Book Synopsis The Impact of Environmental Concerns on the Public Enforcement Mechanism Under EU Law by : Levente Borzsák
Download or read book The Impact of Environmental Concerns on the Public Enforcement Mechanism Under EU Law written by Levente Borzsák and published by Kluwer Law International B.V.. This book was released on 2011-01-01 with total page 354 pages. Available in PDF, EPUB and Kindle. Book excerpt: "The European Union, with only 7.5% of the world's population, is responsible for a major part of the contamination of the planet, and is a major contributor to the problems of the global environment. Fortunately, Europe has both the capacity and the experience to fight effectively against these problems, even in this 'twenty-fifth hour' of environmental degradation. This timely book identifies some of the weaknesses of the public enforcement mechanism inherent in Articles 258-260 TFEU, and suggests how that mechanism could be improved in order to promote the overall effectiveness of EU law and environmental law in particular"--Provided by publisher.

Book Synopsis Mixed Agreements as a Technique for Organizing the International Relations of the European Community and its Member States by : Joni Heliskoski
Download or read book Mixed Agreements as a Technique for Organizing the International Relations of the European Community and its Member States written by Joni Heliskoski and published by BRILL. This book was released on 2021-08-30 with total page 345 pages. Available in PDF, EPUB and Kindle. Book excerpt: This volume provides the most comprehensive account to date of the foundations, evolution, and nature of the treaty-making practice, known as the practice of mixed agreements, whereby the European Community and its Member States enter into international agreements with one or more other subjects of international law. Covering policy areas from external economic relations to the environment, from development cooperation to the law of the sea, the practice of mixed agreements occupies a highly prominent position in the external relations of the EU. Rather than focusing upon any particular agreement or subject area, the book seeks to identify, through analysis of the respective interests of the Community, the Member States and other parties, as they are reflected in actual practice, the general parameters for the conclusion and application of mixed agreements. The basic thesis defended is that there are mediating strategies whereby mixed agreements can be turned into an effective technique for manifesting the Community's position in external relations whilst nevertheless safeguarding the vital interests of the Member States and the other, non-EC parties. Rather than a `necessary evil', mixed agreements should be regarded as a natural way of organizing the international relations of the EC and its Member States. Of individual treaties, the most thorough examination is made of the Community and the Member States' participation in the Law of the Sea Convention, the Food and Agriculture Organization of the UN (FAO), as well as the Agreement establishing the World Trade Organization (WTO). As regards the WTO, for instance, the book offers a comprehensive account of the dispute settlement practice under the GATS and TRIPS Agreements.

Book Synopsis Families and the European Union by : Clare McGlynn
Download or read book Families and the European Union written by Clare McGlynn and published by Cambridge University Press. This book was released on 2006-09-28 with total page 18 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the first book to offer a comprehensive analysis of family law in the European Union, McGlynn argues that a traditional concept of 'family' which has many adverse effects - on individuals, on families (in all their diverse forms), and indeed on the economic ambitions of the EU is forming the basis for the little-recognised and under-researched field of EU family law. This book examines three different aspects of family life - childhood, parenthood and partnerships - and critically analyses existing EU law in relation to each. It examines the emerging field of EU family law, providing a highly sceptical account of recent developments and a robust challenge to the arguments in favour of the codification of European civil law, including family law.

Available in PDF, EPUB and Kindle. Book excerpt: Take action and shatter the glass ceiling with this empowering and optimistic feminist guide from the #1 New York Timesbestselling author of Dear Madam President. In an era marked by a frustrating sense of stagnation for women, Jennifer Palmieri has found a way to move beyond the bounds of patriarchy. Building on the lessons shared in Dear Madam President, Palmieri argues that women have gone as far as they can in a world made for men, and it is time to break from it. She Proclaims declares what most women know in their souls but have yet to say out loud-that they deserve something better than a life where men hold a vast majority of power and women continue to be undervalued. It is a manifesto for the second century of feminism that no longer chases a man's elusive path but proclaims the value, ambition, and emotion women have had all along to change their world by changing how they engage in it. This book celebrates the accomplishments and history of the women's movement, and through personal reflections and stories of other inspirational female leaders, Jennifer shares concrete advice and insights she's learned from her journey out of a man's world that will inspire you to boldly chart your own course in life.

Book Synopsis The Constitutional Foundations of European Contract Law by : Kathleen Gutman
Download or read book The Constitutional Foundations of European Contract Law written by Kathleen Gutman and published by OUP Oxford. This book was released on 2014-12-18 with total page 677 pages. Available in PDF, EPUB and Kindle. Book excerpt: Situated within the context of the ongoing debate about European contract law, this book provides a detailed examination of the European Union's competence in the field of contract law. It analyses the limits of Union competence in relation to several relevant Treaty provisions which potentially confer competence on the Union to adopt a comprehensive contract law instrument and the exercise of Union competence in connection with the operation of the principles of subsidiarity, proportionality and sincere cooperation. It also explores the viability of several alternative and complementary routes to the adoption of such an instrument, including enhanced cooperation, an intergovernmental treaty and certain American techniques. Setting forth an elaborate account of the context for this debate and its chronological development at the European level, this book charts the discussions relating to the European Union's competence to regulate contract law and offers a comparative analysis of the approach taken to the approximation of contract law in the American setting. Setting forth a detailed account of the context for this debate and its chronological development at the European level, the book charts the discussions that have occurred within and outside the EU relating to the transnational competence to regulate contract law. Situating European constitutional law within the continued debate about European contract law, it also reflects upon the contract law structure of the United States and examines the viability of alternative and complementary routes to the adoption of a comprehensive instrument of substantive contract law.
