Book excerpt: "The current EA analyzed the effects of shortnose sturgeon research on the environment in the Delaware River where researchers propose to document habitat use, relative abundance, reproduction, juvenile recruitment, temporal and spatial distributions, and reproductive health of the shortnose sturgeon population in the Delaware River and Estuary. The proposed permit requests annual authorization for non-lethal sampling methods on up to 1,000 adult and juvenile shortnose sturgeon. Research activities would include: capturing via gill net, trammel net, and trawl net; measuring and weighing; tagging with PIT and Floy T-bar tags; and sampling tissue for genetic analysis. A subset of 30 adults and 30 juveniles would be tagged with acoustic transmitters. Another subset of 24 adults would be examined internally using laparoscopic techniques and each would potentially also have gonad biopsy and blood sample taken for analyses. Another subset of 20 adults per year would be included in hydroacoustic gear testing. Additionally, lethal collection of up to 300 eggs and larvae each year (not exceeding 900 over five years) would take place during seasonal spawning activity by artifidal substrate, D-frame ichthyoplankton net, and/or epibenthic sled. Finally, one annually, or up to three unintended mortalities or serious harm resulting from research, is requested over the life of the permit. The proposed action analyzed in the EA would not have significant environmental effects on the target or non-target species; public health and safety would not affected; no unique geographic area would be affected; and the effects of this study would not be highly uncertain, nor would they involve unique or unknown risks. Issuance of this permit would not set a precedent for future actions with significant effects, nor would it represent a decision in prindple about a future consideration. There would not be individually insignificant but cumulatively significant impacts associated with the proposed action, and there would not be adverse effects on historic resources. The permit would contain mitigating measures to avoid unnecessary stress to the subject animals"--Cover letter.

The action would continue to exempt the permit holder from takes of shortnose sturgeon (Acipenser brevirostrum) and Atlantic sturgeon (Acipenser oxyrinchus oxyrinchus) under the ESA, by capture, harassment, wounding and hann during bona fide scientific research. Permit No. 17095 currently authorizes the Permit Holder to: monitor shortnose and Atlantic sturgeon abundance and distribution through the Hudson River Biological Monitoring Program (HRBMP) in the Hudson River from River Mile 0 (Battery Park, Manhattan, NY) to River Mile 152 at Troy Dam (Albany, NY). Researchers are authorized to non-lethally capture, handle, measure, weigh, scan for tags, insert passive integrated transponder and dart tags, photograph, tissue sample, and release up to 82 shortnose sturgeon and 82 Atlantic sturgeon annually. Additionally, researchers are permitted to lethally collect up to 40 shortnose sturgeon and up to 40 Atlantic sturgeon eggs and/or larvae (ELS) annually. To account for a higher than expected catch per unit effort of Atlantic sturgeon so far under Permit No. 17095, the Permit Holder now wishes to increase the number of takes for juvenile, sub-adult and adult Atlantic sturgeon to 200 fish per year. However, take would not exceed a total of 600 Atlantic sturgeon captured over the permit life. The number of shortnose sturgeon taken would remain the same. The Permit Holder also requests that the action area be expanded two miles south of the Battery (Manhattan at River Mile 0) to include the upper New York Harbor (~River Mile -2.0). The amount of lethal collection of Atlantic and shortnose sturgeon ELS would remain the same. The modification would be valid until the permit expires August 28, 2017.

Subsets of captured Atlantic sturgeon are fitted with internal satellite tags or external pop-off satellite tags; sampling also includes gonad tissue biopsy. The applicant now requests authorization for 100 annual shortnose sturgeon (Acipenser brevirostrum) takes for the remainder of the permit; all capture methods, action areas and activities would remain the same as for the currently authorized Atlantic sturgeon takes. The authorization to sample an additional sturgeon species would allow the permit holder to test use of a hydroacoustic assessment method for shortnose sturgeon which is currently authorized for Atlantic sturgeon.

Specifically, the applicant is seeking a five-year scientific research permit characterizing habitat use, population abundance, reproduction, juvenile recruitment, age and growth, temporal and spatial distributions, diet selectivity, and contamination load of shortnose sturgeon captured from the Hudson River Estuary from New York Harbor to Troy Dam. The applicant would use anchored and drift gill nets and trawls capturing up to 240 and 2,340 shortnose sturgeon during year 1-3 and year 4-5, respectively. Research activities would also include: measuring, weighing; tagging unmarked individuals with passive integrated transponder and Floy tags; and sampling tissue for genetic analysis. A first subset of fish would be anesthetized and tagged with acoustic transmitters; a second subset would have fin rays sampled for ageing; and a third subset of fish would have gastric contents lavaged for diet analysis, as well as have blood samples taken for contaminant testing. A total of four unintended mortalities are requested over the life of the permit. The Permit modifications addressed in this SEA are for Permit No. 1578-00 issued to the Maine Division of Marine Resources (MDMR) in 2006, and Permit No. 1595-03 issued to Michael Hastings of the University of Maine (UM) in 2009. This SEA, therefore, supplements the prior respective EA and SEA, and all other minor permit modifications. Permit No. 1578 currently authorizes research focusing on the location of spawning habitat, feeding habitat, and migratory pathways of shortnose sturgeon (Acipenser brevirostrum) in the Kennebec River, between Augusta and Waterville, Maine. The proposed modification (File 1578-01) would change research objectives, as well as expand the geographic scope of the research, increasing numbers of sturgeon sampled, acoustic tags deployed, and new research methods including: borescoping, Floy anchor tagging, blood collection, gastric lavage, electronarcosis and scute sampling. Permit 1595-03 currently assesses the distribution, abundance, movements and spawning of shortnose sturgeon in the lower Penobscot River and Estuary. The objectives and action area of research would not be changed in the proposed modification (File 1595-04); however, it proposes increased numbers of sturgeon captured, lower water temperatures for sampling adults and juvenile sturgeon, and new research methods including: scute sampling, Floy anchor tagging, fall egg and larvae sampling, electronarcosis and gastric lavage. Both permit modifications would assist researchers in the future development of collaborative research programs in the Gulf of Maine (GOM) determining the number and size of extant populations of shortnose sturgeon in the GOM and the rate of exchange between coastal river systems"--Abstract (p.
