Tragically even in the year 2014, the state of women around the world remains precarious. Every day women and girls endure horrific acts of violence in their homes and communities. Women are raped, beaten, disfigured by acid, forcibly married, trafficked and sold as slaves. They are denied basic rights—such as the opportunity to get an education, to see a doctor, try to make a living outside the home—simply because of their gender.

Domestic violence against women and girls – commonly known as intimate partner violence or family violence – concerns any form of physical, psychological, sexual, or economic abuse perpetrated by partners and relatives. It encompasses multiple and varied acts and behaviors – ranging from emotional and verbal abuse to femicide – aiming at affirming power and control over women and their lives. Although combating this form of violence is especially challenging in the context of private settings, domestic violence is no longer treated as a “private matter”. Decades of mobilization and sensitization of societies and institutions, strongly supported by the restless action of women’s movements, have contributed to making violence against women a priority on the national and international agendas. Indeed, the road to the adoption of international binding instruments and national legislation on domestic violence has been long and twisted. Nonetheless, today women are protected against violence by some landmark legal instruments adopted at the global, regional and national levels. This book aims to offer a systematic overview of the legal protection afforded to women and girls against domestic violence and other relevant forms of violence and discrimination, while also critically assessing the state of the law at international, regional and domestic levels. It dealt with a highly sensitive issue, the position and role of women in society and in the political decision-making process. The vast number of extensive reservations to the Convention bear witness to the fact that this is possibly one of the most contentious topics at the international level. Few other core universal human rights conventions have attracted a comparable number of reservations. This unique Guide is an attempt to create a picture of the legal--political background to the Convention. Its basic layout follows the style of a classical commentary with annotations to the individual provisions. These annotations draw on documentary sources from the years of preparatory discussions and negotiations (the travaux préparatoires). It primarily covers the genesis of the Convention, i.e. the drafting and negotiating process up to its adoption in 1979. To enhance the Guide's usefulness, a number of more recent documents have been incorporated, for example, the General Recommendations issued by the Committee on Elimination of Discrimination against Women have been reproduced and references to relevant recommendations have been inserted in the annotations to each provision in question. In addition to this, a number of other documents relative to the interpretation of the Convention have been reproduced in Part III, including lists of ratifications of and reservations to the Convention. For example, women are more likely than men to be sexually assaulted or killed by someone they know. The United Nations has defined violence against women as "gender-based" violence, to acknowledge that such violence is rooted in gender inequality and is often tolerated and condoned by laws, institutions, and community norms. Violence against women is not only a profound violation of human rights, but also a costly impediment to a country's national development. While gender-based violence occurs in many forms throughout the life cycle, this review focuses on two of the most common types-physical intimate partner violence and sexual violence by any perpetrator. Unfortunately, the knowledge base about effective initiatives to prevent and respond to gender-based violence is relatively limited. Few approaches have been rigorously evaluated, even in high-income countries. And such evaluations involve numerous methodological challenges. Nonetheless, the authors review what is known about more and less effective-or at least promising-approaches to prevent and respond to gender-based violence. They present definitions, recent statistics, health consequences, costs, and risk factors of gender-based violence. The authors analyze good practice initiatives in the justice, health, and education sectors, as well as multisectoral approaches. For each of these sectors, they examine initiatives that have addressed laws and policies, institutional reforms, community mobilization, and individual behavior change strategies. Finally, the authors identify priorities for future research and action, including funding research on the health and socioeconomic costs of violence against women, encouraging science-based program evaluations, disseminating evaluation results across countries, promoting investment in effective prevention and treatment initiatives, and encouraging public-private partnerships.

Book excerpt: Violence against women and children is a serious public health concern, with costs at multiple levels of society. Although violence is a threat to everyone, women and children are particularly susceptible to victimization because they often have fewer rights or lack appropriate means of protection. In some societies certain types of violence are deemed socially or legally acceptable, thereby contributing further to the risk to women and children. In the past decade research has documented the growing magnitude of such violence, but gaps in the data still remain. Victims of violence of any type fear stigmatization or societal condemnation and thus often hesitate to report crimes. The issue is compounded by the fact that for women and children the perpetrators are often people they know and because some countries lack laws or regulations protecting victims. Some of the data that have been collected suggest that rates of violence against women range from 15 to 71 percent in some countries and that rates of violence against children top 80 percent. These data demonstrate that violence poses a high burden on global health and that violence against women and children is common and universal. Preventing Violence Against Women and Children focuses on these elements of the cycle as they relate to interrupting this transmission of violence. Intervention strategies include preventing violence before it starts as well as preventing recurrence, preventing adverse effects (such as trauma or the consequences of trauma), and preventing the spread of violence to the next generation or social level. Successful strategies consider the context of the violence, such as family, school, community, national, or regional settings, in order to determine the best programs.

But these reports tend to focus on one segment of the LGBT community—white, middle class men—and largely ignore that part of the community that arguably suffers a larger share of the violence—racial minorities, the poor, and women. In Violence against Queer People, sociologist Doug Meyer offers the first investigation of anti-queer violence that focuses on the role played by race, class, and gender. Drawing on interviews with forty-seven victims of violence, Meyer shows that LGBT people encounter significantly different forms of violence—and perceive that violence quite differently—based on their race, class, and gender. His research highlights the extent to which other forms of discrimination—including racism and sexism—shape LGBT people’s experience of abuse. He reports, for instance, that lesbian and transgender women often described violent incidents in which a sexual or a misogynistic component was introduced, and that LGBT people of color sometimes weren’t sure if anti-queer violence was based solely on their sexuality or whether racism or sexism had also played a role. Meyer observes that given the many differences in how anti-queer violence is experienced, the present media focus on white, middle-class victims greatly oversimplifies and distorts the nature of anti-queer violence. In fact, attempts to reduce anti-queer violence that ignore race, class, and gender run the risk of helping only the most privileged gay subjects. Many feel that the struggle for gay rights has largely been accomplished and the tide of history has swung in favor of LGBT equality. Violence against Queer People, on the contrary, argues that the lives of many LGBT people—particularly the most vulnerable—have improved very little, if at all, over the past thirty years.
