Book excerpt: The initial determination, by a city, to adopt one of two alternative flood control projects, is legislative in nature, and is a proper subject of an initiative petition under the provisions of K.S.A. 1980 Supp. 12-3013, as amended by Section 31 of Chapter 173 of the 1981 Session Laws of Kansas. However, a proposed ordinance, which is submitted to a city governing body under the initiative and referendum statute, may not include provisions which are administrative in nature, or provisions which conflict with applicable state statutes. Where a proposed ordinance contains such provisions, it is not subject to the initiative and referendum process. Book excerpt: An audit of a third class city, for which an audit is not otherwise required by K.S.A. 1980 Supp. 75-1122, may be accomplished only by action of the city's governing body, as provided in K.S.A. 75-1125, although such action may be compelled by a petition of the city's electors filed with the governing body. K.S.A. 75-1125 requires any such petition to be signed by a number of currently qualified electors equal to 20% or more of the number of electors who voted in the last municipal election for officers, and does not require the petition to be signed by 20% or more of the same persons who actually voted in said election. The contents of the petition must conform to the requirements of K.S.A. 1980 Supp. 25-3602. Although a county attorney has no duty to assist in the preparation of such petition, he or she may assist in the preparation of the petition as part of his or her private practice, absent a professional conflict of interests. An action in mandamus may be brought to compel the governing body to act in accordance with the petition if necessary. Book excerpt: L. 1981, Ch. 156 section 2(g) does not require that an inmate convicted of a class A, B or C felony by reason of aiding, Abetting, advising or counseling another to commit a crime, or by reason of the principle provided for in subsection (2) of K.S.A. 21-3205, serve one-half of the minimum term of imprisonment imposed by the court. Rather, the law requires that the inmate serve one-half of the term of imprisonment which would be required had not the aiding, abetting, etc. come into play. Thus, on a class A felony conviction, parole eligibility would occur after seven and one-half years of confinement and on a class B or C felony conviction, parole eligibility would occur after service of one-half of the minimum sentence imposed less good time credits available.
