Download or read book Litigating War written by Sean D. Murphy and published by Oxford University Press. This book was released on 2013-03-25 with total page 1061 pages. Available in PDF, EPUB and Kindle. Book excerpt: Litigating War offers an in-depth examination of the law and procedure of the Eritrea-Ethiopia Claims Commission, which was tasked with deciding, through binding arbitration, claims for losses, damages, and injuries resulting from the 1998-2000 Eritrean-Ethiopian war. After providing an overview of the war, the authors describe how the Commission was established, its jurisdiction, the sources of law it applied, its treatment of nationality and evidentiary issues, and the relief it rendered. Separate chapters then address particular topics, such as the initiation of the war, battlefield conduct, belligerent occupation, aerial bombardment, prisoners of war, enemy aliens and their property, diplomats and diplomatic property, and general economic loss. A final chapter examines the lessons that might be learned from the experience of the Claims Commission, especially with an eye to the establishment of such commissions in the future. The volume includes a preface from James Crawford and also reproduces all the key documents relating to the Commission: the bilateral agreement establishing the Commission; its rules of procedure; and its numerous decisions and arbitral awards. The analytical portion of the volume contains extensive cross-references to these primary documents. Further, a comprehensive table of contents and indexes relating to subject matter, treaties, and cases provide ready access to all the material contained within.

Download or read book Debt and Entanglements Between the Wars written by Mr.Thomas J Sargent and published by International Monetary Fund. This book was released on 2019-11-08 with total page 322 pages. Available in PDF, EPUB and Kindle. Book excerpt: World War I created a set of forces that affected the political arrangements and economies of all the countries involved. This period in global economic history between World War I and II offers rich material for studying international monetary and sovereign debt policies. Debt and Entanglements between the Wars focuses on the experiences of the United States, United Kingdom, four countries in the British Commonwealth (Australia, New Zealand, Canada, Newfoundland), France, Italy, Germany, and Japan, offering unique insights into how political and economic interests influenced alliances, defaults, and the unwinding of debts. The narratives presented show how the absence of effective international collaboration and resolution mechanisms inflicted damage on the global economy, with disastrous consequences.
Book Synopsis Jewish Property Claims Against Arab Countries by : Michael R. Fischbach
Download or read book Jewish Property Claims Against Arab Countries written by Michael R. Fischbach and published by Columbia University Press. This book was released on 2008-08-26 with total page 384 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the twenty years that followed the Arab-Israeli war of 1948, 800,000 Jews left their homes in Syria, Egypt, Iraq, Yemen, Libya, Morocco, and several other Arab countries. Although the causes of this exodus varied, restrictive governmental measures and an outburst of anti-Semitic feeling during and after the war were major factors. Some of these "Mizrahi" Jews, most of whom were not active Zionists, were forced to leave behind property of great financial and ancestral value-property that was sometimes seized by the governments of the countries they fled. In this book, Michael R. Fischbach, who has dedicated years to studying land and property ownership in the context of the Arab-Israeli conflict, reconstructs the circumstances in which Jewish communities left the Arab world. Conducting meticulous and exhaustive research in the archives of Washington D.C., Jerusalem, London, New York, and elsewhere, Fischbach offers the most authoritative estimates to date of the value of the property left behind. He also describes the process by which various actors, most importantly the State of Israel, linked the resolution of Jewish property claims to the fate of Palestinian refugee property claims following the 1948 war. Fischbach considers the implications of contemporary developments, such as America's invasion of Iraq, Israeli-Palestinian negotiations, and Libya's attempt to shed its international pariah status, which have impacted pending claims and will affect claims in the future. Overall, he finds that many international Jewish organizations have supported the link between the claims of Mizrahi Jews and those of Palestinian refugees, hindering serious efforts to obtain restitution or compensation.
