It analyses the development and features of lordship as it was practised and experienced in Maine and the surrounding regions of France, emphasizing the social logic of lordship (why it worked as it did, and how it was socially justifiable and even necessary) and the role of honour and charisma in shaping lordship relationships. The vision and chronology of tenth- and eleventh-century lordship on offer here departs from the model of "feudal mutation", and emphasizes two major themes - the centrality of intangible, charismatic elements of honor, prestige and acclamation, and the lack of foundation for any notion of "feudal transformation": while acknowledging changes in the geography of power across the tenth and eleventh centuries, the argument insists that the practicalities of the practice of lordship remained essentially the same between 890 and 1160. Book excerpt: Lordship in France, 500-1500 presents a new interpretation of lordship in medieval France based on recent, ground-breaking research on the Merovingian, Carolingian and Capetian eras of lordship in medieval France. In the standard interpretation, lordship emerged around the year 1000, when landed magnates and armed adventurers usurped public authority from the collapsing Carolingian state. This book argues instead that lordship emerged roughly 500 hundred years earlier with the disintegration of the Roman Empire. Politically and socially, lordship expressed the collegial ruling authority of kings and aristocrats, not the usurped public authority of a failed centralized state. Institutionally, lordship was essentially a fiscal apparatus that perpetuated remnants of the late Roman tax system.

Book excerpt: The central argument of The Formation of the English Kingdom in the Tenth Century is that the English kingdom which existed at the time of the Norman Conquest was defined by the geographical parameters of a set of administrative reforms implemented in the mid- to late tenth century, and not by a vision of English unity going back to Alfred the Great (871-899). In the first half of the tenth century, successive members of the Cerdicing dynasty established a loose domination over the other great potentates in Britain. They were celebrated as kings of the whole island, but even in their Wessex heartlands they probably had few means to regulate routinely the conduct of the general populace. Detailed analysis of coins, shires, hundreds, and wapentakes suggests that it was only around the time of Edgar (957/9-975) that the Cerdicing kings developed the relatively standardised administrative apparatus of the so-called 'Anglo-Saxon state'. This substantially increased their ability to impinge upon the lives of ordinary people living between the Channel and the Tees, and served to mark that area off from the rest of the island. The resultant cleft undermined the idea of a pan-British realm, and demarcated the early English kingdom as a distinct and coherent political unit. In this volume, George Molyneaux places the formation of the English kingdom in a European perspective, and challenges the notion that its development was exceptional: the Cerdicings were only one of several ruling dynasties around the fringes of the former Carolingian Empire for which the late ninth, tenth, and eleventh centuries were a time of territorial expansion and consolidation.

Part 1 explores the law as it now stands in England and Wales as a result of cases such as Woolwich EBS v IRC, those resulting from the decision of the European Court of Justice (ECJ) in Metallgesellschaft and Hoechst v IRC and those involving Local Authority swaps transactions. So far these cases have been viewed from either a public or a private law perspective, whereas in fact both branches of the law are relevant, and the author argues that the courts ought not to lose sight of the public law issues when a claim is brought under the private law of unjust enrichment, or vice versa. In order to achieve this a hybrid approach is outlined which would allow the law access to both the public and private law aspects of such cases. Since there has been much discussion, particularly in the context of public body cases, of the relationship between the common law and civilian approaches to unjust enrichment, or enrichment without cause, Part 2 considers the French approach in order to ascertain what lessons it holds for England and Wales. And finally, as the Metallgesellschaft case itself makes clear, no understanding of such cases can be complete without an examination of the relevant EU law. Thus Part 3 investigates the principle of unjust enrichment in the European Union and the division of labour between the European and the domestic courts in the ECJ's so-called 'remedies jurisprudence'. In particular it examines the extent to which the two relevant issues, public law and unjust enrichment, are defined in EU law, and to what extent this remains a task for the domestic courts.
