Book excerpt: A proposed ordinance which would preclude the governing body from using certain property for any use except use as a burial ground is administrative in nature and, therefore, cannot be the subject of initiative. Furthermore, if the land has been set aside for use as a cemetery or burial ground but has not yet been used for the interment of human bodies, K.S.A. 12-1441 cannot be applied to prevent the governing body from using the property for a use other than as a burial ground or a cemetery. We express no opinion as to whether the bond issue or other legal provisions may preclude use of the property for other than cemetery purpose. Book excerpt: "Forthwith" as used in K.S.A. 38-1672(a) is not susceptible to a fixed term definition and is dependent upon the circumstances. There is no time period within which SRS must act between the time a juvenile offender is placed in the custody of a state youth center and the time a juvenile is actually admitted to the youth center. If the court commits a juvenile offender to a state youth center the county is responsible for the expenses for the care and custody of the juvenile until the juvenile is delivered to the youth center. Placing a juvenile offender in the custody of both the secretary of SRS and a youth residential facility is not an "appropriate" combination of dispositions under K.S.A. 38-1663(a)(5). The juvenile offender code does not address the length of time between the point at which a juvenile offender is placed in the custody of SRS and the time SRS decides where the juvenile will be placed. A juvenile, under house arrest, who cuts his or her electronic monitoring equipment and absconds may be charged with escape from custody. Book excerpt: A public official may not deny access to a public record unless the disclosure is prohibited by federal or state law or the record fits one of the exceptions listed in K.S.A. 45-221. Public land records are public records which do not fit any of these exceptions, and are therefore open for inspection. A custodian who relies in good faith on a certification by a requestor that the information obtained from public records will not be used in a prohibited manner is not subject to criminal charges under K.S.A. 21-3914. Therefore, a public official may not deny a requestor access to records, which are otherwise open, when the appropriate certification is submitted pursuant to K.S.A. 45-220, and the official is acting in good faith.
