Available in PDF, EPUB and Kindle. Book excerpt: Derived from the renowned multi-volume International Encyclopaedia of Laws, this convenient volume provides comprehensive analysis of the legislation and rules that determine civil procedure and practice in Greece. Lawyers who handle transnational matters will appreciate the book’s clear explanation of distinct terminology and application of rules. The structure follows the classical chapters of a handbook on civil procedure: beginning with the judicial organization of the courts, jurisdiction issues, a discussion of the various actions and claims, and then moving to a review of the proceedings as such. These general chapters are followed by a discussion of the incidents during proceedings, the legal aid and legal costs, and the regulation of evidence. There are chapters on seizure for security and enforcement of judgments, and a final section on alternative dispute resolution. Facts are presented in such a way that readers who are unfamiliar with specific terms and concepts in varying contexts will fully grasp their meaning and significance. Succinct, scholarly, and practical, this book will prove a valuable time-saving tool for business and legal professionals alike. Lawyers representing parties with interests in Greece will welcome this very useful guide, and academics and researchers will appreciate its comparative value as a contribution to the study of civil procedure in the international context.

Available in PDF, EPUB and Kindle. Book excerpt: The Greek Code of Civil Procedure, an unprecedented translation of Greek Presidential Decree 503/1985, was painstakingly translated and edited over a period of several years. The purpose of this publication is to clarify the Greek legal system for an international audience, ranging from investors and entrepreneurs to scholars, academics, and students of law and translation, as well as legal practitioners, providing them with the entire text of the law on procedure before Greek civil courts, rather than piecemeal Articles or the gist and main points. The translation of the law is accompanied by Greek-to-English and English-to-Greek glossaries of the terms encountered in the Code. The book includes: An introduction by Dr. Panayiotis Yiannopoulos, LL.B., LL.M., J.D. A detailed foreword by the translators on their approach, methodology and the translational issues faced and resolved. A side-by-side translation of Presidential Decree 503/1985, including all amendments and updates until February 2023. Two useful glossaries of the key terminology used in the above texts (Greek-English and English-Greek). This volume is an indispensable bilingual aid for: Legal practitioners consulting clients involved in civil proceedings in Greece; Legal departments of companies already set up in Greece; Investors and entrepreneurs intending to incorporate a company in Greece, so that they remain abreast of developments in the field of their legal obligations; Translators translating from and into Greek who require a high-quality reference when consulting either this specific Code or other laws citing it, as well as dependable glossaries; Law and translation students interested in seeing a real-life application of their studies and requiring a reference volume for purposes of terminology and English legal drafting.

This book was released on 2016 with total page 12 pages. Available in PDF, EPUB and Kindle. Book excerpt: Since January 1, 2016, law No. 4335/2015 entered into force, resulting in radical changes in Greek civil litigation. Part of the reforms deals with amendments to the chapter on payment orders. Previously it was forbidden to issue a Greek order for payment, if the debtor was residing abroad. Pursuant to the new provisions, this is no longer the case. The importance of the matter for foreign debtors is related to the peculiar nature of the Greek model: Unlike the majority of EU Member States' legislation, the Greek order for payment is, once issued, automatically an enforceable title. The new provisions feature therefore a dual system, depending on the residence of the debtor: With respect to debtors living in Greece, the order for payment remains immediately enforceable; however, additional requirements have been posed, when the order for payment has to be served abroad, in order to safeguard the rights of the defendants.

Book excerpt: The volume describes and analyzes how the costs of litigation in civil procedure are distributed in key countries around the world. It compares the various approaches, draws general conclusions from that comparison, and presents global trends as well as common problems and solutions. In particular, the book deals with three principal questions: First, who pays for civil litigation costs, i.e., to what extent do losers have to make winners whole? Second, how much money is at stake, i.e., how expensive is civil litigation in the respective jurisdictions? And third, whose money is ultimately spent, i.e., how are civil litigation costs distributed through mechanisms like legal aid, litigation insurance, collective actions, and success oriented fees? Inter alia, the study reveals a general trend towards deregulation of lawyer fees as well as a substantial correlation between the burden of litigation costs and membership of a jurisdiction in the civil and common law families. This study is the result of the XVIIIth World Congress of Comparative Law held under the auspices of the International Academy of Comparative Law.
