Book excerpt: Writer and columnist Benjamin Law revisits his joyous and much-loved family memoir, spilling the tea on his family's latest antics The book that inspired the major SBS television series! Meet the Law family – eccentric, endearing and hard to resist. Your guide is Benjamin, the third of five children and a born humourist. Join him as he tries to answer some puzzling questions. Why won't his Chinese dad wear made-in-China underpants? Why was most of his extended family deported in the 1980s? Will his childhood dreams of Home and Away stardom come to nothing? What are his chances of finding love? In this updated edition with a new chapter, Benjamin Law fills us in on his family's antics from the past decade. ‘Benjamin Law manages to be scatagogical, hilarious and heartbreaking all at the same time. Every sentence fizzes like an exploding fireball of energy.’—Alice Pung ‘A vivid, gorgeously garish, Technicolour portrait of a family. It's impossible not to let oneself go along for the ride and emerge at the book's end enlightened, touched, thrilling with laughter.’—Marieke Hardy ‘The eccentric, clever and beautifully resonant The Family Law. It's sharply written, brilliantly observed and infused with an authenticity that makes it compelling.’ —Saturday Age ‘Very funny...you may find yourself at times almost barking with laughter’ —The Monthly ‘Law is a writer of great wit and warmth who combines apparently artless and effortless comedian's patter with a high level of technical skill.’ —Sydney Morning Herald ‘Simultaneously weird and instantly recognisable, the Laws are an Australian family it's well worth getting to know’ —The Enthusiast ‘Wonderful. Everyone should run to their nearest bookshop and buy a copy.’ —Defamer ‘An addictive read.’ —Courier-Mail

Book excerpt: This thematic volume in the series Studies in Private International Law – Asia outlines the general choice of law and recognition rules relating to family matters of 15 Asian jurisdictions: Mainland China, Hong Kong, Taiwan, Japan, South Korea, Singapore, Malaysia, Vietnam, Cambodia, Myanmar, the Philippines, Indonesia, Thailand, Sri Lanka and India. The book examines pressing questions and proposes ways in which their systems may be reformed. A concluding chapter considers the extent to which Asian cross-border family law systems can and should be harmonised. The book provides a comprehensive analysis of cross-border family law challenges, including child surrogacy, child abduction, the recognition of same-sex unions, the recovery of maintenance, and the regulation of intercountry adoption. These are among the matters now testing Asian institutions of private international law and acting as forces for their modernisation. With contributions by leading Asian private international law experts, the book proposes necessary reforms for each of the jurisdictions analysed as well as for Asia as a whole.

Available in PDF, EPUB and Kindle. Book excerpt: By the end of the eighth century A.D., imperial China had established a system of administrative and penal law, the main institutions of which lasted until the collapse of the Ch'ing dynasty in 1911. The Spirit of Traditional Chinese Law studies the views held throughout the centuries by the educated elite on the role of law in government, the relationship between law and morality, and the purpose of punishment. Geoffrey MacCormack's introduction offers a brief history of legal development in China, describes the principal contributions to the law of the Confucian and Legalist schools, and identifies several other attributes that might be said to constitute the "spirit" of the law. Subsequent chapters consider these attributes, which include conservatism, symbolism, the value attached to human life, the technical construction of the codes, the rationality of the legal process, and the purposes of punishment. A study of the "spirit" of the law in imperial China is particularly appropriate, says MacCormack, for a number of laws in the penal codes on family relationships, property ownership, and commercial transactions were probably never meant to be enforced. Rather, such laws were more symbolic and expressed an ideal toward which people should strive. In many cases even the laws that were enforced, such as those directed at the suppression of theft or killing, were also regarded as an emphatic expression of the right way to behave. Throughout his study, MacCormack distinguishes between "official," or penal and administrative, law, which emanated from the emperor to his officials, and "unofficial," or customary, law, which developed in certain localities or among associations of merchants and traders. In addition, MacCormack pays particular attention to the law's emphasis on the hierarchical ordering of relationships between individuals such as ruler and minister, ruler and subject, parent and child, and husband and wife. He also seeks to explain why, over nearly thirteen centuries, there was little change in the main moral and legal prescriptions, despite enormous social and economic changes.

In ii) and general custom (a fi kuei ch12) are mixed up and cannot be kept separated. A Chinese judge will always modify the rigour of the law if local usage differs from it; and a Chinese will invariably be in favour of fi 3 ch'ing ii (the application of special circumstances) in each case. In this sense the term family law is to be understood not merely as a statement of the Chinese family laws (leges) but including also general usages, which will have to enter largely into a future codification of the Chinese law, especially private law.
