Cette définition renvoie à une modélisation des contrats et à leur correspondance avec un type, cadre contractuel préexistant dans lequel, par choix ou par contrainte - contrats-types obligatoires, contrats d'adhésion ou contrats automatiques - les contractants coulent leur volonté. La cause correspond bien alors à celle identique par type de contrat. Mais cette définition recèle une contradiction. En effet, lorsque les parties utilisent la faculté que leur reconnaît l'article 1107 du code civil pour créer des structures contractuelles ne correspondant à aucun type connu, afin de servir une finalité atypique, la cause ne peut plus être entendue comme celle qui découle de la structure contractuelle. Elle doit être recherchée dans la définition individuelle qu'en donnent les parties. La dichotomie rigide des causes, objective-subjective, en fonction du contrôle exercé - de l'existence de la cause ou de sa liceité -, doit donc laisser place à une opposition de la cause typique et de la cause atypique, individuellement définie. En conséquence, le contrôle de l'existence de la cause se trouve diversifié. Dans le premier cas, la définition typique de la cause s'impose aux contractants ayant fait le seul choix d'un type de contrat. Elle devient contraignante et se prolonge par des sanctions - intégrant le lien de la cause et de la structure contractuelle utilisée. Dans le second cas, le juge vérifie que les contreparties attendues correspondent aux définitions qu'en ont donné les parties, ou à celles rendant intelligibles l'engagement de chacun.

Avant d’observer la marge de manoeuvre des parties pour gérer ces risques, il faut délimiter la répartition par défaut desdits risques. Une telle répartition varie considérablement en fonction du type contractuel, de l’unilatéralisme du contrat-échange au partage dans le contrat-alliance en passant par l’équilibre des risques au sein des contrats-coopération. En droit anglais, au contraire, la répartition par défaut des risques est, de manière générale, plus équilibrée. La gestion des risques par les parties repose sur le principe de liberté contractuelle dont le sens et la portée varient en fonction du système juridique étudié, mais cette possibilité doit être plus ou moins encadrée selon la nature de la relation contractuelle. Par conséquent, il est possible de proposer un contrôle distinct pour les contrats d’adhésion et les contrats négociables. Les contrats d’adhésion doivent être plus encadrés, et à un degré supplémentaire qu’en droit anglais où la liberté contractuelle s’épanouit pleinement depuis le Consumer Rights Act. Toutefois, même valides, les clauses de gestion des risques contractuels sont limitées au stade de leur application que ce soit en raison de l’extinction du contrat ou du comportement des parties. Ici, les particularités du droit français doivent être renforcées et permettent d’améliorer un système juridique qui, en dépit d’écrits contraires, est à la fois efficace et efficient.

Book excerpt: In October I873, as every Conference Report recalls, the Associ ation for the Reform and Codification of the Law of Nations was founded in Brussels (Belgium). At the Brussels Conference of I895 the Association's name was changed and ever since it has been "The International Law Association". On August 30 and 3I and September I, I973, a Centenary Cele bration will be held in the Association's place of birth. In the course of preparations made for this triduum, plans were also laid by the Executive Council for a Centenary Volume to mark the event. The formula adopted for the book was mostly based on contributions by Chairmen and/or Rapporteurs of International Committees of the Association who were asked to shed light on "the present state" of their subject. Hence the title of the Volume. For good measure, vari ous other topics not coming under the terms of reference of Inter national Committees were added. Almost all of the authors invited responded favourably, and their studies are to be found in Part II, arranged in sections which have no other justification than the Editor's whim. It should be pointed out that Chairmen and/or Rapporteurs of International Committees wrote their articles a titre personnel and, therefore, cannot be deemed to express opinions held by their Com mittees as such. Part I contains the "other essays", dealing with the Association itself rather than with the present state of international law.
