Download or read book International Investment Law and Globalization written by Jean-Michel Marcoux and published by Routledge. This book was released on 2018-09-03 with total page 310 pages. Available in PDF, EPUB and Kindle. Book excerpt: In a context of neoliberal globalization, have the processes of elaboration and implementation of foreign investors' responsibilities by intergovernmental organizations reached the realm of legality? Using an analytical framework and a methodology that combines international law with international relations, this book provides a twofold answer to this question. First, it demonstrates that the normative integration of foreign investors' responsibilities in international investment law is fragmented and consistent with the interests of the most powerful actors. Second, while using the interactional theory of international law to assess the normative character of several international instruments elaborated and implemented by intergovernmental organizations, it highlights the sense of obligation that each instrument generates. The analysis demonstrates that such a codification process is marked by relations of power and has resulted in several social norms, with relatively few legal norms.

Book Synopsis Contemporary Issues in Politics & International Relations by : Nesrin Kenar

This book was released on 2021-12-26 with total page 453 pages. Available in PDF, EPUB and Kindle. Book excerpt: “Conflict” is a phenomenon as old as human history. Although the actors and reasons have changed, conflicts have occurred in every period of history. In the pre-Cold War era, conflicts in the international system were experienced between states. The conflicts during the Cold War mainly were interstate conflicts arising from the rivalry between the two blocs. In this period, it was expected that the threat to the security of a state would come from outside the borders of the state and from other states. For this reason, all the regulations made by the League of Nations, which was established at the end of the First World War, and the United Nations, which was established after the Second World War, to protect international peace and security included the measures to be taken against the attack or threat of attack by one state against another state. However, the developments that took place right after the end of the Cold War confirmed that the risk of interstate conflict decreased, and new security threats emerged in this period. The conflicts that emerged in the post-Cold War period were separatist conflicts due to ethnic and religious reasons, such as the former Yugoslavia and Georgia, or intra-border conflicts that occurred for other reasons, such as in Syria. Upon the inadequacy of international organizations and international law to intervene in intra-border conflicts, the concept of "security" was redefined, and a transformation from the security of the state to the security of the individual took place. New security threats such as environmental security, human security, food security, terrorism, weapons of mass destruction and pandemics have been identified. One of the reasons for the decrease in conflicts between states in the post-Cold War period is that states mostly use "soft power" instead of military force in achieving their foreign policy goals. The structure of the international system is also a dynamic that affects conflicts. After the end of the bipolar system, the transformation of the international system is not yet complete. One of the most critical problems in today's world is the competition and struggle between states to become the future superpower. While the US wants the current status quo to continue, China is trying to change the status quo in its favour. The European Union is to become the dominant power in the international system after its transformation in the post-Cold War period.
Book Synopsis The Globalization of Labour Standards by : Roger Blanpain
Download or read book The Globalization of Labour Standards written by Roger Blanpain and published by Kluwer Law International B.V.. This book was released on 2004-01-01 with total page 186 pages. Available in PDF, EPUB and Kindle. Book excerpt: "Do core labour standards exist in today's global economy? If so, what are they? And most important how effective are they?" "In this book two labour law scholars answer these questions in a definitive manner. In detail they demonstrate that, although insufficiently legally binding instruments governing employment and labour exist beyond the national level, a significant body of international soft law has developed that does in fact carry great weight. Blanpain and Colucci identity four major sources of this soft law - the UN Global Compact of 1999, the ILO Tripartite Declaration of Principles, the North American Agreement on Labour Cooperation and the OECD Guidelines for Multinational Enterprises - and show how the principles these instruments enunciate act as a countervailing power to the international economic decision-making of multinational corporations." "The authors cite relevant cases and highlight emerging trends in this important area of labour law. Annexes reprint all four of the instruments. The Globalization of Labour Standards will be welcomed by all sectors of the labour and employment law community as a fully realized analysis of what is currently available to those who would like to ensure economic and social progress in a world dominated by multinational corporations."--BOOK JACKET.

Book excerpt: Non-trial resolutions, often referred to as settlements, have been the predominant means of enforcing foreign bribery and other related offences since the entry into force of the OECD Anti-Bribery Convention 20 years ago. The last decade has seen a steady increase in the use of coordinated multi-jurisdictional non-trial resolutions, which have, to date, permitted the highest global amount of combined financial penalties in foreign bribery cases. This study is the first cross-country examination of the different types of resolutions that can be used to resolve foreign bribery cases.
