Book excerpt: "When battered women kill their abusive partners they generally do so in self-defense. However, self-defense law never took women's experiences with domestic violence into account. It was not until 1990 that certain states began to allow expert testimony on Battered Woman Syndrome in self-defense trials. Because of this change in law, several states granted clemency to small numbers of incarcerated battered women (Gagné 1998). While the research on battered women who received clemency is minimal (Gagné 1998; Beattie and Shaunessy 2000), there has been no research on the women who applied for clemency and were denied. Using existing interview data with battered women who applied for clemency in 1990 as a starting point, this dissertation involved first time and follow up interviews with women who were part of the clemency applicant pool in 1990. Findings indicate that the women's lives prior to prison were filled with multiple types of abuse. The turning point to kill came when they felt their only choice was to kill or be killed and/or they feared for their children's lives. During their time in prison they became active in domestic violence support groups which enabled them to apply for clemency. The twelve women denied clemency still remain in prison serving life sentences and have become extremely active within the prison by starting different groups (i.e. yoga, choir, and fund-raising for charities). these women shifted their sense of self from victims to survivors and saw prison as a place of safety and freedom. However, this newfound sense of self conflicted with the structure of the prison and the women often felt they were repeatedly victimized. The six women granted clemency struggled with having a felony conviction and found it affected employment and housing options, as well as their own sense of self-worth. Those without family support were more susceptible to criminal activity after prison and were more likely to report problems with substance abuse. They struggled to reconnect with their children and saw improvement in their relationships over time. Lastly, they viewed themselves as survivors and talked about teaching others how to live violence free."--Iii-iv.

Celeste granted clemency to 25 women who had been incarcerated for killing or assaulting abusive partners or stepfathers. Governors in other states quickly followed. This book documents the history of the feminist and social activist groups working within the context of the battered women's movement and the role they playing in making these events possible. The book examines the Ohio movement as a precedent-setting case study, then discusses and analyzes events in six other states where large-scale clemencies were achieved or attempted. Before clemency became a movement goal, feminist legal activists worked for two decades to challenge laws that they argued prevented women from fully defending themselves when accused of killing abusive men. One focus was to ensure that the women who killed could describe the danger with which they had lived and explain the basis of their belief that force was needed to defend their lives. Despite these numbers, incarcerated women, and women lifers specifically, represent a relatively small percentage of the overall correctional and lifer populations. As such, women lifers are easy to overlook, discount, and diminish as such a small group. Many women lifers perceive themselves as a forgotten group; most often those whom we “lock up” and “throw away the key”. They feel excluded from prison programming within and from their own families outside. They feel stigmatized by staff and other women in prison. Aging fast, many have real fears about declining health and losing family members over lengthy stretches of time. However, women lifers are some of the most resilient and strongest women who survive life in prison with the support of each other and religious faith, often transforming themselves in the process of doing time. While most of the women had extensive histories of trauma, abuse, and mental health issues, few had prior experience as offenders. Despite the term “lifer”, many of these women will be released from prison after serving long sentences. Beyond this basic profile, there is much more to learn and share about the lives of women lifers. Focusing on women’s pathways into prison, the ways they cope with life behind bars, and their diverse reentry needs, Meredith Dye and Ronald Aday give voice to women lifers and place their experiences within the larger context of penal harm policies. The authors look at their physical and mental health, family connections, adjustment to prison, prison supports and activities, and experiences with abuse/trauma; while also looking at the growing public and policy concerns over mass incarceration in general. In this book, Elizabeth Dermody Leonard examines the lives and experiences of more than forty women in California who are serving lengthy prison sentences for killing their male abusers. She contrasts them with other women prisoners in the state and finds substantial differences. Leonard's in-depth interviews reveal that the women are slow to identify themselves as battered women and continue to minimize the violence done to them, make numerous and varied attempts to end abusive relationships, and are systematically failed by the systems they look to for help. While in jail, these women receive liberal dosages of psychotropic drugs, damaging their ability to aid in their self-defense. Moreover, trials and plea bargains feature little or no evidence of the severe intimate abuse inflicted upon them. Despite a clear lack of criminal or violent histories, the majority of women found guilty of the death of abusive men receive first- or second-degree murder convictions and serve long, harsh sentences. Leonard concludes the book with a discussion of policy implications and recommendations arising from this research.
