Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A Manual of Equity Pleading and Practice: State and Federal These few pages grew out of a course of lectures delivered for several years at The John Marshall Law School at Chicago. A limited time spent studying one hundred pages of essentials, yields better results than the same time spent on one thousand pages, through which are scattered the same essentials, with nine hundred pages of minor details. For mental grasp, students and lawyers prefer the small elementary treatise; for later study and reference, the larger one. No small work has been published during the last twenty years, and the practice has modernized in many respects. It therefore seems a fit time to produce this modest book, which it is hoped, may lighten the labors of students and lawyers. Its plan is different from prior small treatises. Its aim is to treat the main features briefly but not less completely than in other works large or small, and to discuss only such matters of procedure as most frequently arise, and need to be better understood. The book is designed for the studious lawyer as well as for the student. It is intended to set forth the general chancery procedure, State and Federal. Illinois cases have been cited, where possible, merely to make the book more useful for some particular State. Modem practice in relation to the master's office has received special attention. The practice in the federal courts is largely controlled by the United States Supreme Court's equity rules, and they are included for ready reference. State statutes, governing chancery practice, usually provide that matters of practice not therein provided for, shall be "according to the general usage and practice of courts of equity." Book excerpt: Excerpt from Modern Pleading and Practice in Equity in the Federal and State Courts of the United States, Vol. 1 of 2: With Particular Reference to the Federal Practice, Including Numerous Forms and Precedents I have designed this Work to be a convenient manual of the present practice in all Courts of Chancery, but with particular reference to suits in the federal courts. Inasmuch as the practice in the United States Circuit Courts of Appeals is new, and in consequence at least measurably unsettled, I have given very especial attention to that branch of the subject, endeavoring to include a full statement of every point decided in reference to such appeals down to the time of going to press. Book excerpt: Excerpt from Federal Equity Practice, Vol. 2 of 3: A Treatise on the Pleadings Used and Practice Followed in Courts of the United States in the Exercise of Their Equity Jurisdiction In large and complicated litigation the desirability of determining the details of the controversy in all its aspects in one suit is rightly given much weight. Here the court will allow issues to be brought in by cross bill which in a narrow view might be considered not ger mane to the original bill, and which, under other conditions, would be held to supply matter for an original suit only. This is particularly true in railroad foreclosures. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book excerpt: Excerpt from Federal Equity Practice, Vol. 1 of 3: A Treatise on the Pleadings Used and Practice Followed in Courts of the United States in the Exercise of Their Equity Jurisdiction An examination of the illustrative cases used in this treatise will show pretty clearly, we think, that the author has endeavored to follow the plan of exposition thus recommended. The decisions of the English Chancery have been cited in this work when needed to elucidate points unsettled or left Obscure by the American cases, but no effort has been made to crowd the footnotes with English citations. The English works of Smith (2d ed.) and Daniell (lst ed.) have of course been carefully studied and freely utilized but when it has been found desirable to incorporate passages of any length from these writers, such matter has usually been quoted and printed in subordinate type. While this treatise was in course of preparation, the second edition of Gibson's Suits in Chancery appeared. This admirable work has been of much assistance, and by the kindness of Judge Gibson the present writer has been permitted to use it with the same freedom as he has used Smith or Daniell. For the generous extension of this privilege the author here expresses his sincere thanks. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book excerpt: Excerpt from Cases on Equity Pleading and Practice The cases contained in this volume have been selected with a view of assisting both the student and the instructor, with illustrations of the practical application of the general principles and rules of equity pleading and practice. Only so much of the statement of fact and of the opinion of the court have been retained in each case as is sufficient to make the decision upon the question of pleading before the Court intelligible and clear. As far as possible all padding has been excluded. In the selection of these cases and in the preparation of this volume, we are greatly indebted to the valuable assistance of John W. Dwyer, LL.M., Instructor of Law in the University of Michigan. Littleton has said: "And know, my son, that it is one of the most honorable, laudable, and profitable things in our law to have the science of well pleading; and, therefore, I counsel thee especially to employ thy courage and care to learn this." We hope that this collection of cases will be of some practical assistance to the teacher in giving instruction in this very difficult branch of the law and that it will stimulate the courage of the student to master the "science of well pleading."
