Book excerpt: This Issue brief distills arguments that were presented in the amicus brief filed in the Proposition 8 litigation by the San Francisco La Raza Lawyers Association, for which the authors served as counsel. Proposition 8, a ballot initiative that passed in November 2008, added a new section to the California Constitution which provides that "Only marriage between a man and a woman is valid or recognized in California." The initiative's proponents intended for Proposition 8 to reverse the California Supreme Court's In re Marriage Cases decision, which found that the California Constitution's rights of liberty, privacy, equal protection, and due process protected the right of same-sex couples to marry. A lawsuit was filed by a group of petitioners, including same-sex couples who were unable to marry and those who wanted to preserve legal recognition of their marriages, requesting the California Supreme Court to stay and immediately review the validity of Proposition 8. The majority of press attention has focused on the petitioners' arguments that Proposition 8 is invalid as an improper constitutional revision of the state constitution that could not be accomplished through the initiative process, which only permits constitutional amendments. The authors agree that Proposition 8 should be struck down if the California Supreme Court finds it to have been an unconstitutional revision, but Mr. Martinez and Mr. Yoshino focus on presenting an argument in the alternative: "[T]o the extent the rights to liberty, privacy, due process and equal protection have not themselves been changed, then the pre-existing interpretation of those rights in Marriage Cases must control--and the attempt to mandate a change in the California Supreme Court's interpretation of pre-existing rights violates separation of powers principles. Thus, even if Proposition 8 is construed as a permissible amendment (as opposed to a revision), it would necessarily violate separation of powers principles because it purports to dictate a specific interpretation of certain other--indisputably unchanged--constitutional provisions." The authors explain their view that Proposition 8's attempt to change the Court's reasoning and interpretation of fundamental rights, "without revising the bases for the Court's reasoning, violates separation of powers principles inherent in the California Constitution and renders Proposition 8 unconstitutional." Mr. Martinez and Mr. Yoshino conclude by advising, "[t]his attempt to control judicial interpretive power should also underscore why those who care about separation of powers and the integrity of the three branches of government should be profoundly troubled by Proposition 8, regardless of their position on same-sex marriage"--Description on document home page.

Book excerpt: In one of the most disappointing electoral blows in the struggle for gay and lesbian rights, California voters passed Proposition 8 by a 52-48 margin in November 2008, overturning a state supreme court decision that had legalized same-sex marriage earlier in the year. Although popular votes have almost uniformly rejected same-sex marriage rights, usually by large margins, the polls had indicated that a majority of Californians would vote against the proposition and retain marriage equality. Using data from 24 polls of Californians since 1985, we consider four hypotheses to explain why the polls got it wrong: (1) many respondents misled pollsters, perhaps worried that they would appear to be bigots if they expressed their real beliefs; (2) more effective efforts by the Yes on 8 campaign lowered support for same-sex marriage; (3) a principled opposition by some same-sex marriage opponents to writing discrimination into the constitution declined over the year; and (4) survey respondents misunderstood Proposition 8 and changed their positions as they became more aware of its meaning. We find the most support for the fourth hypothesis and conclude that Proposition 8 passed because most Californians oppose same-sex marriage. Our analysis of changes over time also makes us skeptical that support for same-sex marriage will increase enough by 2012 to pass a new amendment guaranteeing same-sex marriage rights.

Book excerpt: My doctoral dissertation examines the discursive strategies of ten organizations engaged in the 2008-2013 same-sex marriage battle of Proposition 8 in California. In November 2008 Californians voted to ban same-sex marriage under the state constitution through Proposition 8. Based on a queer analysis, my dissertation examines why and how same-sex marriage has become a pivot point in debates about larger political issues, including the regulation of sexualities, the criteria for citizenship, the boundaries of state authority, and the nature of social justice. Proposition 8 serves as an influential case study to assess the current political goals of the American gay and lesbian movement, the influence and power of social conservatives in determining the sexualized nature of citizenship, and the implications of allocating rights on the basis of family form, sexuality and sexual conduct. I examine the political discourses of ten organizations - four social conservative organizations, and six mainstream gay, lesbian and bisexual (LGB) organizations - which rallied for and against Proposition 8 as it progressed through referendum and the courts as Perry et. al. v. Schwarzenegger. To conduct the discourse analysis, I use a triangulation of methods, including the public documents of the ten organizations; elite interviews with leaders of the mainstream LGB organizations; and the court proceedings from the Perry et. al. v. Schwarzenegger hearings. I analyze these documents, asking three central questions. First, how did the Proposition 8 organizations frame their discursive arguments in terms of larger citizenship issues including the legitimating of citizens, the boundaries of state authority, and the nature of social justice? Second, how did the Proposition 8 organizations' discourses reproduce or resist dominant heteronormal, and specifically social conservative, definitions of legitimate citizens, the boundaries of state authority, and the nature of social justice in their attempts to gain social and political inclusions and rights through same-sex marriage? Third, what are the implications of reproducing or resisting, particular heteronormal, social conservative, discourses in relation LGBTQ equality debates? I argue that through their bid to win same-sex marriage, the mainstream LGB organizations produced heteronormal and exclusionary discourses. As a result, the mainstream LGB organizations created and promoted a limited project of equality that only served the ends of particular kinds of heteronormative homosexual citizens.

At the same time, federal and state courts are beginning to address the validity of statutory and constitutional provisions limiting marriage to heterosexual couples. State courts in New Jersey, Massachusetts, California, Connecticut, and Iowa have held that denying gay and lesbian couples the right to marry violates their state constitution. Some state courts have also found that domestic partnership/civil union laws are not the constitutional equivalent of civil marriage. Conservative opponents of same-sex marriage used appeals to religious liberty and parental rights to win ballot measure campaigns, but could not duplicate this success in court. Looking at the same-sex marriage debate at the ballot box and in the courts, this timely book offers unique insights into one of the most fluid social and legal issues of our day—and into the role of institutional context in how rights are used. Why, Joseph Mello asks, did conservative opponents of same-sex marriage enjoy such an advantage when debating this issue in the popular arena of a ballot measure campaign? And why were they less successful at mobilizing the language of rights in the courts? His analysis shows us that rights don't just entitle us to resources; they also shape the way we see ourselves and are perceived by others. Thus, by using the language of rights to frame their cause, conservative opponents of same-sex marriage were able to construe themselves as victims of oppression, their religious and moral beliefs under threat.
