This book was released on with total page 125 pages. Available in PDF, EPUB and Kindle. Book excerpt: Illegal, unreported and unregulated (IUU) fishing is a recognised global problem that undermines the integrity of responsible fisheries management arrangements and results in lost value to coastal states. The first attempt at quantifying the value and volume of IUU fishing in tuna fisheries within the Pacific Islands region was undertaken in 2016 using data from 2010-2015 (MRAG Asia Pacific, 2016). That study estimated the total volume of product either harvested or transhipped involving IUU activity in Pacific tuna fisheries was 306,440t, with an ex-vessel value of $616.11m. Nevertheless, the authors noted that the data and information underlying many of the estimates were highly uncertain and that the outputs should be seen as a ‘first cut’. In order to assess changes in the nature and extent of IUU fishing since that time, this study was commissioned as part of the Global Environment Facility-funded Pacific Islands Oceanic Fisheries Management Project II (OFMP II) to undertake a ‘2020 update’ of the original estimates. Broadly, the aim was to undertake an ‘apples vs apples’ update of the original estimates, using a consistent methodology and taking into account the latest available information. The study period covered the years 2017-2019. Importantly, this preceded any COVID-19 related impacts on monitoring, control and surveillance (MCS) and IUU activity in the region. Broadly, we used a ‘bottom up’ approach to quantify IUU fishing activity across key IUU risks in four categories: (i) unlicensed/unauthorised fishing, (ii) misreporting, (iii) non-compliance with other license conditions (e.g. shark finning) and (iv) postharvest risks (e.g. illegal transhipping). ‘Best estimate’ and minimum/maximum range values were generated for each risk, taking into account the best available information. Monte Carlo simulation was then used to produce probabilistic estimates of IUU activity, taking into account probability distributions assigned within the minimum and maximum range values. Using this approach, estimates of IUU volume and value were developed for each of the three main fishing sectors – purse seine (PS), tropical longline (TLL) and southern longline (SLL) – and then aggregated to produce an overall estimate for Pacific Islands region tuna fisheries. The report sets out the outcomes from the analysis, as well as the main messages arising. The report also identifies priorities for future MCS development in the region across both purse seine and longline fisheries.

Book excerpt: The Food and Agriculture Organization of the United Nations (FAO) can play an important role in encouraging consistent and sound practices for estimating illegal, unreported and unregulated (IUU) fishing activities around the world. This first volume in a series of guidance documents on this topic outlines guiding principles and approaches applicable to a broad range of IUU fishing estimation scenarios. It begins by defining which components of IUU fishing to estimate depending on the specific objectives of the exercise. It then helps to set boundaries for the estimation exercise based on the fishery, species, area and timeframe of interest. Top-down and bottom-up methodological approaches are introduced, with examples, as ways of partitioning an overall IUU fishing amount into component activities, or compiling estimates of IUU fishing at a granular scale to form an overall composite figure, respectively. Ideas for presenting results to maximize the uptake by stakeholders and decision-makers are also presented.

Book excerpt: The IOPA-IUU is a voluntary instrument that applies to all States and entities and to all fishers. Following the IPOA's introduction, the nature and scope of IUU fishing is addressed. This is followed by the IPOA's objective and principles and the implementation of measures to prevent, deter and eliminate IUU fishing. These measures focus on all State responsibilities, flag State responsibilities, coastal State measures, port State measures, internationally agreed market-related measures, research and regional fisheries management organizations. Special requirements of developing countries are then considered, followed by reporting requirements and the role of FAO.

Book excerpt: This book analyses the nearly 30 years of India–ASEAN relations from a contemporary perspective, identifies the reasons for India’s vibrant and significant relation with ASEAN and examines the cultural, economic, political and strategic linkages between India and ASEAN. The book projects the future of India–ASEAN relations in the face of the changing Indo-Pacific geopolitics and explores potential policies which could enhance the connection between India and Southeast Asian countries. Arguing that ASEAN is of primary importance to India, the book suggests that any successful outing in the Indo-Pacific would need a strong partnership with India. The book demonstrates how external powers influence ASEAN, with many of them supporting the centrality of ASEAN and its regional architecture in the broader Indo-Pacific. Chapters by experts in their fields present thematically specific analyses of political, defence, maritime and cultural aspects as well as the position of Northeast India in the India–ASEAN relations and assess the success and challenges of India’s ties with ASEAN in the context of the Look East and the Act East Policies. A reassessment of ASEAN–India relations past and present, this book will be of interest to academics and policy makers working in the field of International Relations, Asian Politics and South Asian Politics, in particular India’s Foreign Policy and Southeast Asian Politics.

Available in PDF, EPUB and Kindle. Book excerpt: This book examines the global, local, and specific environmental factors that facilitate illegal fishing and proposes effective ways to reduce the opportunities and incentives that threaten the existence of the world's fish. Humans are deeply dependent on fishing—globally, fish comprise 15 percent of the protein intake for approximately 3 billion people, and 8 percent of the global population depends on the fishing industry as their livelihood. The global fishing industry is plagued by illegal fishing, however, and many highly commercial species, such as cod, tuna, orange roughy, and swordfish, are extremely vulnerable. Through criminological analysis, The Last Fish Swimming emphasizes the importance of looking at specific environmental factors that make illegal fishing possible. It examines such factors as proximity to known ports where illegally caught fish can be landed without inspection (i.e., ports of convenience), fisheries monitoring, control and surveillance efforts, formal surveillance, and resource attractiveness in 53 countries that altogether represent 96 percent of the world's fish catch. The book calls upon the global community to address the illegal depletion of the world's fish stock and other similar threats to the world's food supply and natural environment in order to ensure the sustainability of the planet's fish and continuation of the legal fishing industry for generations to come.

Available in PDF, EPUB and Kindle. Book excerpt: The proposed book draws on the on-going South China Sea dispute, and the multifaceted challenges wrought by the South China Sea issue that requires an inter-disciplinary perspective. It employs legal-analytical methods, to emphasize the nuances of the role and interpretation of international law and treaties by China in different periods, while taking into account policy and strategic concerns, which generally cast great sways in decision-making. The re-introduction of interdisciplinary concerns straddling law and history illustrates that the historical dimension, which has long been neglected, is an emerging concern that poses looming dangers that may unexpectedly radicalize the friction. Contributing to debunking the mystique wrought by confrontations between a historical and a law-dominated perspective, these perspectives are supported by a more nuanced analytical framework, featuring theoretical concerns with a tinge of practicality. The South China Sea Dispute aims to unveil a nuanced evolution of the issue with a confluence of inter-temporal law, policy and maritime practices in the South China Sea.

This book was released on 2021-03-31 with total page 149 pages. Available in PDF, EPUB and Kindle. Book excerpt: Illegal, unreported and unregulated (IUU) fishing constitutes a persistent and pressing problem estimated to account for up to US$23 billion annually in the APFIC area. The effects of IUU fishing can be severe, particularly for small-island and coastal developing states heavily dependent on fisheries, and include adverse impacts on peoples’ livelihoods, food security, national economies and the environment. Countries unable to fulfil international obligations for fisheries management and governance risk incurring trade sanctions on their fisheries exports, an increasing issue as export markets tighten their permitting. Furthermore, IUU fishing is increasingly associated with national and transnational organised criminal activities, although the evidence remains mixed. FAO commissioned this report two years ago to produce an independent update to an unpublished 2015 study on IUU fishing in the APFIC area of competence, which was presented to the APFIC as an information paper in 2016 (FAO 2016a). The 2015 study used a mixture of media reports, literature review, and interviews to build a picture of hotspots of illegal fishing across the APFIC area of competence. This report builds on the previous work, incorporating additional analysis methods to predict illegal fishing in a transparent manner. Based on discussions with the APFIC Secretariat, it was decided to limit the study to the illegal component of IUU fishing. A key difference with the 2015 study is the extension of the estimation of illegal fishing from the 33 hotspots covered in the 2015 study to the entire APFIC area of competence in this study. This report provides the following key outputs: (i) development and implementation of an agreed methodology for estimating illegal fishing levels and progress; (ii) information from case studies in three Asia-Pacific countries; and (iii) analysis of results from the agreed method estimating the incidence of illegal fishing and implication of efforts to reduce it. The approach taken to achieve these goals included a structured online survey of fisheries officials in APFIC countries, semi-structured interviews of key informants knowledgeable about illegal fishing in the APFIC region, and analysis of articles on illegal fishing from public media data across the APFIC area of competence.

Available in PDF, EPUB and Kindle. Book excerpt: This comprehensive analysis of garbage trafficking, wildlife trafficking, illegal fishing, and illegal logging highlights the difficulty in balancing human interests and environmental responsibility. The alarming consequences of eco-crime go far beyond the widespread degradation of the natural world; important societal institutions are undermined and negative social and economic impacts also result from garbage trafficking, wildlife trafficking, illegal fishing, and illegal logging. In order to successfully combat these problems, a consistent, international response will be necessary. Crimes Against Nature: Illegal Industries and the Global Environment addresses an important topic that is largely unknown and rarely documented other than in reports published by environmental NGOs and a limited number of academic articles and journalistic accounts. A comprehensive and up-to-date description of each illicit industry is provided, emphasizing the damages caused, the transnational nature of these activities, the roles played by organized crime and public and private elites, and the range of possible solutions. The author addresses the complexity of balancing human concerns with environmental interests and concludes with information regarding promising recent developments.

Book excerpt: Huge quantities of natural resources are illegally harvested and their proceeds laundered in the Asia-Pacific region, fostering corruption and undermining environmental governance. Most illegal exploitation and pollution occurs in countries with poor governance capacities, but much of the sale for profit and money laundering occurs in mature markets with well-developed governance capacities. Their asymmetrical enforcement capacities can complement each other. This book explores ways to combat illegal fishing and logging in Asia-Pacific region by the use of cooperative legal measures, particularly anti-money laundering and confiscation of proceeds techniques. Contributors to this volume cover themes including: the nature of transnational environmental crime; patterns in laundering of illicit fish and forest products; networks for distribution of illicit products; weaknesses in current systems for assurance of the legality of products; and international legal cooperation to enforce anti-money laundering laws in relation to illicit products. In considering these topics the book explores how the innovative use of anti-money laundering measures and the seizure of criminal proceeds can as policy options to combat transnational fishery and forestry crimes. The book will be of keen interest to scholars and students of environmental law and criminal law, and excellent use for practitioners in natural resources conservation law.

Book excerpt: Although the flare-up of tensions in East Asia over the disputed islands, which are alternatively called Diaoyu (China), Diaoyutai (Taiwan) and Senkaku (Japan), seems to be ever more frequent, it has not always been the case. Lessons from the Disturbed Waters traces the origin of the issue back to when it first surfaced in the 1970s. The book explains the positions of the claimants, China, Japan and Taiwan, and explores the reasons why they have taken such positions over the past few decades. Unlike the other books which analyse the disputes predominantly from a geopolitical perspective, this books tries to do so mainly from the perspectives of international law, conflict management, negotiation strategies, and history. Readers will get to see an interesting dynamism played out among the three actors which are directly involved and the influence of extra-regional stakeholders such as the US over the disputes. While the disputes are still evolving, the author hopes this book can shed new light on the intricacies and complexities of the disputes and can provide some threads for further in-depth discussions.
