Book excerpt: Excerpt from The Mining Laws of the Republic of Colombia: With a Short Explanation of Their Application and Official Forms for Notices, Denouncements and Applications for Title In 1857 Granada adopted a Federal constitution and the Province of Antioquia became a State of the same name. The Legislature of this State, which has held and still holds the first rank among the mining States of Colombia, on October 3, 1864, passed a law, known as Ley 38, which repealed all existing mining laws. But the provisions of this law were quickly found to be very unsatisfactory, and almost immediately after its pas sage the State Legislature began to study the provisions of a new and more complete law on the subject; a law which would encourage mining, and which, while interesting and afi'ording protection to capital invested in the mining industry, would at the same time provide that the mining lands. Granted by the State in fee simple, should yield a revenue to it. The result Of their labors was Ley 127, passed October 21, 1867, and known as the Codz'go dc M'nas dc Antz'oym'a. This law forms the nucleus of the present Mining Law of the Republic Of Colom bia. The Code was first amended by Ley 209, passed November 2, 1871, but the amendments failed to give satisfaction and they were repealed and others were substituted by Ley 292, passed September 20. 1875. The last amendments made by the Legis lature of the State of Antioquia were passed December 4, 1877, and were known as Ley 38. Concerning this law, it is to be Observed that two of its articles have been suspended by the Federal Supreme Court, on January 13, 1879. Article 4 of Ley 38, declared excepted from denouncement the bed and banks of the Cauca River to high flood mark (vide page The sus pension of this article was only partial, the Court deciding that the provisions of said article could in no wise afi'ect the rights already acquired at the time of its passage. Article 7 of Ley 38 provided that where the working of a mine was suspended, the owner of another mine could take for his mine the water used in the first. (v ide page This provision was declared uncon stitutional by the Supreme Court and was totally suspended. Available in PDF, EPUB and Kindle. Book excerpt: Freedom's Captives is a compelling exploration of the gradual abolition of slavery in the majority-black Pacific coast of Colombia, the largest area in the Americas inhabited primarily by people of African descent. From the autonomous rainforests and gold mines of the Colombian Black Pacific, Yesenia Barragan rethinks the nineteenth-century project of emancipation by arguing that the liberal freedom generated through gradual emancipation constituted a modern mode of racial governance that birthed new forms of social domination, while temporarily instituting de facto slavery. Although gradual emancipation was ostensibly designed to destroy slavery, she argues that slaveholders in Colombia came to have an even greater stake in it. Using narrative and storytelling to map the worlds of Free Womb children, enslaved women miners, free black boatmen, and white abolitionists in the Andean highlands, Freedom's Captives insightfully reveals how the Atlantic World processes of gradual emancipation and post-slavery rule unfolded in Colombia.

Book excerpt: Excerpt from The Mining Laws of the Republic of Colombia: Translated With an Introduction and Notes In the earliest colonial days various isolated legal provisions (emanating from the Spanish Crown as the private owner of the Colonies) were made, but the first complete code was that constituted by the Ordenanzas de Minas del Peru, 1541. A few years later, the viceroys were directed to enforce the laws of Castille relating to mines, and were recommended to issue such further ordinances as they deemed suitable, in accordance with which recommendation the viceroy Francisco de Toledo gave out the ordinances of 1574, with the approval of Philip the Second, and these were completed 25 years later by the viceroy, the Marquis de Canete. Meanwhile, in Spain, the Mon arch published the Ordinances oi August 22, 1584, founded on the principles of the German legislation (which in turn undoubtedly derives from the Roman) 1 and these were made applicable to America. These various ordinances, together with sundry minor provisions of various dates. Were codified in the celebrated Ordenanzas del Peru, published in 1683.
