Book excerpt: China has a long and enduring culture involving a complex set of highly ritualised social roles. Less well known, however, is the existence throughout Chinese history and society of a vibrant culture of contract. In 1978 China began opening up to the West. Since then China has signed a wide range of international agreements (including the United Nations Convention on the Rights of the Child) and adopted a large number of Westernised laws which make a number of child promises (ie. promises aimed at minimising child-harm). However, the rights a child might legitimately enjoy in China at the present time, over and above those connected with their social obligations, are based not on their humanity but, rather, on their capacity to fulfil a set of contractual obligations (promises) which stem from the status of parties as interdependent (not independent) human beings. ; ;This book develops a basic philosophical framework with which to explore and analyse China'TMs child-promises.

This book offers a critical analysis of the major principles, doctrines and concepts of insurance contract law in China. At every point the analysis discusses the principles of the Insurance Law in detail, referring where appropriate to decided cases and also drawing attention to external influences. Readers are guided through the complexities of Chinese law in a clear and comprehensive fashion, and – significantly – in a manner that is accessible and meaningful for those used to a common law system. This book presents a comprehensive picture of Chinese insurance contract law, to facilitate a wider understanding of the relevant rules of law. Elements of insurance contract law are critically examined. In addition, this book presents rules of law on some special types of insurance contract, such as life insurance, property insurance, liability insurance, motor vehicle insurance, reinsurance, and marine insurance. The deficiencies and shortcomings of the law and practice will be identified and analysed; suggestions and recommendations on how to reform the law will be presented. Chinese Insurance Contracts also offers legal and practical advice to insurance professionals on how to draft clauses to avoid contractual pitfalls. It also uses cases to illustrate the difficulties which can arise in applying the principles in practice. This book will be essential reading for insurance companies and legal practitioners looking to do business in China, as well as reference for Chinese lawyers practising insurance law. It will also be a useful resource for students and academics studying Chinese law.

Available in PDF, EPUB and Kindle. Book excerpt: From one of the leading policy experts of our time, an urgent rethinking of how we can better support each other to thrive Whether we realize it or not, all of us participate in the social contract every day through mutual obligations among our family, community, place of work, and fellow citizens. Caring for others, paying taxes, and benefiting from public services define the social contract that supports and binds us together as a society. Today, however, our social contract has been broken by changing gender roles, technology, new models of work, aging, and the perils of climate change. Minouche Shafik takes us through stages of life we all experience—raising children, getting educated, falling ill, working, growing old—and shows how a reordering of our societies is possible. Drawing on evidence and examples from around the world, she shows how every country can provide citizens with the basics to have a decent life and be able to contribute to society. But we owe each other more than this. A more generous and inclusive society would also share more risks collectively and ask everyone to contribute for as long as they can so that everyone can fulfill their potential. What We Owe Each Other identifies the key elements of a better social contract that recognizes our interdependencies, supports and invests more in each other, and expects more of individuals in return. Powerful, hopeful, and thought-provoking, What We Owe Each Other provides practical solutions to current challenges and demonstrates how we can build a better society—together.

Available in PDF, EPUB and Kindle. Book excerpt: Since the beginning of the 20th century, various attempts have been made by legal scholars to draft a Civil Code in China. However, only since the 1980s, when the ‘open-door’ policy was implemented, has Chinese Civil law become the basis for the development of a socialist market economy. Since the adoption of Chinese contract law (1999), property Law (2007) and tort Law (2009) in recent years, the basic construction of a socialist civil law system has been formulated. For the completion of a systematic civil law structure, a Civil Code has now been further advocated by society. The Draft Civil Code, prepared by the Chinese Academy of Social Sciences headed by Liang Huixing, is the first Draft Civil Code since the establishment of the People’s Republic of China. The English translation of this code aims to provide a source for western scholars to provide some knowledge on recent developments of Chinese civil law. Also available as a Paperback edition (978-90-04-17915-8).

Available in PDF, EPUB and Kindle. Book excerpt: This book is the product of a unique collaboration between Mainland Chinese scholars and scholars from the civil, common, and mixed jurisdiction legal traditions. It begins by placing the current Chinese contract law (CCL) in the context of an evolutionary process accelerated during China's transition to a market economy. It is structured around the core areas of contract law, anticipatory repudiation (common law) and defense of security (German law); and remedies and damages, with a focus on the availability of specific performance in Chinese law. The book also offers a useful comparison between the CCL and the UNIDROIT Principles of International Commercial Contracts, as well as the Convention on Contracts for the International Sale of Goods. The analysis in the book is undertaken at two levels - practical application of the CCL and scholarly commentary.

Book excerpt: Disturbed by a series of harrowing "birth-control" experiences, Chi An applied for a visa to join her husband, who was studying at a university in the U.S. Not long after she arrived in America, the tables were turned: Chi An found herself pregnant. Since Chi An and her family planned to return to China, she was forced to seek permission from Chinese officials to have a second child. The Chinese authorities responded with a resounding no, insisting that Chi An "fix this problem as soon as possible." After much anguished debate, Chi An and her husband decided to cut their ties to their homeland and applied to the U.S. government for asylum. America was not responsive and, instead, initiated deportation procedures. China expert Steven Mosher stepped in, helping Chi An win her case and ultimately effecting a policy change that protects families in similar situations.

Book excerpt: This book offers a comprehensive analysis in the theories and framework of Chinese contract law as well as its implication in Chinese judicial practices through the recent cases in Chinese people’s courts. It aims to provide answers to the above questions in a systematic way, theoretically and practically; it therefore analyzes the issues surrounding the process of contract-making and performance under the Chinese contract law and doctrines underlying the law. The focus is upon issue-oriented discussions from which different solutions may be drawn based on the nature of particular fact patterns. In addition, for research purposes, an analytical comparison is employed with regard to the laws that govern contracts to help illustrate how Chinese law is distinctive. In short, the book presents a well-analyzed inside view of Chinese contract law in theory and practice, which will be of interest to both academic researchers and practitioners in the area of contracts.

Available in PDF, EPUB and Kindle. Book excerpt: Abstract: This work suggests three possible avenues of implementation that would bring China's child welfare policies more in-line with their 2005 agreement to the Hague Convention on Protection of Children and Co-operation in Respect to Inter-country Adoption. These three suggestions are relaxing the One-Child policy so children are able to remain with their birth families, relaxing domestic adoption regulations to enable willing Chinese families to adopt, and creating a formal national foster care system for disable children who have little chance of adoption. It focuses on each suggestion's history, current situation, its possibility of success, and which policy suggestion has the highest potential for success concerning China's orphaned and abandoned children.
