Available in PDF, EPUB and Kindle. Book excerpt: The purpose of the volume Basic Documents in Federal Campaign Finance Law is to present that evolution of the meaning of money and politics in American governance, with a special focus on the regulations and norms which have shaped the current understanding of campaign finance in the United States. It is important to acknowledge the main reasons for federal legislation on campaign finance, its outcomes, and the ways in which issues have been challenged in the courts, focusing especially on the changing interpretations of the Supreme Court towards the issue. The book contains a short introduction to every important piece of legislation or Court decision, in which the authors have presented the background of the legislation and its main purposes and substance, as well as the facts leading to legal disputes over the legislation's constitutionality. Each introductory piece is followed by the most crucial excerpts from legislative acts or Supreme Court opinions on campaign finance, so that readers are able to analyze for themselves the substance and form of the regulations on the issue. According to the authors, all twenty nine documents presented in the volume (14 acts of Congress, and 15 Court decisions), should be considered the main legal source of the debate on the proper scope of money in federal election campaigns. Although most of the excerpts presented relate to federal laws, there are a few references to state laws when the issue at stake has a direct effect on the national discussion on campaign finance.

Available in PDF, EPUB and Kindle. Book excerpt: In 2002 Congress enacted the Bipartisan Campaign Reform Act (BCRA), the first major revision of federal campaign finance law in a generation. In March 2001, after a fiercely contested and highly divisive seven-year partisan legislative battle, the Senate passed S. 27, known as the McCain-Feingold legislation. The House responded by passing H.R. 2356, companion legislation known as Shays-Meehan, in February 2002. The Senate then approved the House-passed version, and President George W. Bush signed BCRA into law on March 27, 2002, stating that the bill had "flaws" but overall "improves the current system of financing for federal campaigns." The Reform Act was taken to court within hours of the President's signature. Dozens of interest groups and lawmakers who had opposed passage of the Act in Congress lodged complaints that challenged the constitutionality of virtually every aspect of the new law. Following review by a special three-judge panel, the case is expected to reach the U.S. Supreme Court in 2003. This litigation constitutes the most important campaign finance case since the Supreme Court issued its decision in Buckley v. Valeo more than twenty-five years ago. The testimony, submitted by some of the country's most knowledgeable political scientists and most experienced politicians, constitutes an invaluable body of knowledge about the complexities of campaign finance and the role of money in our political system. Unfortunately, only the lawyers, political scientists, and practitioners actually involved in the litigation have seen most of this writing—until now. Ins ide the Campaign Finance Battle makes key testimony in this historic case available to a general readership, in the process shedding new light on campaign finance practices central to the congressional debate on the reform act and to the landmark litigation challenging its constitutionality.

The book opens with an account of the first law, then moves to the Watergate period while explaining the background of the 1970's reforms. Subsequent chapters examine the origin and passage of legislation through case studies, focusing on congressional debates and roll call votes; analyze the arguments of reformers and their opponents in court battles over these laws; demonstrate how the press and public opinion effect the legislative climate; assess the creation of the Federal Election Commission, its quasi-judicial role, and the political cross pressures to which it is subject; and explain the rise of labor and business PACs.

Book Synopsis Money, Politics, and Campaign Finance Reform Law in the States by :
Download or read book Money, Politics, and Campaign Finance Reform Law in the States written by and published by . This book was released on 2002 with total page 424 pages. Available in PDF, EPUB and Kindle. Book excerpt: Money, Politics, and Campaign Finance Reform Law in the States presents an exciting examination of campaign finance reform and the role of money in state politics through the 2000 elections. Written by leading scholars on state politics and campaign finance reform, this book is the first to provide in-depth case studies that describe the reality of the impact money has on state politics; what efforts have been undertaken to regulate this money; and how successful the law has been in ensuring fair elections. Americans are deeply concerned about the role and impact of money upon politics and government. While numerous publications have documented Congressional efforts to enact campaign finance reform, this book puts the spotlight on state efforts to address the impact of money on politics. Money, Politics, and Campaign Finance Reform Law in the States offers the most comprehensive and up-to-date analysis of money and campaign finance reform at the state level on the market. Its findings will be invaluable to scholars, lawyers, legislators, and activists involved with campaign finance reform. "This book is a must-read for anyone who wants to understand the direction of politics in Illinois and in other states." -- Illinois Issues, November 2002 "Schultz does an excellent job in the introductory chapter of explaining the four preeminent Supreme Court decisions that frame the current debate on campaign finance reform at the federal and state level... This book will be of interest to students not just of money and campaign finance reform, but also to those interested in state politics, interest groups, and political parties." -- Election Law Journal, 2003 "[T]his book makes an important -- perhaps even unique -- contribution to an area of study that has received much less attention than the federal system." -- Guardian (COGEL), Spring 2004
