Available in PDF, EPUB and Kindle. Book excerpt: On the twelfth floor of an undistinguished-looking high-rise, a tribunal adjudicates the human rights of Indigenous individuals. Why isn’t the process working? Witness to the Human Rights Tribunals draws on testimony, ethnographic data, and years of tribunal decisions to show how specific cases are fought, and offers an in-depth look at anthropological expertise in the courts. Bruce Miller’s candid analysis reveals the double-edged nature of the tribunal, which both protects human rights and re-engages the trauma of discrimination that suffuses social and legal systems. He definitively concludes that any reform must recognize symbolic trauma before Indigenous claimants can receive appropriate justice.

Book excerpt: Any errors and the opinions contained in the paper are those of the authors, and do not necessarily reflect the views of the CCPA. [...] Overall, the availability and generosity of social supports and entitlements has eroded as the government weakens or eliminates key public services and increasingly emphasizes the necessity of individual self-reliance and participation in a de/re-regulated labour market as the only legitimate route to economic security. [...] In so doing, we consider not only policy changes that directly affect employment regulations and the availability of particular kinds of employment for women (such as the loss of public-sector jobs and changes to the provincial Employment Standards Act), but also changes that alter the conditions under which women access employment (such as changes in post-secondary education and childcare policie [...] Higher levels of education are also associated with both higher levels of employment, and a smaller gap in men and women's labour force participation rates, as documented in Table 3. Women in BC with fewer than eight years of education have only 57 per cent of the employment level of men with the same education, while those with an undergraduate degree are employed at 93 per cent of the level of t [...] As a result, the of hospital and long-term care beds, and funding cuts have eliminated number of low income housekeeping services from the home care services received by the children in the regulated disabled and frail elderly in some areas of the province.

Available in PDF, EPUB and Kindle. Book excerpt: Human rights complaints attract a great deal of public interest, but what is going on below the surface? When people contact a human rights lawyer, how do they think about and use human rights discourse? How are complaints turned into cases? Can administrative systems be both effective and fair? Defining Rights and Wrongs investigates the day-to-day practices of low-level officials and intermediaries as they construct domestic human rights complaints. It identifies the values that a human rights system should uphold if it is to promote mutual respect and foster the personal dignity and equal rights of citizens.

Book excerpt: Privatization is occurring throughout the public justice system, including courts, tribunals, and state-sanctioned private dispute resolution regimes. Driven by a widespread ethos of efficiency-based civil justice reform, privatization claims to decrease costs, increase speed, and improve access to the tools of justice. But it may also lead to procedural unfairness, power imbalances, and the breakdown of our systems of democratic governance. Civil Justice, Privatization, and Democracy demonstrates the urgent need to publicize, politicize, debate, and ultimately temper these moves towards privatized justice. Written by Trevor C.W. Farrow, a former litigation lawyer and current Chair of the Canadian Forum on Civil Justice, Civil Justice, Privatization, and Democracy does more than just bear witness to the privatization initiatives that define how we think about and resolve almost all non-criminal disputes. It articulates the costs and benefits of these privatizing initiatives, particularly their potential negative impacts on the way we regulate ourselves in modern democracies, and it makes recommendations for future civil justice practice and reform.

Available in PDF, EPUB and Kindle. Book excerpt: Historically Canadians have considered themselves to be more or less free of racial prejudice. Although this conception has been challenged in recent years, it has not been completely dispelled. In Colour-Coded, Constance Backhouse illustrates the tenacious hold that white supremacy had on our legal system in the first half of this century, and underscores the damaging legacy of inequality that continues today. Backhouse presents detailed narratives of six court cases, each giving evidence of blatant racism created and enforced through law. The cases focus on Aboriginal, Inuit, Chinese-Canadian, and African-Canadian individuals, taking us from the criminal prosecution of traditional Aboriginal dance to the trial of members of the 'Ku Klux Klan of Kanada.' From thousands of possibilities, Backhouse has selected studies that constitute central moments in the legal history of race in Canada. Her selection also considers a wide range of legal forums, including administrative rulings by municipal councils, criminal trials before police magistrates, and criminal and civil cases heard by the highest courts in the provinces and by the Supreme Court of Canada. The extensive and detailed documentation presented here leaves no doubt that the Canadian legal system played a dominant role in creating and preserving racial discrimination. A central message of this book is that racism is deeply embedded in Canadian history despite Canada's reputation as a raceless society. Available in PDF, EPUB and Kindle. Book excerpt: Although Canada is known internationally as a leader among industrialized countries for inclusive practices towards immigrants and refugees, the twenty-first century has witnessed a rise in the number of refugees and temporary migrant workers who are often denied citizenship and may also experience detention and deportation. Containing Diversity examines to what extent Canada’s long-standing support for immigration, multiculturalism, and citizenship has shifted in favour of discourses, policies, and practices that "contain" diversity. This book reflects on how diversity is being "contained" through practices designed to insulate the Canadian settler-colonial state. In assessing the Canadian government’s policies towards refugees and asylum seekers, economic migrants, family-class migrants, temporary foreign workers, and multiculturalism, the authors show the various contradictory practices in effect. Containing Diversity reflects on policy changes, analysed alongside the resurgence of right-wing political ideology and the realities of the COVID-19 pandemic. Ultimately, Containing Diversity highlights the need for a re-imagining of new forms of solidarity that centre migrant and Indigenous justice.
