Book excerpt: The Commission's New Better Regulation Strategy of 2015 (NBRS) seeks to address shortcomings of Old Better Regulation by promoting an approach resembling what elsewhere has been called responsive behavioural regulation. By discussing the weaknesses of Old Better Regulation, we argue that limited validity of its preferred methodology, CBA, poses core issues. Differentiating between internal (legal and scientific) and external (social) validity, we find that legal evaluation and behavioural insights need to be included in a structured manner into RIA to provide a robust methodology which matches state of the art standards in science and societal dialogue. First, NBR has to acknowledge that it operates in a legal environment of EU law, where some decisions are already predetermined. Generic EU law hence already contains certain requirements at normative level, which need to be taken into account when developing NBR strategies. Second, the methods applied for IA have to ensure a degree of internal and external validity that is acceptable for regulatory purposes. In order to meet the value commitments embedded in EU law on the assessment of impacts of EU legislation and to provide internal and external validity in a structured manner we propose to use the “homo oeconomicus institutionalis” model as a guidance for methodological design of RIA.

Legislation and regulations at all levels which might have a social or economic effect are tested thoroughly and systematically. This involves the generation of a range of options and their evaluation, including consultation with those likely to be affected: consumers, small businesses and enterprises, as well as operators and service providers. Final decisions are based on careful evaluation of the options, together with the views expressed and the data submitted. They are open to re-evaluation on appeal. The European Union has adopted formal procedures for impact assessment. These have been subject to review and re-assessment, based on experience across all economic sectors. They have been widely applied (e.g., to international mobile roaming and to energy efficiency of consumer electronics). The United Kingdom was an early mover in better regulation, implementing a framework and setting targets, then reviewing and renewing the initiatives. In telecommunications both its ministry and its regulator conduct impact assessments. In the Republic of Ireland the government adopted a white paper on better regulation and guidelines for regulatory impact assessments. Such assessments have been widely adopted across government, including by its telecommunications regulator. The OECD has coordinated work on better regulation and impact assessment across its member states and also has activities with developing countries.

Book excerpt: Impact assessments, used to assess the need for and the likely impact of proposed government policy interventions, do not yet consistently provide a sound basis for assessing the relative merits of different policy proposals. Impact assessments are of a high standard, but wide variation remains between the best and worst. Eighteen per cent of the NAO's sample was assessed as 'red' because they may not provide sufficient evidence to convince the reader that the right conclusion has been reached. Over half had weaknesses with only 28 per cent fully meeting reasonable quality standards. The number of policy options considered has improved, but is still too limited, with almost half of the assessments considering only one option, or one option plus a "do nothing" option. In addition, Impact assessments for interventions originating from European Union decisions are often produced only after a decision has been made at European Union level. The use of quantification in analysis for impact assessments is improving, with 86 per cent of those reviewed by the NAO containing some quantification of the costs of their preferred option and 60 per cent containing some quantification of benefits. However, 10 per cent of the assessments had not quantified either the costs or the benefits. Departments have increased the resources that they allocate to preparing Impact Assessments and internal scrutiny has improved. Some impact assessments have altered the course of policy development, yet only half of policy staff felt that they were useful in the policy process.

Book excerpt: Regulatory Impact Assessments (RIAs) are designed to enable policy makers to assess the need for, and impact of, new regulations. In 2005 Government departments produced around 200 'Final' RIAs. They have been used to assess the likely economic, social and environmental impacts of the proposed regulation, and the range of options for implementing it. They have grown in scope in recent years as additional assessment criteria, such as sustainable development, have been added. Departments have primary responsibility for undertaking RIAs, and the Better Regulation Executive (BRE), which forms part of the Cabinet Office, has primary responsibility for taking forward the Government's Better Regulation agenda. The National Audit Office focused its examination on four departments - Culture, Media and Sport (DCMS); Trade and Industry; Home Office; and Transport (DfT). RIAs are often not used in the right way. The purpose of RIAs is not always understood; there is a lack of clarity in the presentation of the analysis; and persistent weaknesses in the assessments. RIAs are only occasionally used to challenge the need for regulation and influence policy decisions. If used well, RIAs can offer an effective tool for assessing different options and identifying regulatory solutions that do not impose unnecessary costs on those being regulated. There are three ways the BRE should bolster RIAs. Firstly, it should re-emphasise that economics should lie at the heart of RIAs, considering market failure, counterfactuals, competition, and how consumers and organisations behave. Secondly, RIAs need to be supplemented by a broader toolkit that policy makers can use earlier in the life of a policy. Thirdly, the BRE could re-emphasise the importance of the RIA process in challenging the introduction of new regulations.
