Para entender estos cuestionamientos, esta obra parte de una realidad de la globalización, la existencia de una mayor propensión a conflictos de normas u obligaciones en materia comercial, más específicamente del derecho de la OMC y los TLC celebrados por Colombia, con otras disposiciones del derecho internacional tales como normas medioambientales, de derechos humanos, laborales, comunitarias, regionales, etc. Aquí, la proliferación de instrumentos internacionales y su constante interacción, sin duda, hacen más difícil encontrar respuestas en un océano de obligaciones contenidas en tratados que normalmente son independientes entre sí y que tienen el mismo rango jurídico. Teniendo en cuenta lo anterior, en este libro se propone identificar algunas problemáticas del sistema de comercio internacional, o por lo menos aquellas que afectan a Colombia, V presenta algunas soluciones a partir de los principios sobre los cuales se erige este sistema, como el principio de no discriminación, sin olvidar los principios que son el fundamento de las relaciones internacionales en el Estado social de derecho colombiano, como los principios reciprocidad, equidad y conveniencia nacional.

La mayor dificultad es cualitativa, esto es, ¿con quiénes y cómo se negocian estos TLC?, lo que se llamará a lo largo de este libro la "administración del comercio internacional", que permite a los gobiernos calcular los beneficios y anticipar los costos económicos y sociales de la apertura de sus mercados. En esta nueva edición se destaca un ejemplo de ello, que se evidenció en los retos de la pandemia de la COVID-19, donde se presentaron dilemas entre el cumplimiento de obligaciones de protección de patentes frente a obligaciones de acceso a medicamentos y de salud pública.

Se revela que, a pesar de las concesiones comerciales significativas realizadas durante las negociaciones, los beneficios prometidos no se materializaron. Durante la campaña presidencial de 2022 varios candidatos expresaron la necesidad de revisar y renegociar estos acuerdos, reflejando la percepción negativa de su impacto en la economía colombiana, motivando a los autores a emprender este libro con el ánimo de conseguir fuentes sólidas para comprobar esa necesidad. El análisis detallado revela que, contrario a las justificaciones del Ministerio de Comercio de la primera década del siglo XXI, el crecimiento económico y las exportaciones no experimentaron el esperado impulso después de la implementación de los TLC. El estudio señala una disminución de las exportaciones, especialmente en sectores clave como la industria liviana, la agricultura y la manufactura pues, descontando las exportaciones minero-energéticas, la balanza comercial muestra un déficit con los países miembros de la OMC que han firmado TLC con Colombia. Además, se destaca que la estructura exportadora no ha experimentado cambios sustanciales, y ciertos sectores como la industria del calzado, las manufacturas de cuero, el papel, la metalurgia y la cerámica han perdido participación. La reseña también señala la falta de adaptación y la rigidez en la política comercial colombiana, así como las reglas de juego detrás del comercio (propiedad intelectual) ante las dinámicas globales, especialmente en medio de la competencia entre Estados Unidos, Europa y China, lo que plantea la necesidad de una revisión y un cambio de rumbo en la política comercial del pais.

This political impasse raises several overarching questions: Does the status of fast track represent a temporary or a permanent setback in the postwar trend toward freer trade? Is it due simply to lax efforts in mobilizing groups that support trade liberalization, or is US trade policy becoming more protectionist? More generally, what were the most important economic and social factors shaping congressional voting on trade legislation in the 1990s? How do these factors differ for the various trade bills Congress considered over this period? Baldwin and Magee attempt to answer these questions by analyzing three key trade bills: NAFTA in 1993; the legislation implementing the Uruguay Round agreements in 1994; and the House bill seeking to renew fast-track authority in 1998. The authors provide a brief legislative history of each, and then outline a conceptual framework for their analysis. Focusing on district and state economic conditions, ideological leanings, and campaign contributions, they find both predictable and surprising relationships in the data.
