La segunda edición del Comentario a la Ley 17/2001, de Marcas recoge las principales novedades de la práctica (jurisprudencia, legislación y aplicación por la Oficina Española de Marcas), después de casi cinco años desde la entrada en vigor de la Ley de Marcas 17/2001. En el ámbito legislativo las reformas más relevantes han sido la introducción de los Juzgados de lo Mercantil (culminación del deseo largamente expresado de crear órganos especializados en materia de Derecho comercial), la creación del Juzgado de Marca Comunitaria con sede en Alicante (ambos mediante la Ley Orgánica 8/2003); la Ley 19/2006, que amplía los medios de tutela de la Propiedad industrial -incorporando la Directiva 2004/48/CE- y que modifica el sistema de indemnización de daños y perjuicios e introduce a la vez en las diligencias preliminares de la LEC una regulación específica para la propiedad industrial. Igualmente la Ley de protección del Diseño industrial (Ley 20/2003) diversos aspectos de la Ley de Marcas y afectó directamente a la situación de la protección de los productos accesorios. Otras disposiciones contempladas en la obra son la Ley 24/2003, de la Viña y del Vino, la Ley 60/2003, de arbitraje, la reforma del Código penal por la LO 15/2003 y la Ley 34/2002, de servicios de la sociedad de la información y en el ámbito reglamentario, el Real Decreto 687/2002, la Orden de 19 de mayo 2005 (nombres de dominio bajo el código de país .es), etc. Desde el punto de vista jurisprudencial se analizan las diferentes sentencias del Tribunal de Justicia de las Comunidades Europeas que han afectado fundamentalmente a la definición de marca y a la susceptibilidad de protección de los signos olfativos, de colores, sonoros, etc., así como al concepto de infracción de marca. En cuanto a la jurisprudencia nacional se reseñan los desarrollos existentes en materia de legitimación para la interposición del recurso de alzada, la indemnización de daños y perjuicios, el concepto de derecho positivo de uso de la marca y la doctrina de la violación continuada específicamente aplicada a las marcas. El presente Comentario ha estudiado igualmente la doctrina del Juzgado de Marca Comunitaria y, en apelación, del Tribunal de Marca Comunitaria en sentencias que han abordado cuestiones relativas al riesgo de asociación de marcas y muy especialmente cuestiones procesales (acumulación de acciones de competencia desleal, de nulidad de marca nacional o internacional, acumulación de acciones de infracción de la marca nacional, acción reivindicatoria de marcas nacionales y comunitarias, etc.). Respecto de la práctica de la Oficina Española de Patentes y Marcas se ha hecho especial hincapié en las cuestiones de registro (prohibiciones absolutas y relativas), así como en las relativas a la legitimación para el registro de marcas (registro por entidades sin personalidad, por sociedades civiles, etc.). En el ámbito doctrinal se hace mención a las principales aportaciones doctrinales desde el año 2002 que, por razones temporales, no se incluyeron en la primera edición.

The Centre is a product of the Bonn Berlin agreement of July 1994 which was adopted to offset the effects caused by the Parliament and much of the Government moving to Berlin.
