L’ère de lutte pour la survie dans laquelle l’arbitrage a dû affirmer sa légitimité et sa nécessité face au monde judiciaire et aux pouvoirs publics, a priori peu favorables à l’expansion d’une justice privée, tout en cherchant à s’évader du cadre jugé trop étroit des ordres juridiques étatiques, est désormais révolue en s’universalisant, l’arbitrage s’est banalisé, affadi, voire même altéré en s’éloignant de ses origines ; devenu un rouage clé des institutions de la société marchande, il connaît aujourd’hui d’inquiétantes dérives : judiciarisation, bureaucratisation, relativisation de l’éthique et course à un véritable « march頻 de l’arbitrage. Ces réflexions s’efforcent de mettre en lumière ces tendances en restituant à l’arbitrage ses dimensions philosophique et théorique, trop souvent occultées.
