Available in PDF, EPUB and Kindle. Book excerpt: Reprint of the first English edition, based on the 12th American edition with notes on English decisions by W.E. Grigsby. Originally published: London: Stevens and Haynes, 1884. lxxiii, 1093 pp. "Probably the decisive factor in our reception of English equity was Story's Equity Jurisprudence. With much art (...) he made it seem that the precepts established by the decisions of the English Courts of Chancery coincided in substance with those of the Roman law as expounded by the civilians and hence were but statements of universal principles of natural law universally accepted in civilized states. If equity had been expounded to American judges and lawyers and students in the dry and technical fashion of the contemporary English treatises, we might have been sorely hampered in the development of American Law by a crippled equity. Story's sympathetic exposition of English equity (...) was the one thing needed to commend equity to our American courts and to counteract the forces that were working against it."-- Pound, The Formative Era in American Law 156-157 Apart from James Kent, no man has had greater influence on the development of American law than Joseph Story [1779-1845]. He was Dane Professor of Law at Harvard, where he played a key role in the growth of the school and the establishment of its national eminence, and an associate justice of the U.S. Supreme Court, where he was the author of several landmark decisions, such as Martin v. Hunter's Lessee. His many books, most notably the monumental work Commentaries on the Constitution (1833), have been cited extensively, and he remains an authority today.

Necessity of Placing Parties in Statu Quo.--Before a plaintiff, who has come into a Court of Equity asking that a contract be rescinded, is entitled to the relief prayed, he must first do equity unto the party with whom he has dealt. It is a general rule of law that a plaintiff will not be granted relief until he has placed the defendant in statu quo, and the plaintiff must have done everything, in his power, to save the defendant harmless.3 Of course it is not possible in every case that may arise that the parties can be placed in statu quo, and thus suffer no injury. The policy of the law is that this be done. For instance, where the mortgagor seeks to have the deed cancelled because the notary who took her examination was a stockholder in the mortgagee corporation, it is contrary to good morals that the deed be cancelled until everything received under it be returned.4 Nor is a minor child required to deed back to her father the land received by her from her father in settlement of her interest in her mother's estate, when in fact the land deeded to her was not her real share in the estate.5 In passing upon the offer of plaintiff to restore the consideration, it is sufficient where he alleges in his complaint that he is ready to return the consideration, and while upon the witness stand he offers to return it in open court.6 In asking a cancellation of an instrument conveying interests in property which has been improved, and from the nature of the property it is impossible to restore it to the former owner in precisely the same condition as when received, it is sufficient a repara-, 1 Cud v. In dismissing the work to the indulgent consideration of the profession, I venture to hope that it will not be found, that more has been promised than is performed and that, if much has been omitted, something will yet be found to lighten the labors of the inquisitive, if not to supply the wants of the learned.
