In the last few decades, the importance of consultation has been elevated by two main trends: the decline in trade union membership and the retreat from collective bargaining in the private sector on the one hand, with the result that consultation may be the only form of collective employee voice available; and the programme of legislative support for consultation by the European Union since the 1970s on the other. The book charts the meaning and development of consultation in the twentieth century and explores the justifications for the practice. It shows how EU intervention to promote consultation evolved and changed, paying particular attention to the adoption of the Information and Consultation of Employees (ICE) Regulations, which became fully operational in enterprises with 50 or more employees in 2008. Analysing the half-hearted response to EU consultation initiatives by the social partners in Britain, it provides a critical assessment of successive UK governments' handling of the issue. Drawing on the authors' empirical research in twenty-five organizations, the book closely examines the take-up and impact of consultation regulations, and explores the processes involved in effective consultation. Consultation at Work looks at the dynamics of consultation and draws a contrast between 'active' consultation of the type envisaged by the EU, and more limited consultation used as a means of communication. Discussing the UK experience in comparative perspectives, it asks what has to happen for the take-up of consultation to improve and suggests the changes that should be made to the EU Directive and UK ICE Regulations.

Book excerpt: This working paper explores the transposing of the EU Information and Consultation of Employees (ICE) Directive in the Liberal Market Economies of the Republic of Ireland (ROI) and Northern Ireland (NI) by considering how employers and employees have responded to national information and consultation regulations. We outline the analytical concept of 'regulatory space' and assess the impact of ICE Regulations in both ROI and NI jurisdictions in 4 cross-border case study organizations. The research concludes that an analytical framework to advance the concept of 'regulatory space' enables a refined assessment of employer and employee responses to employee voice regulation. Employer occupancy of regulatory space for voice is explained in part by a reassessment of the regulatory function of the State, from one of employee to employer protection. The UK and Irish governments both closely circumscribed the parameters of the national ICE Regulations to limit encroachment on the terrain of managerial prerogative. Ambivalence of national unions towards contesting the space opened by the ICE Directive also aids employers in occupying space for voice. The case evidence suggests that, consequently, employers largely dominate regulatory trajectories for workplace voice, and patterns of regulatory space for voice varied across workplaces. Though employees and their representatives were marginalized for the most part, voice remains a contested terrain.

Assessed against the regulations' default provisions that require I&C concerning strategic business issues and major organizational change, a substantial minority of participating organizations were categorized as 'active consulters', while a majority were 'communicators'. The differing trajectories of I&C primarily reflected internal organizational dynamics, particularly management's approach to consultation. Beyond providing the catalyst for managerial moves to introduce I&C, the influence of the statutory framework proved largely peripheral.

Book excerpt: The thesis focuses on the impact of the EU Directive (2002/14/EC), which was incorporated into UK employment law, with its phased implementation starting on 6th April 2005. The empirical evidence is based on a survey and predominantly on case-study research that involved interviews with: managers, employees and trade union representatives, together with the collection of relevant documentary evidence. The empirical findings, especially for the non-unionised sector, indicate that the reflexive nature of the Information and Consultation of Employees (ICE) Regulations has mainly stimulated the development of organisation-specific or tailor-made information and consultation arrangements, which minimally comply with the legislative provisions. Moreover, the development of such arrangements is primarily based on the ad hoc momentum that is generated by business pressures (i.e. collective redundancies, transfer of undertakings etc) and can be viewed as reflecting the conceptual framework of legislatively prompted voluntarism. The ICE Directive is aimed at bringing a consistency to the establishment of basic and standard information and consultation arrangements across the workplaces in Great Britain. Subsequently, it should promote the harmonisation of employee participation practices amongst the UK and other EU countries, as it has the goal of ensuring that there is a minimum floor of rights in relation to information sharing and consultation with employees. Nevertheless, the Europeanisation of British industrial relations cannot instantly take place through the adoption of such EU directives. With regard to this research endeavour, it emerges that the extant national idiosyncrasies cannot be substantially altered, whilst business pressures and employers? goodwill continue to be key drivers in the development of employee participation and consultation arrangements in Great Britain, albeit within the newly adopted legislative and statutory framework.
