Book excerpt: In English Trade and Adventure to Russia in the Early Modern Era, Maria Salomon Arel revisits Anglo-Russian trade in first half of the seventeenth century. Drawing on largely neglected Russian and English sources, she reconstructs the history of the Muscovy Company in a period of expanding opportunities for foreigners in Russia and of tightening links between regional markets across the globe. In her strongly revisionist telling, the Company successfully rebuilt in the aftermath of the devastating Time of Troubles, securing its uniquely privileged position in the Russian market at the hands of a newly installed tsar and Romanov dynasty keen to revive the country’s decimated economy through the stimulus of foreign trade. Meanwhile, on the London end of a trade clearly deemed relevant to commercial and shipping interests increasingly dependent on Russian naval stores and invested in the Russian re-export trades to and from the Mediterranean and Asia, the Company restructured its organization and finances with crucial royal support in furtherance of the ‘public good’ and early Stuart dynastic honor. As Arel documents, by the 1630s-40s, English trade to Russia was flourishing, as seen in the growing number of Muscovy Company men active all along the Moscow-Archangel route, their substantial commercial infrastructure, extensive supply networks among a broad swath of Russian merchants and traders, and prominent role in the exploitation of monopoly trades established to fill the tsar’s coffers with specie. The picture drawn by Arel overturns a traditional narrative on the Russia trade that has relegated the English to the shadows, demonstrating the tenacity and continued development of their enterprise at the intersection of English commercial expansion, Russian economic growth, and advancing globalization processes. Taking the narrative even further, the book opens up new perspectives and research directions by pointing to an incipient link between the Russian and transatlantic markets, while shifting the lens on the Anglo-Dutch relationship in the Russia trade away from the time-worn dichotomy of cutthroat competition to a more nuanced understanding of mutual cooperation and business association between merchants on the ground, even in the face of commercial and territorial competition between nations.

Book excerpt: The growth in England and Britain’s merchant marine from the medieval period onwards meant that an increasing number of criminal offences were committed on or against the country’s vessels while they were at sea. Between 1536 and 1834, such crimes were determined at the Admiralty Sessions if brought to trial. This was a special part of the wider Admiralty Court, which, unlike the other forums in that tribunal, used English common law procedure rather than Roman civil law to try its cases. To a modest extent, this produced a ‘hybrid’ court, dominated by the common law but influenced by aspects of Europe’s other major legal tradition. The Admiralty Sessions also had their own (highly singular) regime for executing convicts, used the Marshalsea prison to hold their suspects and displayed the Admiralty Court’s ceremonial silver oar at their hearings and hangings. During the near three centuries of its existence, the Admiralty Sessions faced enormous legal and logistical problems. The crimes they tried might occur thousands of miles and months of sailing time away from England. Assembling evidence that would ‘stand up’ in front of a jury was a constant challenge, not least because of the peripatetic lives of the seafarers who provided most of their witnesses. The forum’s relationship with terrestrial criminal courts in England was often difficult and the demarcation between their respective jurisdictions was complicated and subject to change. Despite all of these problems, the court experienced significant successes, as well as notable failures, in its battle to deal with a litany of serious maritime crimes, ranging from piracy to murder at sea. It also spawned a series of Vice-Admiralty Courts in English and British colonies around the world. This book documents the origins, development and abolition of the Admiralty Sessions. It discusses all of the major crimes that were determined by the forum, and examines some of the more arcane and unusual offences that ended up there. Some of the unusual challenges presented by the maritime environment, whether the impossibility of preserving dead bodies at sea, the extensive power given to captains to physically punish sailors, the difficulty of securing suspects in small vessels, or the often gruesome problems occasioned by the marginal legal status of slaves, are also considered in detail.

The book examines the Two Treatises of Government, in which Locke argues that the seas are collectively owned by all humans and are governed by universal natural laws that prohibit piracy. Locke’s Two Treatises provides a systematic political theory of the seas that contributes to theories of international law and maritime law, but his text does not answer the practical question of how to enforce law effectively at sea. The book also considers how Locke translated his theoretical ideas into practice when he was involved in policymaking as a member of England’s Board of Trade during the 1690s. On the Board, Locke waged a war against pirates by proposing an anti-piracy treaty between Europe’s major maritime states, by successfully advocating a new English piracy law, and by supporting the deployment of the English Navy against pirates. Locke’s war against pirates was consistent with the natural law theory in the Two Treatises, and helped to build English empire on land and at sea. There is also consistency between Locke’s theoretical views about slavery and his work on the Board of Trade. As a Board member, Locke advocated forced migration and forced labor for English convicts, which is consistent with the theory of penal slavery in the Two Treatises and suggests that his theory was intended to justify the enslavement of English convicts. However, there are tensions between Locke’s arguments in the Two Treatises and the policies of forced naval service that he supported on the Board. Locke’s theories of law and freedom at sea shaped his vision of English national identity, and influenced the English government’s policies about slavery and piracy.
