Forme d'accord historiquement prédominante, le contrat de concession était naturellement régi par le droit de l'État d'accueil. Cette tradition est peu à peu abandonnée par la doctrine et par les juridictions arbitrales au profit d'une internationalisation des contrats pétroliers, avec le risque de négliger le nécessaire équilibre qui doit exister entre le respect de la souveraineté de l'Etat et la protection des intérêts de l'investisseur privé. Cette thèse dans une approche comparée s'attachera à déterminer la loi applicable aux contrats pétroliers et les différents régimes susceptibles d'encadrer le contentieux nés de ce contrat.
