Book excerpt: Excerpt from A Review of the Argument of President Lincoln and Attorney General Bates, in Favor of Presidential Power to Suspend the Privilege of the Writ of Habeas Corpus The argument endeavors to prove the President's power so to suspend the privilege of the writ, so to order such arrests, and that in so doing he is not controllable by the Judiciary; and perhaps, also, its true meaning is, that he is not controllable by Congress either. In other words, it seems to be con tended, that in the exercise of his executive functions, for the suppression of rebellion, at least, if not for all other purposes, he acts by his own arbitrary discretion, free from the control of Congress and the Judiciary - either, or both. The pretension to this power is not confined, either by argument or the President's acts, to such States or districts as may have been proclaimed to be in insurrection; but the power Operates all over the Union, and may be applied equally to a citizen of and in Maine, as to an inhabitant of a pro claimed State. This is a high pretension, now for the first time asserted in behalf of a President. In the existing state of things, and in view of what has already been done, it is a pretension of the most momentous importance. It places the personal liberty of every man in this nation within his arbitrary disere tion. He may arrest any one, without justifiable cause, transport him where he pleases, incarcerate him during the continuance of this war of probably many years' duration, subjecting him during the while to such deprivation, hardship, and humiliation, as the President may think proper to inflict. For all this the citizen is to have no redress. Against such atrocious, tyrannical outrage the law of his country can afford him no redress. Book excerpt: The question of which political branch has the power to suspend the privilege of the writ of habeas corpus is a classic constitutional separation of powers question with important consequences for civil liberties. However, the one case squarely addressing the question, Chief Justice Roger B. Taney's opinion in Ex Parte Merryman concerning Lincoln's suspension of the writ during the Civil War, is cited more often as a confrontation of personal wills rather than a valid legal analysis. Although history tends to assume that Taney's opinion was correct as a matter of law, while Lincoln's refusal to acknowledge the opinion was correct as a matter of necessity, the question itself remains unsettled. However, a correct answer to the question is vitally important, as recent events in the war on terror threaten to undermine civil liberties. This article attempts to determine which branch of government has the power to suspend the writ of habeas corpus through an in-depth analysis of the legal arguments surrounding Ex Parte Merryman. In conducting this analysis, it first provides a detailed recitation of the facts surrounding Taney's opinion in Merryman and Lincoln's disregard of that opinion. It then examines the framing and ratification of the Suspension Clause, and the strengths and weaknesses of various legal theories regarding which branch possesses the suspension power, paying special attention to the theories put forth by legal commentators of the period regarding the question. Ultimately, the article concludes that the power to suspend habeas corpus can only reside with Congress, and that the President has no independent power, even in time of emergency, to suspend. Finally, the article examines the relevance of the answer to the question, and its implications today.

Declared immediately after the Pearl Harbor attack, martial law was all-inclusive, bringing under army rule every aspect of the Territory of Hawaii's laws and governmental institutions. Even the judiciary was placed under direct subservience to the military authorities. The result was a protracted crisis in civil liberties, as the army subjected more than 400,000 civilians—citizens and alien residents alike—to sweeping, intrusive social and economic regulations and to enforcement of army orders in provost courts with no semblance of due process. In addition, the army enforced special regulations against Hawaii's large population of Japanese ancestry; thousands of Japanese Americans were investigated, hundreds were arrested, and some 2,000 were incarcerated. In marked contrast to the well-known policy of the mass removals on the West Coast, however, Hawaii's policy was one of "selective," albeit preventive, detention. Army rule in Hawaii lasted until late 1944—making it the longest period in which an American civilian population has ever been governed under martial law. The army brass invoked the imperatives of security and "military necessity" to perpetuate its regime of censorship, curfews, forced work assignments, and arbitrary "justice" in the military courts. Broadly accepted at first, these policies led in time to dramatic clashes over the wisdom and constitutionality of martial law, involving the president, his top Cabinet officials, and the military. The authors also provide a rich analysis of the legal challenges to martial law that culminated in Duncan v. Kahanamoku, a remarkable case in which the U.S. Supreme Court finally heard argument on the martial law regime—and ruled in 1946 that provost court justice and the military's usurpation of the civilian government had been illegal. Based largely on archival sources, this comprehensive, authoritative study places the long-neglected and largely unknown history of martial law in Hawaii in the larger context of America's ongoing struggle between the defense of constitutional liberties and the exercise of emergency powers.

Book excerpt: Federal habeas corpus is a procedure under which a federal court may review the legality of an individual's incarceration. It is most often the stage of the criminal appellate process that follows direct appeal and any available state collateral review. The law in the area is an intricate weave of statute and case law. Current federal law operates under the premise that with rare exceptions prisoners challenging the legality of the procedures by which they were tried or sentenced get "one bite of the apple." Relief for state prisoners is only available if the state courts have ignored or rejected their valid claims, and there are strict time limits within which they may petition the federal courts for relief. Moreover, a prisoner relying upon a novel interpretation of law must succeed on direct appeal; federal habeas review may not be used to establish or claim the benefits of a "new rule." Expedited federal habeas procedures are available in the case of state death row inmates if the state has provided an approved level of appointed counsel. The Supreme Court has held that Congress enjoys considerable authority to limit, but not to extinguish, access to the writ.
