Marshall, that "American military officers, of whatever service, should share common ground ethically and morally." In this new edition, the authors methodically explore that common ground, reflecting on the basics of the Profession of Arms, and the officer's special place and distinctive obligations within that profession and especially to the Constitution.

Book excerpt: This book explores the human rights consequences of the new mercenarism, as channeled through so-called private military and security companies (PMSCs), and offers an overview of the evolution and status quo of both non-legal (soft law and self-regulation) and legal initiatives seeking to limit them. It addresses various topics, including the impact of the presence of non-state actors on human security using the cases of Afghanistan and Syria; research on PMSCs’ impact on human rights in specific cases; the insufficiency and ineffectiveness of existing direct and indirect legal prohibitions on the use of mercenaries; various aspects of international human rights law and international humanitarian law related to the conduct of PMSCs; soft-law and self-regulation mechanisms; and the international minimum standard in general international law regarding the privatization, export, import, and contracting of PMSCs.

Available in PDF, EPUB and Kindle. Book excerpt: This edition of the U. S. Army War College Guide to National Security Policy and Strategy continues to reflect the structure and approach of the core national security strategy and policy curriculum at the War College. The fifth edition is published in two volumes that correspond roughly to the Department of National Security and Strategy's core courses: "Theory of War and Strategy" and "National Security Policy and Strategy." Like previous editions, this one is based on its predecessor but contains both updates and new scholarship. Over a third of the chapters are new or have undergone significant rewrites. Many chapters, some of which appeared for years in this work, have been removed. Nevertheless, the book remains unchanged in intent and purpose. Although this is not primarily a textbook, it does reflect both the method and manner we use to teach strategy formulation to America's future senior leaders. Both volumes are organized to proceed from the general to the specific. Thus, the first volume opens with general thoughts on the nature and theory of war and strategy, proceeds to look at the complex aspect of power, and concludes with specific theoretical issues. Similarly, the second volume begins by examining the policy/strategy process, moves to a look at the strategic environment, and concludes with some specific issues. This edition continues the effort begun in the fourth edition to include several short case studies to illustrate the primary material in the volume. Part I: The National System and Environment * 1. American Values, Interests, and Purpose: Perspectives on the Roots of American Political and Strategic Culture * 2. Crafting National Interests in the 21st Century * 3. The National Security Community, Revisited * 4. Making National Security Policy in the 21st Century * 5. National Security Powers: Are the Checks in Balance? * 6. National Military Strategies: A Historical Perspective, 1990 to 2012 * 7. Present at the Counterrevolution: An Essay on the 2005 National Defense Strategy and its Impact on Policy * 8. Securing America From Attack: The Defense Department's Evolving Role After 9/11 * Part II: The International System and Environment * 9. International Order * 10. The International System in the 21st Century * 11. International Relations Theory and American Grand Strategy * 12. Multilateralism and Unilateralism * 13. The Democratic Peace * 14. Available in PDF, EPUB and Kindle. Book excerpt: It is widely assumed, at least from a Western perspective, that the armed forces provide national defence against external threats. In reality, within many consolidated Western democracies the armed forces are assuming an increasingly wide range of internal roles and tasks. These can include domestic security roles and the provision of humanitarian assistance in situations of natural or humanitarian catastrophe, often under the command and control of different civilian agencies. This SSR Paper seeks to make sense of this complex reality. Different internal roles of armed forces are analysed, drawing on the cases of Austria, Belgium, Canada, Denmark, Finland, France, Germany, Italy, Luxembourg, Netherlands, Norway, Spain, Sweden, the United Kingdom and the United States of America. Through carefully examining evolving internal roles and identifying patterns and lessons from these experiences, this SSR Paper provides an important contribution to understanding the evolving nature of contemporary armed forces.

Available in PDF, EPUB and Kindle. Book excerpt: The United States faces the realistic and indefinite threat of terrorist attack with nuclear weapons. Whether the United States is successful in preventing such an attack will depend on whether we effectively wield the instruments of security. It will also depend on whether we effectively manage national security processes and apply the law in a manner that both enhances security and upholds our core values. As a result, lawyers, not just presidents, generals, and spies, will decide the outcome of this conflict. This book, first published in 2007, is essential for anyone wanting an understanding of national security law and process. The book includes chapters on constitutional law, the use of force, and homeland security, presented in the context of today's threats and as applied to issues like rendition and electronic surveillance.

National Security Law and the Constitution provides a comprehensive examination and analysis of the inherent tension between the Constitution and select national security policies, and it explores the multiple dimensions of that conflict. Specifically, the Second Edition comprehensively explores the constitutional foundation for the development of national security policy and the exercise of a wide array of national security powers. Each chapter focuses on critically important precedents, offering targeted questions following each case to assist students in identifying key concepts to draw from the primary sources. Offering students a comprehensive yet focused treatment of key national security law concepts, National Security Law and the Constitution is well suited for a course that is as much an advanced “as applied” constitutional law course as it is a national security law or international relations course. New to the Second Edition: New author Gary Corn is the program director for the Tech, Law and Security Program at American University Washington College of Law, and most recently served as the Staff Judge Advocate to U.S. Cyber Command, the capstone to a distinguished career spanning over twenty-seven years as a military lawyer Two new chapters: Chapter 1 (An Introduction to the “National Security” Constitution), and Chapter 17 (National Security in the Digital Age) Professors and students will benefit from: An organizational structure tailored to present these national powers as a coherent “big picture,” with the aim of understanding their interrelationship with each other, and the legal principles they share A comprehensive treatment of the relationship between constitutional, statutory, and international law, and the creation and implementation of policies to regulate the primary tools in the government’s national security arsenal Targeted case introductions and follow-on questions, enabling students to maximize understanding of the text Text boxes illustrating key principles with historical events, and highlight important issues, rules, and principles closely related to the primary sources Chapters that focus on primary or key authorities with limited diversion into secondary sources A text structure generally aligned to fit a three-hour, one-semester course offering

Available in PDF, EPUB and Kindle. Book excerpt: U.S. Government departments and agencies contributing to combat or stability operations overseas are relying on private firms to perform a wider scope of security services than was previously the case. The use of private security contractors (PSCs) to protect personnel and property in Iraq and Afghanistan has been a subject of debate in the press, in Congress, and in the international community. While PSCs are widely viewed as being vital to U.S. efforts in the region, many Members are concerned about transparency, accountability, and legal and symbolic issues raised by the use of armed civilians to perform security tasks formerly performed by military personnel, as well as the adverse impact PSCs may be having on U.S. counterinsurgency efforts. This report discusses the legal framework that applies to PSCs in Iraq and Afghanistan. After presenting a general description of the types of law applicable, including international humanitarian law and relevant status of forces agreements, the report addresses some implications of international law and a multilateral proposal for the adoption of international "best practices" regarding the use of PSCs. The report follows up with a discussion of jurisdiction over PSC personnel in U.S. courts, whether federal or military courts, identifying possible means of prosecuting contractor personnel who are accused of violating the law overseas in the context of U.S. military operations, including a listing of known cases that have occurred or are pending. Finally, the report briefly discusses the possible implication of the roles of private security contractors with respect to inherently governmental functions.
