Book excerpt: Excerpt from The Plea of Clarence Darrow, August 22nd, 23rd and 25th, 1924, in Defense of Richard Loeb and Nathan Leopold Jr., On Trial for Murder Harvard, he was to take a trip to Europe and had already purchased his ticket for the ocean voyage. Loeb was the youngest graduate of the University of Michigan and was intending to study law. Both Leo pold and Loeb had always been well supplied with money and there was no financial reason why they should have committed either the crime of kidnaping or that of mur der. When the body of Robert Franks was placed in the culvert, the eye glasses of Leopold dropped from his pocket and, after several other arrests, these were found by the police and identified as Leopold's glasses. At the time of their arrest, no one believed that they had any thing to do with the kidnaping and killing. They were taken to the State's Attorney's office and after being in the custody of the attorneys and officers for about sixty hours, they confessed to the full details of the crime. It was claimed by the defense that their minds were diseased and also that on account of their extreme youth, they should not be hanged. The Illinois statutes provide that on a verdict or plea of guilty, a defendant may be sentenced to death or to a term in the penitentiary for not less than fourteen years and up to life. The statute also provides that on a plea of guilty, In all cases where the court possesses any discretion as to the extent of the punishment, it shall be the duty of the court to examine witnesses as to the aggravation and mitigation of the offense. The defendants in this case pleaded guilty before Judge Caverly; thereupon evidence was offered both by the State and the defense on the question of aggravation and mitigation. Alienists were introduced by both sides, touching the mental condition of the two boys. The hearing occupied about thirty days. The defend ants were sentenced to the penitentiary for life. Download or read book Clarence Darrow written by Andrew E. Kersten and published by Macmillan + ORM. This book was released on 2011-04-26 with total page 321 pages. Available in PDF, EPUB and Kindle. Book excerpt: Clarence Darrow is best remembered for his individual cases, whether defending the thrill killers Leopold and Loeb or John Scopes's right to teach evolution in the classroom. In the first full-length biography of Darrow in decades, the historian Andrew E. Kersten narrates the complete life of America's most legendary lawyer and the struggle that defined it, the fight for the American traditions of individualism, freedom, and liberty in the face of the country's inexorable march toward modernity. Prior biographers have all sought to shoehorn Darrow, born in 1857, into a single political party or cause. But his politics do not define his career or enduring importance. Going well beyond the familiar story of the socially conscious lawyer and drawing upon new archival records, Kersten shows Darrow as early modernity's greatest iconoclast. What defined Darrow was his response to the rising interference by corporations and government in ordinary working Americans' lives: he zealously dedicated himself to smashing the structures and systems of social control everywhere he went. During a period of enormous transformations encompassing the Gilded Age and the Progressive Era, Darrow fought fiercely to preserve individual choice as an ever more corporate America sought to restrict it.

Available in PDF, EPUB and Kindle. Book excerpt: This volume presents a selection of 500 letters by Clarence Darrow, the pre-eminent courtroom lawyer of the late nineteenth and early twentieth century. Randall Tietjen selected these letters from over 2,200 letters in archives around the country, as well as from one remarkable find—the kind of thing historians dream about: a cache of about 330 letters by Darrow hidden away in the basement of Darrow’s granddaughter’s house. This collection provides the first scholarly edition of Darrow’s letters, expertly annotated and including a large amount of previously unknown material and hard-to-locate letters. Because Darrow was a gifted writer and led a fascinating life, the letters are a delight to read. This volume also presents a major introduction by the editor, along with a chronology of Darrow’s life, and brief biographical sketches of the important individuals who appear in the letters.

Book Synopsis Clarence Darrow by : Richard J. Jensen
Download or read book Clarence Darrow written by Richard J. Jensen and published by Greenwood. This book was released on 1992-05-30 with total page 360 pages. Available in PDF, EPUB and Kindle. Book excerpt: He reviled the rich for their cupidity and they found his rhetoric repulsive. Plebians believed him their champion and patricians knew he was their bete noire, remarks Halford Ryan in his eloquent foreword to this definitive survey of Clarence Darrow's development as orator and unique American myth. As a writer, lecturer, debater, and trial lawyer Darrow spoke for the have-nots and cultivated an image of mythic proportions as the underdog's advocate. Many of the more than 2,000 trials in which he was active reflected the major social and philosophical issues of the last quarter of the nineteenth and first third of the twentieth centuries in America. Read today, Darrow's speeches still ring true both as political statements and as models of persuasive pleading and pathos--reason enough to study the work of this uncommon advocate who stood perpetually opposed to the great and powerful of the earth. Richard J. Jensen has written a clearsighted volume that documents how Darrow created and then enlarged his personal myth through speeches, writings, and actions. Each chapter focuses on particular segments of that creation. Half of the book consists of authoritative texts of several of Darrow's most influential and rhetorically brilliant speeches, and a speech chronology simplifies the work of researchers. The study opens with a brief biography, an overview of Darrow's rhetoric, along with the forces that affected it, and some initial comments on the elements that make up the myth. The next chapter, Schoolmaster of the Courtroom, chronicles the origins of Darrow's image as a defender of the downtrodden and his early trials in defense of labor unions and their leaders. What is considered to be one of the most famous speeches in American legal history, that given by Darrow at the conclusion of the 1924 Leopold and Loeb trial, is the focus of Chapter Three. Chapter Four centers on the Scopes Trial, perhaps the most famous trial in recent American history, during which the dramatic confrontation with William Jennings Bryan occurred. The penultimate chapter explains the arguments Darrow used to defend the poor, radicals, Blacks, and other less fortunate members of society. Finally, Darrow's rhetoric as a writer and as an active speaker and debater on the lecture circuit is examined. Part II contains the authoritative texts of seven speeches including those given during the Leopold and Loeb Trial and the Scopes Trial, among others. The Chronology of Speeches, Bibliography, and Index close the volume. The speeches along with Jensen's intelligent, readable analysis and criticism will be an important resource for those teaching and studying Legal Rhetoric and the History of Public Address.
