Il volume si prefigge lo scopo di offrire il quadro, quanto più possibile aggiornato e tempestivo, delle novità apportate dalla riforma nel settore degli appalti pubblici e delle concessioni, non tralasciando di ricostruire, nella prima parte, i passaggi salienti del processo di riforma, dall’adozione delle direttive da parte delle Istituzioni europee, alla delega al recepimento conferita al Governo nazionale, sino all’attuazione della delega stessa. Nella nuova edizione sono riportate le rettifiche al testo del D.Lgs. n. 50/2016 derivanti dal Comunicato pubblicato sulla Gazzetta Ufficiale n. 164 del 15 luglio 2016, le disposizioni integrative e correttive del testo derivanti dal D.Lgs. n. 56 del 2017, le recentissime modifiche in tema di poteri ANAC apportate dalla legge n. 96 del 21 giugno 2017, nonché le principali novità in materia di servizi di architettura e ingegneria, offerta economicamente più vantaggiosa, responsabile unico del procedimento, procedura sottosoglia, commissione di gara, mezzi di prova per l’esclusione dalle gare ed affidamenti diretti alle società in house, contenute nelle Linee Guida approvate dall’ANAC.

The main focus of The Legal Order is the notion of institution, which Romano considers to be both the core and distinguishing feature of law. After criticising accounts of the nature of law centred on notions of rule, coercion or authority, he offers a compelling conception, not merely of law as an institution, but of the institution as ‘the first, original and essential manifestation of law’. Romano advances a definition of a legal institution as any group who share rules within a bounded context: for example, a family, a firm, a factory, a prison, an association, a church, an illegal organisation, a state, the community of states, and so on.
