Persons who are citizens of a country other than the United States are deemed to be residents of the country in which which they hold citizenship. Those persons are not to be enumerated in the Kansas census unless they obtain United States citizenship as well as establish legal residence in this state prior to the time of enumeration. The resulting distinction between citizens and non-citizens does not impermissibly dilute the power of an individual's vote, and does not therefor deny equal protection. While a full evidentiary hearing is not available to the licensee until after the suspension becomes effective, the degree of deprivation (in view of the opportunity for a hearing within 30 days and the availability of a restricted license in hardship cases) and any risk of erroneous deprivation are outweighed by the government's interest in highway safety. Book excerpt: Budgetary laws, K.S.A. 79-2925 e̲t̲ s̲e̲q̲., and cash-basis laws, K.S.A. 10-1101 e̲t̲ s̲e̲q̲., prevent diverting any budgeted fund to the use of another fund and the creation of any unbudgeted indebtedness against the county except as specifically allowed. In furtherance of the proposed improvements to the airport runway, Rawlins County may use moneys budgeted in the airport fund, moneys contained in any existing revolving account established to operate the airport and moneys from the general fund not previously allocated for other uses. In order to relocate the county landfill the county may expend moneys from the budgeted landfill and general funds. Use of general fund moneys is limited to those uses which serve a valid public purpose and actions by the board are subject to continuing fudiciary duties. If expenditures exceed amounts budgeted for in the specific and general funds, the county may attempt to amend the budget and issue no-fund warrants or issue bonds. Ed. 2d 797 (1979) (plurality opinion) the United States Supreme Court held that the United States Constitution would permit a state to require a pregnant minor to obtain parental consent to an abortion if the state provided an alternative procedure whereby the minor could establish that she was mature enough to make the decision on her own or that it would be in her best interests to have the abortion. Since 1988 House Bill No. 2950 establishes such an alternative procedure, it is our opinion that its parental consent requirements would pass constitutional muster.
