State governments took steps between 1950 and 1990 to minimize the involuntary confinement of people in psychiatric hospitals, and many mental health facilities closed down. Yet, as Anne Parsons reveals, the asylum did not die during deinstitutionalization. Instead, it returned in the modern prison industrial complex as the government shifted to a more punitive, institutional approach to social deviance. Focusing on Pennsylvania, the state that ran one of the largest mental health systems in the country, Parsons tracks how the lack of community-based services, a fear-based politics around mental illness, and the economics of institutions meant that closing mental hospitals fed a cycle of incarceration that became an epidemic. Given the vast racial disparities in incarceration, the prison system also reinforces race and class divisions. How and why did we become the world’s leading jailer? And what can we, as a society, do about it? Reframing the story of mass incarceration, Heather Schoenfeld illustrates how the unfinished task of full equality for African Americans led to a series of policy choices that expanded the government’s power to punish, even as they were designed to protect individuals from arbitrary state violence. Examining civil rights protests, prison condition lawsuits, sentencing reforms, the War on Drugs, and the rise of conservative Tea Party politics, Schoenfeld explains why politicians veered from skepticism of prisons to an embrace of incarceration as the appropriate response to crime. To reduce the number of people behind bars, Schoenfeld argues that we must transform the political incentives for imprisonment and develop a new ideological basis for punishment.

This concept has a rather mixed lineage. "After September 11" has become a slogan that conveys all things to all people but carries some very specific implications on interrogation and civil liberties for the future of punishment and social control.The editors hold that the already pliable boundaries between ordinary and political crime will become more unstable; national and global considerations will come closer together; domestic crime control policies will be more influenced by interests of national security; measures to prevent and control international terrorism will cast their reach wider (to financial structures and ideological support); the movements of immigrants, refugees, and asylum seekers will be curtailed and criminalized; taken-for-granted human rights and civil liberties will be restricted. Before their confinement, many incarcerated women had gained access to work and higher education. But once behind bars, they found the only programs available for them perpetuated misogynistic norms. Challenging Confinement is about how incarcerated women incorporated strategies from feminist movements into their activism behind bars. Facing long sentences, overcrowded prisons, and a lack of rehabilitation programs, incarcerated women protested, organized, and filed lawsuits to advocate for gender and racial equality in prison. Drawing on prison grievance reports, oral histories, state archives, and private collections, Bonnie L. Ernst tells the story of how women's movements, beginning in the 1920s and ending in the era of mass incarceration, infused prison activism in Michigan with new energy. Female prisoners and attorneys successfully persuaded the federal court to force state prisons to offer more programming and access to legal services.
