Book excerpt: Al escribir este libro hemos tratado de presentar, según nos parece, cómo el derecho de bienes ha venido evolucionando desde diversos aspectos y cómo va avanzando hacia un derecho que pudiéramos llamar integral. Nos referimos al proceso conocido como constitucionalización del derecho civil (subtítulo de este libro), proceso que apenas se encuentra en un estado primario, pues los pronunciamientos constitucionales no alcanzan una cantidad suficiente como para formar un bloque compacto en esta materia; sin embargo, a pesar de su escasez, son de gran importancia y por tanto no pueden ser desconocidos. Estos pronunciamientos han introducido conceptos y definiciones que adquieren un carácter interpretativo de primera línea y en ocasiones de respeto obligado. Esta constitucionalización ha permitido, por una parte, estudiar el derecho civil según el derecho constitucional y, por otra, modernizar ciertos aspectos que no habían tenido pronunciamientos importantes. Visto lo anterior, hemos tratado de mostrar este panorama a lo largo de los diferentes temas, advirtiendo que por este ejercicio no estamos convirtiendo en constitucional el derecho civil, sino simplemente mostrando una realidad que se ha venido presentando. También hemos querido presentar otra tendencia, que pudiéramos llamar la función social en el derecho de bienes, que tiene su base en la función social de la propiedad, y dentro de la cual hemos introducido esta figura, no como algo externo sino como algo esencial; es decir, la función social es un elemento fundamental de la propiedad, por lo cual siempre la veremos presente por múltiples factores, sobre todo los de interpretación y legislativos. Así mismo, y sin que se haya completado, a lo largo del libro se busca alcanzar mayor nivel de particularidad en los diferentes temas, mediante un análisis más detallado y, si se me permite, con mayor profundidad.

If it was axiomatic that the goal of human society should be the common good, then this notion presented at least two conceptual alternatives. Did it embody the highest moral ideals of happiness and the life of virtue, or did it represent the more pragmatic benefits of peace and material security? Political thinkers from Thomas Aquinas to William of Ockham answered thisquestion in various contexts. In theoretical terms, they were reacting to the rediscovery of Aristotle's Politics and Ethics, an event often seen as pivotal in the history of political thought. On a practical level, they were faced with pressing concerns over the exercise of both temporal and ecclesiastical authority - resistance to royal taxation and opposition to the jurisdiction of the pope. In establishing the connections between these different contexts, The Common Good questions the identification of Aristotle as the primary catalyst for the emergence of 'the individual' and a 'secular' theory of the state. Through a detailed exposition of scholastic political theology, it argues that the roots of any such developments should be traced, instead, to Augustine and the Bible.
