett's application for a lectureship at a South African university. Other highlights include innovative essays by the plenary speakers and panelists - Enoch Brater, Mary Bryden, Bruno Clément, Steven Connor, S. E. Gontarski, Evelyne Grossman, and Angela Moorjani - and an illuminating section on Beckett's television dramas. The Borderless Beckett volume renews our awareness of the admirable quality and wide range of approaches that characterize Beckett studies.

Available in PDF, EPUB and Kindle. Book excerpt: This book aims to fill a void in the literature on the contributions of the state to the social protection, educational training, and human security of its overseas citizens. Additionally, Michel S. Laguerre seeks to explain the rise of the postdiaspora condition: an emancipatory metamorphosis of diaspora status. Laguerre pays particular attention to the crossborder services that the state provides, transfrontier mechanisms developed by various institutions, as well as extraterritorial forms of management and governance. He sheds light on complex crossborder arrangements and management, the multiplicity of crossborder agencies and organizations, and the promulgation of new laws that provide a legal basis for these extraterritorial undertakings by the state. The ability of emigrants to hold citizen status—and to enjoy access to the same rights and privileges as those offered to residents of the homeland—sets the cosmonational context for the performance of the postdiaspora condition.

It is alive and growing in Canada, Russia, China, Italy, Belgium, Britain, and even the United States Yet secession remains one of the least studied and least understood of all historical and political phenomena. The contributors to this volume have filled this gap with wide-ranging investigations - rooted in history, political philosophy, ethics, and economic theory - of secessionist movements in the United States, Canada, and Europe.

Book excerpt: Efficiency, economy, and equity are policy goals pursued by governments around the world, but analysts and evaluators have devoted more effort to measuring and evaluating the first two. In Speaking Justice to Power, contributors examine the concept of equity, the role it plays, and its application in policy evaluation. Here some of the most valuable thinkers in the area of policy studies address key questions: How should evaluators develop criteria for measuring equity as they analyze both program and policy implementation as well as their impacts? What distinctions among people should be taken into account when measuring and valuing impacts? What sorts of data should be used to analyze processes and impacts in different settings? How might such data be validated? The contributors employ grounded-theory thinking as they translate key ethical principles into their work and draw important lessons from their experiences. The work discusses equity in interventions addressing a variety of social and environmental problems. This volume continues the fine tradition of Transaction’s Comparative Policy Evaluation series.

Available in PDF, EPUB and Kindle. Book excerpt: Permanent establishment is the key concept for allocating taxation rights in respect of business income, and the question ‘Is there a permanent establishment?’ is a tax treaty issue that advisers, government officials, and courts perennially confront. Based on a ‘fixed link to the ground’, the idea has become progressively more difficult to apply until, at this stage, re-evaluation has become a political necessity. If a permanent establishment may exist in the context of e-commerce, the concept of a geographical presence must be redefined. However, the question remains: Is e-commerce a sufficient reason for challenging the well-established permanent establishment nexus? Drawing on case law, administrative practice, and business decisions in numerous jurisdictions, the author discusses the permanent establishment criteria under conditions of e-commerce and the service economy. He shows that the OECD Model Convention and its commentaries already offer the basis for the evolution of the analysis of the concept, and that the preservation of permanent establishment protects and maintains the level playing field between capital importing and capital exporting economies. He examines in depth such elements as the following: ;the prevalence of commercial coherence over geographic coherence; the role of value-added tax; services permanent establishment; relevant definitions of ‘activity’ and ‘personnel’; multiple permanent establishments; supervision activity and sub-contracting; the differences between civil law and common law concepts of representation; particular treatment of the insurance sector; the ‘force of attraction’ concept; and specific exceptions (e.g., transportation, artists and sportsmen, rental income, agricultural activities, pipelines). Taking into account important distinctions between two model conventions (OECD and UN), as well as pertinent EU directives and the impact of EU law, the author proposes minor amendments to the OECD Model that adapt it to economic reality and current trends in jurisprudence and that can be implemented immediately. An appendix includes Article 5 and its commentaries as they have evolved since 1963, with the successive addenda and deletions. The author’s 20-plus years of experience as a tax lawyer lend the presentation a thoroughly practical aspect. The work addresses in more detail than any other publication the topic of profit allocation to a permanent establishment in the e-commerce world, an issue which is evolving rapidly in the current economic environment. Tax advisors, lawyers, and interested academics and policymakers will benefit from the book’s clear analysis of the conditions under which a permanent establishment not only should be preserved, but also how it is likely to be adapted in the future.

Celebrating the long-standing and sustained contribution Eric Bergsten has made in international commercial law, international arbitration, and legal education, more than fifty colleagues – among them quite a few of the best-known arbitrators and arbitration academics in the world – present 45 pieces that, individually both engaging and incisive, collectively present a thorough and far-reaching account of the state of the field today, with contributions covering international sales law, commercial law, commercial arbitration, and investment arbitration. In addition, nine essays on issues in legal education mirror the great importance of the renowned Willem C. Vis International Commercial Arbitration Moot, Eric’s Vienna project which has offered a life-changing experience for so many young lawyers from all over the world.

Available in PDF, EPUB and Kindle. Book excerpt: The founding president of the International Association of Geomorphologists, Denys Brunsden, outlines in the opening chapter ten responsibilities for geomorphologists in today s world. In the "Great Debate" which follows, a distinguished international panel (Baker, USA; Bremer, Germany; Slaymaker, Canada; Tricart, France; Twidale, Australia; Yatsu, Japan; and Brunsden himself) debate the ten principles of geomorphology propounded by Brunsden in 1982 as a framework for the development of the subject. The second part of the volume consists of five review essays which were presented as plenary addresses by leading Canadian and international geomorphologists. Frank Ahnert evaluates the role of modelling in geomorphology, focusing on process response models and their design, and makes a plea for simplicity in the face of complexity. Yoko Ota draws attention to plate tectonic processes in her authoritative review of coral reef terrace sequences around the northern Pacific. Anders Rapp, a Scandinavian mountain geomorphologist, adds new insights to our understanding of the destruction and preservation of ancient surface forms in alpine zones. Many of Rapp s themes are also considered by Derek Ford in his essay concerning the impact of glacial and periglacial processes upon the karst landscapes and groundwater systems of Canada. In the concluding essay, John Shaw presents an exciting and imaginative new interpretation of Canada s glacial landscapes and the role of giant meltwater floods. There is an underlying theme in this volume of the need for professionalism within the discipline and for a wide dissemination of findings, especially applied work, directed particularly to the developing world.
