As evidence of this supposed siege, they point to a series of rules issued by the Environmental Protection Agency that aim to slash air pollution from the nation's power sector . Because coal produces far more pollution than any other major energy source, these rules are expected to further reduce its already shrinking share of the electricity market in favor of cleaner options like natural gas and solar power. But the EPA's policies are hardly the "unprecedented regulatory assault " that opponents make them out to be. Instead, they are merely the latest chapter in a multi-decade struggle to overcome a tragic flaw in our nation's most important environmental law. In 1970, Congress passed the Clean Air Act, which had the remarkably ambitious goal of eliminating essentially all air pollution that posed a threat to public health or welfare. But there was a problem: for some of the most common pollutants, Congress empowered the EPA to set emission limits only for newly constructed industrial facilities, most notably power plants. Existing plants, by contrast, would be largely exempt from direct federal regulation-a regulatory practice known as "grandfathering." What lawmakers didn't anticipate was that imposing costly requirements on new plants while giving existing ones a pass would simply encourage those old plants to stay in business much longer than originally planned. Since 1970, the core problems of U.S. environmental policy have flowed inexorably from the smokestacks of these coal-fired clunkers, which continue to pollute at far higher rates than their younger peers. In Struggling for Air, Richard L. Revesz and Jack Lienke chronicle the political compromises that gave rise to grandfathering, its deadly consequences, and the repeated attempts-by presidential administrations of both parties-to make things right.

The United States has pledged to the world community a reduction in greenhouse gas emissions by 26–28 percent below 2005 levels in 2025. Because much of this reduction must come from electric utilities, especially coal-fired power plants, coal states will make or break the U.S. commitment to emissions reduction. In Climate of Capitulation, Vivian Thomson offers an insider's account of how power is wielded in environmental policy making at the state level. Thomson, a former member of Virginia's State Air Pollution Control Board, identifies a “climate of capitulation” in state government—a deeply rooted favoritism toward coal and electric utilities in states' air pollution policies. Thomson narrates three cases involving coal and air pollution from her time on the Air Board. She illuminates the overt and covert power struggles surrounding air pollution limits for a coal-fired power plant just across the Potomac from Washington, for a controversial new coal-fired electrical generation plant in coal country, and for coal dust pollution from truck traffic in a country hollow. Thomson links Virginia's climate of capitulation with campaign donations that make legislators politically indebted to coal and electric utility interests, a traditionalistic political culture tending to inertia, and a part-time legislature that depended on outside groups for information and bill drafting. The first myth is that the Clean Air Act precluded the use of coal; the second, that industrial use of coal will expand rapidly as a result of purely economic choices. Through analyzing fuel-use decisions actually made by industry, Mr. Alm concludes that environmental quality standards have played a minor role in industrial choice of fuel. Historically, natural gas and oil have been both less costly and more convenient fuels for industry to use. Coal gained a substantial economic advantage over oil after the oil price increases of the last decade, yet it continues to maintain a lower market share than economics alone would suggest. Mr. Alm demonstrates that coal's share of the fuel market will continue to remain low because of the way U.S. businesses view fuel-use choices. For most U.S. firms, energy costs are a relatively small portion of total costs and a minor factor in a firm's ability to compete. Faced with alternative capital projects to expand production facilities or to make mandatory investments, companies do not generally give high priority to coal conversion projects. Moreover, most U.S. firms have little experience with burning coal, and that lack of expertise creates additional psychological and institutional barriers to coal's use. Finally, there is a tendency to prefer high-payoff, short-term investments over projects that promise cost savings many years in the future. These are all strong reasons for coal's lackluster performance in the industrial market—much more potent forces than environmental regulations.

Book excerpt: The US coal industry has gone through a number of gradual shifts in recent decades. The industry has become more concentrated, and mine productivity has improved. More low-sulphur coal and less high sulphur coal is today being produced. Less coal is exported, in part because of a strong US dollar. Improved production methods, such as greater utilisation of and improvements in longwall mining technology, have lowered the cost of underground mining, although surface mining continues to hold a substantial cost advantage. The United States is well endowed with coal. The total demonstrated resource base is estimated by the Energy Information Administration (EIA) at 508 billion short tons, of which about 274 billion short tons are classified as recoverable reserves. US recoverable reserves are estimated at 25% of total world reserves. Production of US coal reached an all-time high in 2001 at 1,121 million short tons. Coal supplies 22% of the nation's energy demand but 52% of its electricity needs. EIA forecasts coal to fall to 47% of the US electricity market by 2025 because of increased competition from natural gas. About 1,063 million short tons of coal were consumed in the United States in 2001, 90% of which was used in the electric power sector. Currently, railroads move about 65% of all coal, barges transport about 15%, and trucks about 11%. The outlook for US coal is mixed. While forecasts predict steady growth in coal supply and demand, the increased production is expected to come from fewer, larger mines and fewer producers. Continued competition from natural gas is likely to put pressure on coal prices for the foreseeable future.
