Book excerpt: The provisions of K.S.A. 1980 Supp. 13-1806 require that a vacancy occurring in the office of city commissioner be filled by the remaining commissioners selecting a successor to serve until the next city general election. Even though said statute is silent as to the election procedure to be followed where such vacancy occurs during a term of office that otherwise would not have expired at such election, the apparent underlying legislative intent is that, at said election, the qualified electors of the city elect a successor to fill the balance of the unexpired term. The election to fill such unexpired term must be separate and distinct from the election of persons to fill the regular four-year and two-year terms of office, as provided in K.S.A. 12-1004. Thus, persons filing for the office of city commissioner must declare their candidacy for either the position having an unexpired term of office or for a position having a full term of office, and the number of candidates for each such election will determine the necessity of holding a primary election in accordance with K.S.A. 1980 Supp. 25-2108a. In the event that the person elected to fill the remainder of the unexpired term is someone other than the person previously selected to fill the vacancy until the city general election, the latter person holds over in office until the person so elected is qualified to commence upon the duties of the office. Two such restrictions apear at K.S.A. 16-601 (8) and (9) (as amended by L. 1981, ch. 90, section 1). The former proscribes loans from investment companies in excess of a specified percentage of the unimpaired capital of the company, except where the loan is to a majority-owned affiliate or subsidiary Kansas corporation of the company or of its parent corporation. An affiliate of the company's parent which was not a Kansas corporation would accordingly not be a proper recipient of such a loan. Furthermore, such a transaction would not come under the exception for the purchase of commercial paper contained in K.S.A. 16-601(8), nor is it an investment which is "inherent" to the business of the investment company as required by K.S.A. 16-601(9). Book excerpt: Under the provisions of K.S.A. 1980 Supp. 22-4504 (as amended by L. 1981, ch. 157, sec. 1), the board of supervisors of panels to aid indigent defendants is empowered to adopt rules and regulations concerning the ability of a defendant in a criminal action to retain counsel to assist in his defense. Such rules and regulations specifically relate to the income, assets and anticipated costs of representation of a defendant. Pursuant to the 1981 amendment, such rules and regulations are controlling on any determination by a judge or magistrate as to whether a defendant is financially unable to employ counsel. Moreover, these rules and regulations are adopted in accordance with K.S.A. 77-415 e̲t̲ s̲e̲q̲., thus allowing the legislature to modify or reject them through the adoption of a concurrent resolution (K.S.A. 1980 Supp. 77-426). Insofar as the making of indigency determinations involves the resolution of questions of fact, which is a judicial and not a legislative function, control by the legislature over such determinations is an impermissible interference with the authority of another department of government. Accordingly, those provisions of L. 1981, ch. 157 which require the submission of such rules and regulations to the legislature and which make any rules and regulations so adopted binding on district courts are unconstitutional as violative of the separation of powers doctrine.
