Download or read book From Jim Crow to Civil Rights written by Michael J. Klarman and published by Oxford University Press. This book was released on 2004-02-05 with total page 670 pages. Available in PDF, EPUB and Kindle. Book excerpt: A monumental investigation of the Supreme Court's rulings on race, From Jim Crow To Civil Rights spells out in compelling detail the political and social context within which the Supreme Court Justices operate and the consequences of their decisions for American race relations. In a highly provocative interpretation of the decision's connection to the civil rights movement, Klarman argues that Brown was more important for mobilizing southern white opposition to racial change than for encouraging direct-action protest. Brown unquestioningly had a significant impact--it brought race issues to public attention and it mobilized supporters of the ruling. It also, however, energized the opposition. In this authoritative account of constitutional law concerning race, Michael Klarman details, in the richest and most thorough discussion to date, how and whether Supreme Court decisions do, in fact, matter.

Book Synopsis 51 Imperfect Solutions by : Judge Jeffrey S. Sutton
Download or read book 51 Imperfect Solutions written by Judge Jeffrey S. Sutton and published by Oxford University Press. This book was released on 2018-05-07 with total page 297 pages. Available in PDF, EPUB and Kindle. Book excerpt: When we think of constitutional law, we invariably think of the United States Supreme Court and the federal court system. Yet much of our constitutional law is not made at the federal level. In 51 Imperfect Solutions, U.S. Court of Appeals Judge Jeffrey S. Sutton argues that American Constitutional Law should account for the role of the state courts and state constitutions, together with the federal courts and the federal constitution, in protecting individual liberties. The book tells four stories that arise in four different areas of constitutional law: equal protection; criminal procedure; privacy; and free speech and free exercise of religion. Traditional accounts of these bedrock debates about the relationship of the individual to the state focus on decisions of the United States Supreme Court. But these explanations tell just part of the story. The book corrects this omission by looking at each issue-and some others as well-through the lens of many constitutions, not one constitution; of many courts, not one court; and of all American judges, not federal or state judges. Taken together, the stories reveal a remarkably complex, nuanced, ever-changing federalist system, one that ought to make lawyers and litigants pause before reflexively assuming that the United States Supreme Court alone has all of the answers to the most vexing constitutional questions. If there is a central conviction of the book, it's that an underappreciation of state constitutional law has hurt state and federal law and has undermined the appropriate balance between state and federal courts in protecting individual liberty. In trying to correct this imbalance, the book also offers several ideas for reform.

Book Synopsis Establishing Justice in Middle America by : Jeffrey Brandon Morris
Download or read book Establishing Justice in Middle America written by Jeffrey Brandon Morris and published by U of Minnesota Press. This book was released on with total page 473 pages. Available in PDF, EPUB and Kindle. Book excerpt: Headquartered in St. Louis and serving primarily Midwestern states, the Eighth Circuit Court has ruled on cases that touch some of the most significant issues in American history, including Native American rights, school segregation, farm bankruptcies, abortion, the environment, pornography, the “war on drugs,” and the first successful class-action sexual-harassment lawsuit. In Establishing Justice in Middle America, Jeffrey Brandon Morris covers its history, from its founding in 1866 through the present day. Morris also provides a panoramic view, discussing how the court has changed over time, the judges who have served on the court, and all of the court’s major cases. This work is one of the first histories of a court in the mostly regional tier of federal courts that are, judicially speaking, nearest to the Supreme Court. Establishing Justice in Middle America reveals how, in many ways, the history of a regional court is a history of the nation itself. Jeffrey Brandon Morris is professor of law at Touro Law Center in Long Island, New York. He is the author or editor of sixteen books, including histories of four federal courts, and is editor of the Encyclopedia of American History. Published for the Historical Society of the United States Courts in the Eighth Circuit.
