Cloth. $65. * Probably the first doctrine on the conflict of laws, this is a portion of Bartolus' commentary on Justinian's Code and its glosses, his Super Primam et Secundam Partem Codicis Commentaria. Copied often in manuscript, it appeared in print in 1471. It takes into account local customs and statutes, and contains what may be the first clear recognition of the principle that the lex loci governs the validity of a legal act. Bartolus also appreciated the distinction between laws effective only within the territory and laws that might have operation outside the territory, a distinction that assumed great importance in later continental writings on the subject. One of the great medieval commentators, Bartolus di Sassoferrato [1313-1357] was a professor of law at the University of Perugia. His authority as an expositor of Roman law was immense, and it endured for centuries. A practical lawyer, Bartolus attempted to derive principles suitable to his time from the accumulated layers of local, feudal and Roman law.

Regardless of the relative superiority of one to the others, the author is convinced, after seven years teaching experience, that no one of these methods alone is adequate to sound, thorough instruction in the law. In his presentation of this difficult subject in the class-room, he has produced satisfactory results only by a combination of text, cases, and lecture in proper proportion. The value of a text in stating the principles of the law in brief form can not be denied. The necessity of reading leading decisions that support and apply those principles is indisputable. And finally, there is the general discussion in class; the Instructor when necessary, expounding the subject, imparting the benefits of his knowledge and experience and observation, thereby arousing and sustaining interest in the work; these are the things that elevate instruction from the mechanical to the intellectual. In presenting this text therefore, the author makes no defense. He has embodied the fundamentals of the subject in the text in simple form. He has scrupulously selected the leading decisions and included them in the notes, where they are identified by large conspicuous citation. Finally, instead of merely stating the law, he has by clear simple language explained it, so as to reproduce, as far as possible, the full value of the class instruction. It is this very feature, it is believed, that will commend it for Law School purposes to Instructor and class alike. While hopeful of the success of this, his first literary effort, the author is nevertheless humanly conscious that errors will be found, and for these he assumes complete responsibility. The subject is one of great importance and interest; and from the increasing intercourse between foreign States, as well as between the different States of the American Union, it is daily brought home more and more to the ordinary business and pursuits of human life. The difficulty of treating such a subject in a manner suited to its importance and interest can scarcely be exaggerated. The materials are loose and scattered, and are to be gathered from many sources, not only uninviting, but absolutely repulsive, to the mere Student of the Common Law. There exists no treatise upon it in the English language; and not the slightest effort has been made, except by Mr. Chancellor Kent, to arrange in any general order even the more familiar maxims 0l the Common Law in regard to it. Until a com paratively recent period, neither the English Lawyers, nor the English Judges seem to have had their attention drawn towards it, as a great branch of international jurisprudence, which they were required to administer.
