The idea of pooling resources in order to better address medical conditions that are rare or require very specialized expertise or equipment, corresponds with moves towards concentration of specialized health care services, often motivated by common health systems challenges like tightening financial constraints, workforce shortages and growing attention for quality and safety. This book examines the different ways in which the concept of reference networks has been implemented in European countries, and what kind of medical conditions or interventions it covers in various countries. It also looks at the motivations behind the establishment of such networks, the regulatory and administrative processes for identifying and designating them, as well as the financial arrangements needed for their proper functioning. This study outlines the key policy implications and challenges for developing the concept of reference networks at national and European levels. Ultimately we aim to provide a better understanding of the issues that may be encountered when implementing the Directive.

Book excerpt: The 2011 Cross‐border Healthcare Directive seeks to ensure EU patients’ rights to access safe and high‐quality healthcare, including across national borders within the EU. These rights are also intended to facilitate closer cooperation between Member States on eHealth and the treatment of rare diseases. We concluded that although EU actions in cross-border healthcare enhance Member States’ collaboration, the benefits for patients were limited. We found that despite the progress made on providing EU citizens with information on cross-border healthcare, in some areas this information remains difficult to access. We identified weaknesses in the Commission’s strategic planning and project management. We make recommendations focusing on the Commission’s support for national contact points, the deployment of cross-border exchanges of health data, and EU’s actions in the field of rare diseases.

Book excerpt: European Union policy in the field of health is aimed at complementing and supporting national health policies, encouraging cooperation between Member States (MS) and promoting coordination between their programmes. The Directive 2011/24/EU on the application of patients' rights in cross-border health care aims to facilitate access to safe and high-quality cross-border health care and ensure patient mobility in the Union. The Expert Panel on Effective ways of Investing in Health was requested to identify areas which would potentially benefit from greater formal cross-border cooperation and collaboration in health care provision. This identification should focus on service configuration in border regions, but can also consider issues outside border regions. In the opinion the Expert panel looks for areas where there is potential for successful co-operations as well as the existing and potential benefits of such co-operation. Furthermore, the Expert panel identifies obstacles to successful co-operation in health care and suggests priorities of actions which could be taken at EU level in order to help overcome some of these obstacles.

The study focuses on the following areas: responsibilities of the Member State of treatment; responsibilities of the Member State where the patient is insured (reimbursement of costs for cross-border healthcare and the use of prior authorisation for reimbursement); provision of information to patients by the National Contact Points (NCPs); administrative procedures for cross-border healthcare; recognition of prescriptions issued in other Member States; mutual assistance and cooperation in healthcare in the border regions; and development of the European Reference Networks (ERNs) and cooperation in rare diseases. The study will provide DG SANTE with relevant data and analysis to support the ex-post evaluation of the Directive in accordance with the Better Regulation Guidelines (BRG). As such, the study, will seek to provide an answer to the following overarching questions: to what extent is the Directive relevant for meeting patients' needs to cross-border healthcare and what is the patients' awareness of their rights to cross-border healthcare? how effectively does the Directive operate in practice and what barriers remain to patients seeking cross-border healthcare? to what extent has the Directive delivered the expected benefits at proportionate costs, and what have been the administrative burdens for patients seeking healthcare in another Member State? how does the Directive interact with other legislation, such as the Regulation on the coordination of social security systems? in what ways has the Directive provided EU added value in terms of patient rights to cross-border healthcare and patient choice of healthcare services in the EU?
