Book excerpt: Excerpt from The Bearing of Religious Equality on the Rights of Individuals and Spiritual Communities: A Lecture Delivered in the Memorial Hall, Manchester, January 14th, 1873 Do they regard us as bound in reason to stand by the premature judgments of the Nonconformists who have gone before us? Well, but how is it they do not call to mind the canon of their Master: With what measure ye mete, it shall be meted to you again? Why, the predecessors of our modern Establishmentarians are left quite as far behind by their successors as the old Puritans and Nonconformists are by Liberationists. They reviled, ejected, imprisoned, pilloried, and branded the very men whom their ecclesiastical descendants held up before us as bright exemplars'of Spiritual wisdom and virtue. We do not accept as oracular every thought expressed by our Nonconformist forefathers, especially on questions which had scarcely been pro pounded in their day. The subject of religious equality, like that of personal slavery, and that of war, has had more abundant light cast upon it since the generations which the glow of their spirituality adorned. But when we are taunted with our de generacy, on account of the more decided views we hold than theirs on the question of Church Establishment, might not they who taunt us do well to remember that they also have advanced beyond the position stiffly maintained by Establishmentarians of between two and three centuries back and that tp such of them as now plead the authority of Owen, Baxter, Watts, and Wesley in condemnation of the doctrine Of religious equality, and in disparagement of the spiritual character of those who profess it, there is danger lest they Incur the woful heritage of them who were charged with building the tombs of the prophets, and garnishing the sepulchres of the righteous, and thereby witnessing unto themselves that they are the children Of them which killed the prophets. Book excerpt: During the middle decades of the nineteenth century the English Nonconformist community developed a coherent political philosophy of its own, of which a central tenet was the principle of religious equality (in contrast to the stereotype of Evangelical Dissenters). The Dissenting community fought for the civil rights of Roman Catholics, non-Christians, and even atheists, on an issue of principle that had its flowering in the enthusiastic and undivided support that Nonconformity gave to the campaign for Jewish emancipation. This study examines the political efforts and ideas of English Nonconformists during the period, covering the whole range of national issues raised, from state education to the Crimean War. It offers a case study of a theologically conservative group defending religious pluralism in the civic sphere, showing the that concept of religious equality was a grand vision at the center of the political philosophy of the Dissenters.

Is enough effort made to accommodate those motivated by a religious conscience? All rights matter but at times the right to put religious beliefs into practice increasingly takes second place in the law of different countries to the pursuit of other social priorities. The right to freedom of belief and to manifest belief is written into all human rights charters. In the United States religious freedom is sometimes seen as 'the first freedom'. Yet increasingly in many jurisdictions in Europe and North America, religious freedom can all too easily be 'trumped' by other rights. Roger Trigg looks at the assumptions that lie behind the subordination of religious liberty to other social concerns, especially the pursuit of equality. He gives examples from different Western countries of a steady erosion of freedom of religion. The protection of freedom of worship is often seen as sufficient, and religious practices are separated from the beliefs which inspire them. So far from religion in general, and Christianity in particular, providing a foundation for our beliefs in human dignity and human rights, religion is all too often seen as threat and a source of conflict, to be controlled at all costs. The challenge is whether any freedom can preserved for long, if the basic human right to freedom of religious belief and practice is dismissed as of little account, with no attempt to provide any reasonable accommodation. Given the central role of religion in human life, unnecessary limitations on its expression are attacks on human freedom itself.

Proposals involving school prayer and the posting of the Ten Commandments in schools and courtrooms perennially spur controversy. But there is also a sense that the prevailing discourse is exhausted, that no one seems to know how to think about religious freedom in a way that moves beyond our stale, counterproductive thinking on this issue. In Getting over Equality, Steven D. Smith, one of the most important voices now writing about religious liberty, provocatively contends that we must get over our presumption mistakenly believed to be rooted in the Constitution that all religions are equally true and virtuous and "authentically American." Smith puts forth an alternative view, that the courts should promote an ideal of tolerance rather than equality and neutrality. Examining such controversial examples as the animal sacrifice case, the peyote case, and the problem of aid to parochial schools, Smith delineates a way for us to tolerate and respect contrary creeds without sacrificing or diluting our own beliefs and without pretending to believe in a spurious "equality" among the variety of diverse faiths.
