Book Synopsis Security and Privacy by : John Kleinig
Download or read book Security and Privacy written by John Kleinig and published by ANU E Press. This book was released on 2011-12-01 with total page 304 pages. Available in PDF, EPUB and Kindle. Book excerpt: This study is principally concerned with the ethical dimensions of identity management technology - electronic surveillance, the mining of personal data, and profiling - in the context of transnational crime and global terrorism. The ethical challenge at the heart of this study is to establish an acceptable and sustainable equilibrium between two central moral values in contemporary liberal democracies, namely, security and privacy. Both values are essential to individual liberty, but they come into conflict in times when civil order is threatened, as has been the case from late in the twentieth century, with the advent of global terrorism and trans-national crime. We seek to articulate legally sustainable, politically possible, and technologically feasible, global ethical standards for identity management technology and policies in liberal democracies in the contemporary global security context. Although the standards in question are to be understood as global ethical standards potentially to be adopted not only by the United States, but also by the European Union, India, Australasia, and other contemporary liberal democratic states, we take as our primary focus the tensions that have arisen between the United States and the European Union.
Book Synopsis Advance Metadata Fair by : Stanley Shanapinda
Download or read book Advance Metadata Fair written by Stanley Shanapinda and published by Springer Nature. This book was released on 2020-08-30 with total page 231 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book outlines the legal powers of a major Western nation – Australia – to collect and use location information. Mobile service and social media service providers now have the ability to track, record and store more precise location information. Unlike 4G, 5G mobile communications require that cell towers and antennas be in much closer proximity; as a result, the location data can reveal more personal and sensitive information about individual citizens. Despite this aspect, service providers are required to disclose the data to the authorities, without the need for a judicial warrant. This book was written from the perspective of big location data software analytics, a capability that makes it possible to combine various location data points to create a profile on a given individual’s movements, habits, and political, religious and ideological orientation. In this regard, privacy is poorly protected. The rationale used to justify the powers was enforcing serious crimes – terrorism offences. Location data can now be retained for at least two years and be collected to investigate even minor offences. This can be done without the person being reasonably suspected of a criminal offence – when the individual is simply determined to be a person of interest. This poses legal risks to vulnerable communities. And yet, such investigative techniques are deemed lawful and reasonable. At a time when national security is so broadly defined to include economic issues, which in turn overlap with climate change and environmental protection, these legal powers should be reassessed. The book clarifies the complex rules that every citizen must know in order to have agency. Further, it calls upon authorities to reflect and to self-regulate, by making the conscious decision to surrender some of their powers to review by the independent judiciary. Without the requirement for a judicial warrant or judicial review, the powers are unfairly broad. The book pursues an interdisciplinary approach to assess the functionality of mobile telecommunications in direct relation to law enforcement powers and existing judicial precedents. Further, it offers a unifying techno-legal perspective on a complex issue touching on modern privacy law and communications technologies.

Book excerpt: Since the September 11, 2001, terrorist attacks, critics have charged that the Federal Bureau of Investigation, while qualified to investigate terrorist incidents after the fact, is not well equipped enough to adequately gather and assess information to prevent attacks. More intrinsically, many believe that given a predominant and deeply rooted law enforcement and prosecutorial culture, the bureau may not be able to change operational focus toward dedicated counterterrorism intelligence gathering and analysis. To better inform debate, researchers analyzed the domestic security structures of four allied countries--the United Kingdom, France, Canada, and Australia--weighing both their positive and negative aspects. This book was released on 2015 with total page 49 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Commonwealth has strong, well-coordinated counter-terrorism (CT) arrangements. Overall, these have been quite successful, although the Martin Place siege and the stabbing of police in Melbourne raise questions. Despite improvements in CT capability, a terrorist attack is possible. All of the terrorism-related metrics are worsening: known numbers of foreign fighters, sympathisers and supporters, serious investigations. We are not 'winning' on any front. Every dollar must be spent wisely. We face a new paradigm that demands ever more careful prioritisation. National security agencies must come together seamlessly around shared priorities. A restructure or reshuffle of national security agencies is not the answer. But more must be done to strengthen cross-agency coordination and leadership. Whatever we do, there is no short-term solution to our evolving terrorist challenge. It is almost inevitable that we will have more terrorist attacks on Australian soil. Long term, we must put a greater effort into reducing, rather than managing, the pool of terrorists, their supporters and sympathisers.

Book Synopsis A Question Of Trust by : David Anderson
Download or read book A Question Of Trust written by David Anderson and published by Lulu.com. This book was released on 2015-06-11 with total page 384 pages. Available in PDF, EPUB and Kindle. Book excerpt: [This convenience copy of the official report by the UK Independent Reviewer of Terrorism Legislation, made available under OGLv3 on a cost-only basis] Modern communications networks can be used by the unscrupulous for purposes ranging from cyber-attack, terrorism and espionage to fraud, kidnap and child sexual exploitation. A successful response to these threats depends on entrusting public bodies with the powers they need to identify and follow suspects in a borderless online world. But trust requires verification. Each intrusive power must be shown to be necessary, clearly spelled out in law, limited in accordance with international human rights standards and subject to demanding and visible safeguards. The current law is fragmented, obscure, under constant challenge and variable in the protections that it affords the innocent. It is time for a clean slate. This Report aims to help Parliament achieve a world-class framework for the regulation of these strong and vital powers.
Book Synopsis Access to Communications Data by the Intelligence and Security Agencies by : Great Britain. Intelligence and Security Committee
Download or read book Access to Communications Data by the Intelligence and Security Agencies written by Great Britain. Intelligence and Security Committee and published by The Stationery Office. This book was released on 2013-02-05 with total page 32 pages. Available in PDF, EPUB and Kindle. Book excerpt: In June 2012, the Government published its Communications Data draft Bill (ISBN 9780101835923). The Bill is intended to ensure that the police and other public bodies continue to be able to access communications data. The Committee believes, in respect of communications data, that there is a serious problem that requires action. That intelligence and security Agencies require access to communications data in certain tightly controlled circumstances and with appropriate authorisation, in the interests of national security. With changing technologies, such Agencies are unable to access all the communications data they need and the Committee believes that updating the current arrangements governing retention of communications data offers the most appropriate way forward. For the draft Bill, more thought needs to be given to the level of detail, in particular in relation to the Order-making power, but Parliament and the public will require more information to be convinced. Further, in respect of the draft Bill, there seems to have been insufficient consultation with the Communication Service Providers on practical implementation, as well as a lack of coherent communication about the way in which communications data is used and the safeguards that will be in place.
