Available in PDF, EPUB and Kindle. Book excerpt: A History of Law in Canada is the first of two volumes. Volume one begins at a time just prior to European contact and continues to the 1860s, while volume two will start with Confederation and end at approximately 2000. The history of law includes substantive law, legal institutions, legal actors, and legal culture. The authors assume that since 1500 there have been three legal systems in Canada - the Indigenous, the French, and the English. At all times, these systems have co-existed and interacted, with the relative power and influence of each being more or less dominant in different periods. The history of law cannot be treated in isolation, and this book examines law as a dynamic process, shaped by and affecting other histories over the long term. The law guided and was guided by economic developments, was influenced and moulded by the nature and trajectory of political ideas and institutions, and variously exacerbated or mediated intercultural exchange and conflict. These themes are apparent in this examination, and through most areas of law including land settlement and tenure, and family, commercial, constitutional, and criminal law.

Available in PDF, EPUB and Kindle. Book excerpt: This second volume of the Canadian State Trials series focuses on the largest state security crisis in 19th century Canada: the rebellions of 1837-1838 and associated patriot invasions in Upper and Lower Canada (Ontario and Québec). Historians have long debated the causes and implications of the rebellions, but until now have done remarkably little work on the legal aspects of the insurrections and their aftermath. Given that over 350 men were tried for treason or equivalent offences in connection with the rebellions, this volume is long overdue. The essays collected here, written by prominent Canadian historians, legal scholars, and archivists, break new ground in the existing historiography of the rebellions by presenting the first comprehensive examination of the legal dimensions of the crises. In addition to examining trials and court martial proceedings, the essays examine their political, social, and comparative contexts, including the passage of emergency legislation and executive supervision of legal responses, the treatment of women, and the plight of political convicts transported to the Australian penal colonies. Canadian State Trials, Volume Two contributes significantly to the ongoing reassessment of the rebellion period.

Available in PDF, EPUB and Kindle. Book excerpt: Starting in 1837, rebels in Upper and Lower Canada revolted against British rule in an attempt to reform a colonial government that they believed was unjust. While this uprising is often perceived as a small-scale, localized event, Revolutions across Borders demonstrates that the Canadian Rebellion of 1837–38 was a major continental crisis with dramatic transnational consequences. In this groundbreaking study, contributors analyze the extent of the Canadian Rebellion beyond British North America and the turbulent Jacksonian period's influence on rebel leaders and the course of the rebellion. Exploring the rebellion's social and economic dimensions, its impact on American politics, policy-making, and the philosophy of manifest destiny, and the significant changes south of the border that influenced this Canadian uprising, the essays in this volume show just how malleable borderland relations were. Chapters investigate how Americans frustrated with the young republic considered an “alternative republic” in Canada, the new monetary system that the rebels planned to establish, how the rebellion played a major role in Martin Van Buren's defeat in the 1840 presidential election, and how America's changing economic alliances doomed the Canadian Rebellion before it even started. Reevaluating the implications of this transnational conflict, Revolutions across Borders brings new life and understanding to this turning point in the history of North America.

Available in PDF, EPUB and Kindle. Book excerpt: First published in 1952 and 1955, John A. Macdonald: The Young Politician, The Old Chieftain remains a classic in Canadian arts and letters. Described as the greatest biography ever written in Canada, it earned Donald Creighton two Governor General's Awards. In 2013, the Toronto Review of Books recommended it to anyone who wished to become a better Canadian. In this book, Creighton examines the public and private lives of Canada’s first prime minister, his victories and defeats as well as his joys and pains. A gifted writer, Creighton takes the reader back in time, to the nineteenth century, the road to Confederation, and the building of the railway. Along the way, he visits Kingston, Quebec, Charlottetown, Ottawa, and London, following his hero from a few rooms above his father’s shop in Kingston to the corridors of power in England, including the magnificent Highclere Castle where much of the British North America Act was written. This edition includes a new introduction by Creighton's biographer, Donald Wright, and by Peter Waite, Creighton's very first doctoral student.

Available in PDF, EPUB and Kindle. Book excerpt: The Carleton Library Series makes available once again Inventing Canada, Suzanne Zeller's classic history of science, land, and nation in Victorian Canada. Zeller argues that the middle decades of the nineteenth century that saw the British North American colonies attempting to establish a transcontinental nation also witnessed the rise of an analytical tradition in science that challenged older conceptions of humanity's relationship with nature and the land. Zeller taps a wide range of archival and published sources to document the prominent place of Victorian science in British North American thought and society. Her focus on the creative functions of Victorian geological, geophysical, and botanical sciences highlights the formation of a Canadian community of scientists, politicians, educators, journalists, businessmen, and others who promoted public support of scientific activities and institutions. By moving beyond the eighteenth-century mechanical ideals that had forged the United States, they reassessed the land and its possibilities to redefine the transcontinental future of a northern variant of the British nation. Inventing Canada is a must-read for anyone interested in the scientific background of Canada's history, including its environmental history.
