Book Synopsis Commercial Law of the European Union by : Gabriël Moens
Download or read book Commercial Law of the European Union written by Gabriël Moens and published by Springer Science & Business Media. This book was released on 2010-04-23 with total page 486 pages. Available in PDF, EPUB and Kindle. Book excerpt: ? The Hon. Michael Kirby AC CMG This splendid book performs the heroic task of introducing readers to the large canvas of the commercial law of the European Union (EU). The EU began as an economic community of six nations but has grown into 27 member states, sharing a signi?cant political, social and legal cohesion and serving almost 500 million citizens. It generates approximately 30% of the nominal gross world product. The EU is a remarkable achievement of trans-national co-operation, given the history (including recent history) of national, racial, ethnic and religious hatred and con?ict preceding its creation. Although, as the book recounts, the institutions of the EU grew directly out of those of the European Economic Community, created in 1957 [1.20], the genesis of the EU can be traced to the sufferings of the Second World War and to the disclosure of the barbarous atrocities of the Holocaust. Out of the chaos and ruins of historical enmities and the shattered cities and peoples that survived those terrible events, arose an astonishing pan- European Movement.

Book excerpt: This volume suggests new, theoretically informed approaches for historians and social scientists to engage with the policy of enlargement – across rounds and in all its diversity. It follows three approaches: first tracing Longue Durée developments; second, investigating enlargement Beyond the Road to Membership; and third, exploring the Entangled Exchanges and synergies between the EC/EU and its outside. It attempts to properly historicise the process of enlargement with contributions from historians, social scientists and a legal scholar exemplifying suggested approaches and theoretical reflections from the various disciplines.

Book Synopsis Why Is Agricultural Trade Liberalization at a Stalemate? by : Gabriel Ngwe
Download or read book Why Is Agricultural Trade Liberalization at a Stalemate? written by Gabriel Ngwe and published by ibidem-Verlag / ibidem Press. This book was released on 2012-02-27 with total page 136 pages. Available in PDF, EPUB and Kindle. Book excerpt: Trans-border trade in agricultural goods still faces immense hurdles at the beginning of the 21st century. The USA and the EU, for example, have been protecting their markets through domestic support, export subsidies and various barriers to market access. They have thus prevented many developing countries from exporting agricultural goods in which they have a comparative advantage to them. As a result, developing countries have demanded that the ninth round of negotiations at the World Trade Organization resolves the issue of agricultural protection. Gabriel Ngwe reviews the agricultural policy of the USA, the EC and the G20 prior to 2001 and discusses the evolving of negotiations from 2001 to 2006. He further explains which parties played which role in the negotiations. Furthermore, he proposes solutions how to overcome the stalemate.

Book Synopsis The Precautionary Principle in Marine Environmental Law by : Bénédicte Sage-Fuller
Download or read book The Precautionary Principle in Marine Environmental Law written by Bénédicte Sage-Fuller and published by Routledge. This book was released on 2013-07-18 with total page 297 pages. Available in PDF, EPUB and Kindle. Book excerpt: The book examines whether the jurisdiction of coastal States under international law can be extended to include powers of intervention towards vessels posing a significant risk to their coastal and marine environment, but which have not yet been involved in any incident or accident. The books sets out how it is that coastal State jurisdiction can indeed be seen as including powers of intervention towards High Risks Vessels before an incident or accident happens, on the basis of the precautionary principle. The precautionary principle requires taking action when a risk of damage to the environment is suspected, but cannot be confirmed scientifically. The book thus considers the potential opportunities for the coastal state under international law to regulate international shipping where they consider vessels to an unacceptable risk to the environment, in order to prevent or minimise the risk of occurrence of the accident or incident leading to damage. The book acknowledges that this puts into question some very old and established principles of the law of the sea, most importantly the principle of freedom of navigation. But Bénédicte Sage-Fuller contends that this change would itself be a consequence of the evolution, since the end of WWII, of on the one hand international law of the sea itself, and of international environmental law on the other hand.
