Book excerpt: The Moving Ahead for Progress in the 21st Century Act (MAP-21; P.L. 112-141), a two-year authorization of federal spending on highway and public transportation programs, surface transportation safety and research, and some rail programs, was set to expire September 30, 2014. The Highway and Transportation Funding Act of 2014 (P.L. 113-159), enacted on August 8, 2014, extended the authorization of the programs and expenditure authority of the highway trust fund through May 31, 2015. The legislation also transfers $10.765 billion to the highway trust fund (HTF), with $9.765 billion from the general fund and $1 billion from the Leaking Underground Storage Tank (LUST) fund. Nearly all the funding for highways and most of the funding for public transportation is drawn from the HTF. However, the motor fuel taxes that are the main source of HTF revenue no longer raise enough money to support the programs Congress has authorized. Congressional Budget Office projections indicate that the shortfall between revenues and outlays will average roughly $15 billion annually from FY2015 through FY2020. MAP-21 made up most of the difference between motor fuel tax revenue and spending authorization by transferring money from the Treasury general fund to the HTF. As Congress considers surface transportation reauthorization, the funding shortfall is the major issue framing the debate. The alternatives will involve choices among raising motor fuels taxes, cutting spending, finding other revenue sources for the HTF, approving further transfers from the general fund, and seeking to increase private investment in surface transportation infrastructure. MAP-21 made major changes in the program structure for both highways and public transportation. Some of the changes were designed to increase program efficiency by requiring performance measurement and streamlining project development. As these changes are recent, their effectiveness may be difficult to evaluate.

When it does, it will update two recent reforms of federal surface transportation law that inaugurated a new era of transportation policy in this country. The laws--the Intermodal Surface Transportation Efficiency Act (ISTEA) of 1991 and the Transportation Equity Act for the 21st Century (TEA-21) in 1998 - gave states and metropolitan areas the certainty in funding and the flexibility in program design necessary to attempt new transportation solutions. However, as this brief outlines, the broad reforms boldly initiated on the federal level have not been uniformly implemented. For that reason, the brief argues that reauthorization this year requires Congress to cement and advance the gains achieved in the past decade, and respond more forcefully to the pressing transportation needs of metropolitan America. The brief, to that end, offers a comprehensive policy framework that calls for a two-step approach to reauthorization. Congress must preserve the innovative framework of ISTEA and TEA-21, and ensure that states attend to the needs of their metropolitan areas. It must also give metropolitan areas more powers and greater tools, in exchange for enhanced accountability, to get transportation policy right for their regions.

A major point of contention in this law is how much of our transportation system should be centrally planned and how much should be built and operated in response to the needs of actual transportation users. Advocates of top-down planning want to reduce per capita driving by providing disincentives to automobiles, such as increased congestion and driving costs, and funding expensive alternatives such as high-speed rail and rail transit. Even if you believe in the goal of reducing per capita driving, the evidence indicates that these tools have minimal effect on driving and may even be environmentally counterproductive. Advocates of customer-driven transportation want to fund transportation out of user fees, not taxes, and make transportation providers -- whether public agencies or private parties -- responsive to the needs and desires of those users. Decades of experience have proven that the best way of reducing the environmental costs of transportation is to use new technologies to reduce the impacts per mile of mobility, not to reduce mobility itself. This citizens' guide presents the basic facts behind these two views.
